Introduction: The intent of this Agenda Item is to seek City Council's ratification for City Manager's emergency approval for by-pass pumping and repairs to the lift station on West Port Arthur Road. The West Port Arthur Road Lift Station developed a leak in the piping feeding one of the pumps and an impeller failed on another pump. The isolation valves for both pumps were frozen due to corrosion. It was decided that the valve replacements and other repairs were an emergency because the lift station was not able to be used and this caused a potential hazard to public health. The emergency repair to the lift station was done by Shaver Construction & Contracting Services, LLC dba Silverback Services. Silverback also had to set up an emergency bypass while specialized parts for the repair were being shipped from overseas. Purchase Order Number 220077 was issued by the Purchasing Department upon receipt of the emergency authorization from the City Manager. The cost of the repair is $94,400.00 and the cost of the by-pass pumping with a 12" pump is $76,760.00. The total cost is $171,160.00 and funds are available in account no. 405-1621-532-83-00, Sewer System Maintenance. Background: On March 2, 2020, Shaver Construction& Contracting Services, LLC dba Silverback Services provided the quote to repair and by-pass the lift station with a 12" pump. Emergency approval was given by the City Manager to hire the contractor to repair the lift station due to the potential hazard to public health. A RESOLUTION REQUESTING THAT CITY COUNCIL RATIFY CITY MANAGER'S DECISION FOR THE EMERGENCY REPAIRS TO THE LIFT STATION ON WEST PORT ARTHUR ROAD FOR UTILITIES OPERATIONS DEPARTMENT BY SHAVER CONSTRUCTION & CONTRACTING SERVICES, LLC DBA SILVERBACK SERVICES OF JASPER, TEXAS WITH A BUDGETARY IMPACT OF $171,160.00, ACCT NO. 405-1621-532-83-00, SEWER SYSTEM MAINTENANCE. WHEREAS, there was a leak discovered in the lift station on West Port Arthur Road making it impossible to operate the lift station normally,which caused an immediate public health and safety concern; and, WHEREAS,the occurrence created an urgent response for repair and bypass of the station with external rental pumps; and, WHEREAS, pursuant to Section 252.022(a)(1) this expenditure is authorized because it was a public calamity that required the immediate appropriation of money to preserve the property of the municipality's residents or to preserve the property of the municipality; and, WHEREAS, it is further authorized pursuant to Section 252.022(a)(3) because of unforeseen damage to public machinery, equipment, or other property; and, WHEREAS, this sewer main was repaired by Shaver Construction & Contracting Services, LLC dba Silverback Services of Jasper, Texas, under emergency conditions authorized by the City Manager(Exhibit"A"); and, WHEREAS, the maximum total budgetary impact for the repair of the sewer line is $171,160.00 (Exhibit B); and, P.R.No.21325 7/2/20 bw Page 2 of 2 NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, in order to protect the health and safety of our citizens, the City Council hereby approves and ratifies the expenses of the emergency repairs to the sewer main on West Port Arthur Road with a budgetary impact of$171,160.00 (Exhibit B); and, THAT, a copy of the caption of this resolution be spread upon the minutes of the City Council. We cannot isolate the leak because we cannot close the two 24" isolation valves required to remove the pump and affect repairs. As City personnel do not have the means to repair it, we have solicited contractor estimates in order to remove and replace these valves.
