HomeMy WebLinkAboutPO 6876: EXECUTION OF A DEVELOPER PARTICIPATION CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND H & P ENGINEERING & CONSTRUCTION, INC. P. O. No. 6876 06/15/20 gt ORDINANCE NO. AN ORDINANCE AUTHORIZING THE EXECUTION OF A DEVELOPER PARTICIPATION CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND H & P ENGINEERING & CONSTRUCTION, INC. WHEREAS, pursuant to the authority in Section 212.071 and 212.072, the City may enter into a Developer Participation Contract with H & P Engineering & Construction, Inc.; and WHEREAS, H & P Engineering & Construction, Inc., plans to develop property in the area denoted in Exhibit "A" and build (60) single family residential townhome units. The deadline for the completion of this project is March 31, 2022; and WHEREAS, under a developer participation contract, H & P Engineering & Construction, Inc., shall construct the improvements and the municipality shall participate in their cost. §212.072 requires the contract to establish the limit of participation at a level not to exceed 30 percent of the total contract price; and WHEREAS, On or before August 31, 2020, construction will commence on the road or roads, water lines, sanitary sewer lines, storm sewers lines, ground raising, catch basins, other storm sewer construction, street lighting and electrical, underground utility extension, landscaping, paving, sidewalk to access pond, pond and pond landscaping and other ancillary public improvements; and WHEREAS, the City's participation shall not exceed 30% of the contract price, which is presently estimated at $194,863.50. Consistent with §212.073 of the Texas Local Government Code, the City will also require the developer to execute a performance bond for the construction of the improvements to ensure completion of the project. 7.po62-6 NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Manager is authorized to execute and agree to the project in the Developer Participation Contract with H & P Engineering & Builders, Inc., in substantially the same form as attached hereto as Exhibit "B". Section 3. That a copy of the caption of this Ordinance be spread upon the Minutes of the City Council. H&P Engineering and Construction Inc.is very interested in applying for this program and would like to discuss with you an opportunity for use of City financial support in form of incentive for the development of this project.The requested financial help would be directed toward the cost of the construction of the infrastructure of the, project.
