RECOMMENDATION:
Staff is recommending the adoption of Proposed Ordinance No. 5294. If adopted by Council
the ordinance will grant developers refunds on permit fees for the building of (4) four new
residential homes. The refund will only be granted to a developer after the new homes have
been constructed. This request for the refund can only be made in January, after the
completion of the construction of the homes from the previous year.
BACKGROUND:
This proposal is being recommended as part of the City of Port Arthur's effort to stimulate
economic growth in the area and to provide an economic incentive for the construction of
new homes.
BUDGET/FISCAL IMPACT:
Permit fees for new single family residential homes range between $350.00 to $800.00 per
structure.
STAFF IMPACT:
All routine inspections will have to be performed by the City's Inspections Division. The
structures will have to comply with all Building Code requirements before a Certificate of
Occupancy can be issued to the owners.

ORDINANCE NO.
CHANGING SECTION 18-35 BUILDING PERMIT FEES OF
THE CODE OF ORDINANCES (RELATING TO ECONOMIC
INCENTIVE PROGRAM FOR NEW CONSTRUCTION). SAID
CHANGES REPEAL ALL OR PARTS OF ORDINANCES IN
CONFLICT HEREWITH; AND DECLARING THE EFFECTIVE
DATE HEREOF.
Whereas, the City desires to stimulate economic development and
provide Incentives for new construction under Chapter 380, Local
Government Code, V.C.T.A.;
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF PORT ARTHUR, TEXAS:
Section t. section t8-35 of Chapter t8 (Buildings} Article II (Building Cedes) be
amended In the Code of Ordinances for the City of Port Arthur:
"Section t 8-35 Building Permit Fees; economic incentive program"
(a} Temporary Economic Incentive Program
In order to provide Incentives for building residential units in the city, building,
~electrical, gas, plumbing, and mechanical permit fees shall be wsived for new
single-family residential structures for s purled of one year, commencing April 10,
2000, and ending April 10, 2001. Extension of this waiver will be allowed to
customers building ten or more single-family residential structures who request the
waiver before April t0, 200t, and agree to the following:
(t} Request must include legal descriptions of the lots to be developed.
(2) A minimum of 20 percent of the houses must be built annually or four
homes, whichever ia greater. The total estimated ad valorem valuation of
the homes built annually must exceed $280,000.00.
(3) No waiver will be allowed after the first year of the agreement until the
prior year's minimums are met.
(4) This agreement is not transferable and has a maximum term of five years,
and all required Inspections will be made before a structure Is Issued a
certificate of occupancy.
(b) In order to provide incentives for the construction of new residential homes in
the City of Port Arthur, building pormlt fees will be refunded for new single-family
residential structures when the following conditions are met:
(a} The customer has completed four (4} or more new single-family
residential homes during the previous calendar year within the City.
(b) Requests for refunds shall be made only between January t, and
January 3t, each year for the building permit fees paid the previous
calendar year.
(c) The customer requesting the refund must be the same customer that
Paid the permit fees being considered for the refund.
(d) The refund will be the actual cost of the permits for the structure or
strooturos.
(e) This Incentive Is only applicable for refunds wherein It pertains to
building permits issued after January 1, 2003.
(f) The City may also enter Into a Developer Partial Agreement with the
terms as delineated at the discretion of the City Council
Section 2. That this Ordinance, being an Ordinance not requiring publication, It shall
become effective January 1, 2003.
