SECTION 86-83 TO THE
AS IT PERTAINS TO
COM)~ERCIAL WHOLESALE REFUSE CUSTOMERS
WHEREAS, the City Council deems it in the public's
interest to add Section 86-83 to the Code of Ordinances as
to delineate rates and policies for commercial wholesale
refuse customers; and
WHEREAS, these policies include earlier gate hours and
later gate hours, which will require the approval of the
Texas Commission on Environmental Quality, as to accommodate
the expected increased usage of the City's landfill.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF PORT ARTHUR:
Section 1. That the facts and opinions in the
preamble are true and correct.
Section 2. That Section 86-83 is herein added to the
Code of Ordinances as delineated in Exhibit ~A".
Section 3. That this Ordinance, not
publication, shall be effective immediately.
Section 4. That a copy of the caption

EXHIBIT "A"
Sec. 86-83. WHOLESALE REFUSE COMMERCIAL CUSTOMERS
For Commercial Customers who commit and do bring
at least 10,000 cubic yards per month, the following
policies shall apply:
in
{1) The refuse disposal rate shall be as follows:
$5.90/cubic yard compacted material
$4.90/cubic yard non-compacted material
(2)
The City will determine the volume of each load
based on truck-mounted packer body capacity,
capacity of roll-off boxes, or capacity of other
delivery methods.
(3)
The City will, consistent with its landfill
permit, endeavor to change its gate times through
the Texas Commission on Environmental Quality as
to accommodate to the maximum extent possible the
expected usage of the landfill by commercial
customers.
(4) City will provide documented/identified gate
tickets at the end of each day to customer.
(5)
The company will pay for each day's business on
the next business day, or on a weekly or monthly
billing schedule as may be arranged with the City
Manager or his designee.
