INVOCATION, PLEDGE & ROLL CALL Councilmember Moses gave the invocation followed with the pledge to the flag. The City Council of the City of Port Arthur met in Regular Session on Tuesday, April 21, 2020 at 11:00 a.m. in the City Council Chamber, City Hall, with the following members present: Mayor Thurman "Bill" Bartie; Mayor Pro Tern Harold Doucet, Sr.; Councilmembers Raymond Scott, Cal Jones, Thomas Kinlaw, III. and Charlotte Moses; City Manager Ron Burton; City Secretary Kelly Moore; City Attorney Valecia R. Tizeno and Sergeant At Arms Police Chief Tim Duriso. Councilmember Kaprina Frank was absent from the Special Meeting. II. INDIVIDUAL ACTION (NON-CONSENT) A. Resolutions (1) P.R. No. 21370 — A Resolution Approving The City Of Port Arthur Section 4A Economic Development Corporation Accepting A Proposal From Sitek Omni Services, LLC For Additional Selective Asbestos Abatement Services At The Former Port Arthur News Building Located At 549 4th Street, Port Arthur, Texas In An Amount Not To Exceed $42,400.00; Funds Available In EDC Account No. 305-1606-591.82.00 Project No. EDC549 The Mayor introduced the above-mentioned Proposed Resolution. Upon the motion of Mayor Pro Tern Doucet, seconded by Councilmember Jones and carried, Proposed Resolution No. 21370 was adopted becoming Resolution No. 20-120. Voting Yes: Mayor Bartle; Mayor Pro Tern Doucet; Councilmembers Scott, Jones, Kinlaw and Moses. Voting No: None. The caption of Resolution No. 20-120 reads as follows: RESOLUTION NO. 20-120 A RESOLUTION APPROVING THE CITY OF PORT ARTHUR SECTION 4A ECONOMIC DEVELOPMENT CORPORATION ACCEPTING A PROPOSAL FROM SITEK OMNI SERVICES, LLC FOR ADDITIONAL SELECTIVE ASBESTOS ABATEMENT SERVICES AT THE FORMER PORT ARTHUR NEWS BUILDING LOCATED AT 549 4TH STREET, PORT ARTHUR, TEXAS IN AN AMOUNT NOT TO EXCEED $42,400.00; FUNDS AVAILABLE IN EDC ACCOUNT NO. 305-1606- 591.82.00 PROJECT NO. EDC549 (2) P.R. No. 21371 — A Resolution Approving The City Of Port Arthur Section 4A Economic Development Corporation Accepting A Proposal From Total Safety, U.S., Inc. For Environmental Consulting Services For Selective Asbestos Abatement Services At The Former Port Arthur News Building Located At 549 4th Street, Port Arthur, Texas For A Cost Not To Exceed $9,990.00; Funds Available In EDC Account No. 305-1606-591.82.00 Project No. EDC549 The Mayor introduced the above-mentioned Proposed Resolution. Upon the motion of Councilmember Jones, seconded by Mayor Pro Tem Doucet and carried, Proposed Resolution No. 21371 was adopted becoming Resolution No. 20-121. Voting Yes: Mayor Bartle; Mayor Pro Tem Doucet; Councilmembers Scott, Jones, Kinlaw and Moses. Voting No: None. The caption of Resolution No. 20-121 reads as follows: RESOLUTION NO. 20-121 A RESOLUTION APPROVING THE CITY OF PORT ARTHUR SECTION 4A ECONOMIC DEVELOPMENT CORPORATION ACCEPTING A PROPOSAL FROM TOTAL SAFETY, U.S., INC. FOR ENVIRONMENTAL CONSULTING SERVICES FOR SELECTIVE ASBESTOS ABATEMENT SERVICES AT THE FORMER PORT ARTHUR NEWS BUILDING LOCATED AT 549 4TH STREET, PORT ARTHUR, TEXAS FOR A COST NOT TO EXCEED $9,990.00; FUNDS AVAILABLE IN EDC ACCOUNT NO. 305-1606-591.82.00 PROJECT NO. EDC549 (3) P.R. No. 21372 - A Resolution Authorizing All Regularly Scheduled Council Meetings Be Held At 11:00 A.M. While The Declaration Of Local Disaster Is In Effect (Requested By Mayor Bartie) The Mayor introduced the above-mentioned Proposed Resolution. Upon the motion of Councilmember Kinlaw, seconded by Councilmember Scott and carried, Proposed Resolution No. 21372 was adopted becoming Resolution No. 20-122. Voting Yes: Mayor Bartie; Mayor Pro Tem Doucet; Councilmembers Scott, Jones, Kinlaw and Moses. Voting No: None. The caption of Resolution No. 20-122 reads as follows: RESOLUTION NO. 20-122 A RESOLUTION AUTHORIZING ALL REGULARLY SCHEDULED COUNCIL MEETINGS BE HELD AT 11:00 A.M. WHILE THE DECLARATION OF City Council Minutes Special Meeting — April 21, 2020 2 LOCAL DISASTER IS IN EFFECT (REQUESTED BY MAYOR BARTIE) B. Ordinance (1) P.O. No. 6859 - An Ordinance Extending The Declaration Of Disaster Pursuant To §418.108(B) Of The Texas Government Code The Mayor introduced the above-mentioned Proposed Ordinance. Upon the motion of Councilmember Moses, seconded by Councilmember Kinlaw and carried, Proposed Ordinance No. 6859 was adopted becoming Ordinance No. 20-43. Voting Yes: Mayor Bartle; Mayor Pro Tern Doucet; Councilmembers Scott, Jones, Kinlaw and Moses. Voting No: None. The caption of Ordinance No. 20-43 reads as follows: ORDINANCE NO. 20-43 AN ORDINANCE EXTENDING THE DECLARATION OF DISASTER PURSUANT TO §418.108(B) OF THE TEXAS GOVERNMENT CODE III. *CLOSED MEETING (EXECUTIVE MEETING) Closed Meeting: (1) Section 551.071 Government Code — To Discuss And Receive Legal Advice From The City Attorney Regarding Potential And/Or Pending Litigation And Other Legal Matters Involving The City Of Port Arthur (2) Section 551.071 Government Code — Pursuant To Chapter 418.183(F) Of The Texas Government Code (Emergency Management) And 551. 071 Texas Government Code. Discuss Issues Related To Preparation, Response, And Mitigation Efforts Related To The Coronavirus ( COVID- 19) That Are Required As A Result Of The Federal, State, And Local Disaster Declarations That Have Been Issued (3) Section 551.087 Government Code — To Discuss Incentives For Commercial, Residential, And/Or Industrial Business Prospects Upon the motion of Councilmember Moses, seconded by Councilmember Kinlaw and carried unanimously the City Council recessed their meeting at 11:50 a.m. to meet in Executive Session to consider the above-mentioned topics, and reconvened their meeting at 1:12 p.m. with the following members present: Mayor Bartie; Mayor Pro Tem Doucet; Councilmembers Scott, Kinlaw and Moses; City Manager Burton; City Secretary Bellard; City Attorney Tizeno and Sergeant At Arms Chief Duriso. III. ADJOURNMENT OF MEETING City Council Minutes Special Meeting —April 21, 2020 3 Upon the motion by Councilmember Kinlaw seconded by Councilmember Scott and carried unanimously, the City Council adjourned their meeting at 1:14 p.m. An audio-tape of this meeting is on file in the office of the City Secretary and is made a part of the official minutes of this meeting.
