The City Council of the City of Port Arthur met in Regular Session on Tuesday, May 19, 2020 at 11:11 a.m. in the City Council Chamber, City Hall, with the following members present: Mayor Thurman "Bill" Bartie; Mayor; Councilmembers Raymond Scott, Thomas Kinlaw, III, and Kaprina Frank; City Manager Ron Burton; City Secretary Kelly Moore; City Attorney Valecia R. Tizeno and Sergeant At Arms Police Chief Tim Duriso. Mayor Pro Tern Harold Doucet, Sr. was absent from the Special Meeting. II. INDIVIDUAL ACTION — NON CONSENT Resolutions (1) P.R. No. 21361 - A Resolution Documenting That Pursuant To The Amendment Of Section 9 Of Article II Of The City Charter Approved At The May 2, 1992 City Election In The City Of Port Arthur, Texas, Position 7 Councilmember Shall Serve As Mayor Pro Tem And Shall Act As Mayor During The Absence Or Disability Of The Mayor And Shall Serve As Mayor Pro Tem Until May 2021 The Mayor introduced the above-mentioned Proposed Resolution. Upon the motion of Councilmember Kinlaw, seconded by Councilmember Jones and carried, Proposed Resolution No. 21361 was adopted becoming Resolution No. 20-156. Voting Yes: Mayor Bartie; Councilmembers Scott, Jones, Kinlaw, Moses and Frank. Voting No: None. The caption of Resolution No. 20-156 reads as follows: RESOLUTION NO. 20-156 A RESOLUTION DOCUMENTING THAT PURSUANT TO THE AMENDMENT OF SECTION 9 OF ARTICLE II OF THE CITY CHARTER APPROVED AT THE MAY 2, 1992 CITY ELECTION IN THE CITY OF PORT ARTHUR, TEXAS, POSITION 7 COUNCILMEMBER SHALL SERVE AS MAYOR PRO TEM AND SHALL ACT AS MAYOR DURING THE ABSENCE OR DISABILITY OF THE MAYOR AND SHALL SERVE AS MAYOR PRO TEM UNTIL MAY 2021 (2) P.R. No. 21403 - A Resolution Authorizing The City Manager To Enter Into A Contract Between The City Of Port Arthur And LSPS Solutions, LLC, Of Victoria, Texas For Consulting Services Related To America's Water Infrastructure Act Of 2018 For A Total Budgetary Impact Of $69,757.00; Funding Is Available In 410-1251-532.54-00, Professional Services The Mayor introduced the above-mentioned Proposed Resolution. Upon the motion of Councilmember Scott, seconded by Councilmember Jones and carried, Proposed Resolution No. 21403 was adopted becoming Resolution No. 20-157. Voting Yes: Mayor Bartle; Councilmembers Scott, Jones, Kinlaw, Moses and Frank. Voting No: None. The caption of Resolution No. 20-157 reads as follows: RESOLUTION NO. 20-157 A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND LSPS SOLUTIONS, LLC, OF VICTORIA, TEXAS FOR CONSULTING SERVICES RELATED TO AMERICA'S WATER INFRASTRUCTURE ACT OF 2018 FOR A TOTAL BUDGETARY IMPACT OF $69,757.00; FUNDING IS AVAILABLE IN 410- 1251-532.54-00, PROFESSIONAL SERVICES (3) P.R. Upon the motion of Councilmember Frank, seconded by Councilmember Moses and carried, Proposed Resolution No. 21412 was adopted becoming Resolution No. 20-158. Voting Yes: Mayor Bartie; Councilmembers Scott, Jones, Kinlaw, Moses and Frank. Voting No: None. The caption of Resolution No. 20-158 reads as follows: RESOLUTION NO. 20-158 A RESOLUTION APPOINTING AND/OR REAPPOINTING A DIRECTOR OR DIRECTORS TO THE CITY OF PORT ARTHUR SECTION 4A ECONOMIC DEVELOPMENT CORPORATION (REQUESTED BY COUNCILMEMBER FRANK) Ordinances (1) P.O. No. 6867 - An Ordinance Extending The Declaration Of Disaster Pursuant To §418.108(B) Of The Texas Government Code The Mayor introduced the above-mentioned Proposed Ordinance. Upon the motion of Councilmember Scott, seconded by Councilmember Jones and carried, Proposed Ordinance No. 6867 was adopted becoming Ordinance No. 20-49. Voting Yes: Mayor Bartie; Councilmembers Scott, Jones, Kinlaw, Moses and Frank. City Council Minutes Special Meeting — May 19, 2020 2 Voting No: None. The caption of Ordinance No. 20-49 reads as follows: ORDINANCE NO. 20-49 AN ORDINANCE EXTENDING THE DECLARATION OF DISASTER PURSUANT TO §418.108(B) OF THE TEXAS GOVERNMENT CODE III. *CLOSED MEETING (EXECUTIVE MEETING) Closed Meeting: (1) Section 551.071 Government Code — Attorney Consultation To Provide Advice And Counsel In Connection With The City's Rights, Duties, Privileges, And Obligations In Connection With Negotiations With The Port Arthur Police Association and International Fire Fighter Association Local 397 (2) Section 551.071 Government Code — To Discuss And Receive Legal Advice From The City Attorney Regarding Potential And/Or Pending Litigation And Other Legal Matters Involving The City Of Port Arthur (3) Section 551.087 Government Code — To Discuss Incentives For Commercial, Residential, And/Or Industrial Business Prospects The City Council recessed their meeting at 11:41 a.m. to meet in Executive Session to consider the above-mentioned topics, and reconvened their meeting at 12:11 p.m. with the following members present: Mayor Bartie; Councilmembers Scott, Kinlaw and Frank; City Manager Burton; City Secretary Bellard; City Attorney Tizeno and Sergeant At Arms Chief Duriso. IV. ADJOURNMENT OF MEETING Upon the motion by Councilmember Kinlaw, seconded by Councilmember Scott and carried unanimously, the City Council adjourned their meeting at 12:12 p.m. An audio-tape of this meeting is on file in the office of the City Secretary and is made a part of the official minutes of this meeting.
