RE: Proposed Ordinance No. 6840: Revise ordinance amending section 86-113 (Residential
Rubbish) and section 86-114 (Commercial Refuse) of the code of ordinances, City of Port
Arthur, Texas, by adding a fee of$1.75 (section 86-113) per month from a residence, adding
an extra pick up fee per customer request, add $100 fee for extra commercial containers, and
adjust fees for pick-ups for 2 CY container and 4 CY container(section 86-114).
Introduction:
The intent of this Agenda Item is to seek the City Council's approval to adopt an Ordinance
Amendment which will amend section 86-113 (Residential Rubbish) and section 86-114 (Commercial
Refuse).
Background:
Per ordinance 17-26, the City amended the section 86-114 to increase the commercial container rates to
97% of the lowest charge in region for commercial container rates over a three-year period (2018-
2020). The City of Port Arthur's commercial rates are comparable to other cities in Texas. To
complete the fee schedule for container pick-ups, we need to add fees for extra pick up per customer
request and add fees for four(4)pick-ups per week for 2 CY and 4 CY containers and five(5)pick-ups
for 2 CY containers in the ordinance. The City has 700+ old containers that need to be
repaired/replaced. The $100 fee for the extra containers will be utilize to repair/replace the commercial
containers in service for 91 accounts. This fee is estimated to generate $205,000 a year. The City has
been picking up residential bulk waste/tree rubbish at no charge for the residents of Port Arthur for
several years. This ordinance proposes to add a fee of$1.75 a month for bulk waste/tree rubbish pick-
up which is estimated to generate $365,000 a year. This has been a complimentary service to the
residents of Port Arthur, which also includes staff time and resources to address illegal dumping
throughout the city. Since January 2020,we have collected 85,000 CY of bulk waste/tree rubbish.
- Section 86-113, A fee will-net of $1.75 per month will be charged for regular service trash
collection from a residence; new each customer paying the fee for regular service
garbage collection shall be entitled to one regular service trash collection each two weeks.
- Subsection(a)(1)of Section 86-114, see Exhibit A.
Budget Impact:
Adoption of this Ordinance Amendment will generate revenue for Residential Service and Commercial
Service and pay for ongoing costs for the Solid Waste/Landfill Operations.
Recommendation:
Staff is requesting City Council to amend section 86-113 (Residential Rubbish) and section 86-114
(Commercial Refuse).

AN ORDINANCE AMENDING THE CODE OF ORDINANCES
SECTION 86-113 (RESIDENTIAL RUBBISH) BY ADDING A FEE
OF $1.75 PER MONTH FOR RESIDENTIAL CUSTOMERS AND
AMENDING SECTION 86-114 (A)(1) (COMMERCIAL REFUSE) BY
ADDING A FEE FOR EXTRA COMMERCIAL REFUSE PICK-UP
BASED UPON CUSTOMER REQUESTS, ADDING SECTION 86-114
(A)(9) BY ADDING A $100 FEE FOR EXTRA COMMERCIAL
CONTAINERS AND ADJUSTING FEES FOR 2 CY AND 4 CY
CONTAINERS
WHEREAS, it is deemed in the best interests of the City of Port Arthur to
amend Chapter 86 of the Code of Ordinances to reflect changes in the fee schedule as it
pertains to residential rubbish and commercial refuse; and
WHEREAS, a copy of the proposed amendments and additions red-lined and
attached hereto as Exhibit"A".
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR,TEXAS:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That Section 86-113, residential rubbish service of Article IV (Fees) is
hereby amended to add a fee of$1.75 per month for all residential customers; and
Section 3. That Subsection(a) (1) of Section 86-114, Commercial Refuse-Regular
Service of Article IV (Fees) is hereby amended to add a fee for extra commercial refuse pickup
based upon customer requests; and
Section 4. That Subsection(a) (9) be added in Section 86-114, Commercial Refuse-
Regular Service of Article IV (Fees)Ordinance is hereby amended Exhibit"A"; and
Section 5. The above provisions are all to be inserted in the affected Code of
Ordinances, City of Port Arthur, Texas, in the sequence required by their designation; and
Section 6. That all Ordinances and parts of Ordinances in conflict with this
Ordinance are hereby repealed to the extent of the conflict.
Section 7. That this Ordinance requires publication and an effective date of August 1,
2020.
Section S. That a copy of the caption of the Ordinance be spread upon the Minutes of
the City Council.

Sec. 86-113 Residential Rubbish
A fee met of $1.75 per month will be charged for regular service trash collection
from a residence; nevertheless, each customer paying the fee for regular service garbage
collection shall be entitled to one regular service trash collection each two weeks.
Sec. 86-114.—Commercial Refuse.
(a) Regular Service.
(1)Commercial premises (excluded from this rate charge are multiple dwelling complexes
such as trailer parks and apartment units) will receive sanitation container system service
for removal of trash and garbage under the rates hereinafter set forth, as routes for such
services are established by the city. All institutions, on-hand service, will be required to
change to container service when the solid waste superintendent shall deem necessary
and the containers are made available by the Solid Waste Department. Under this system,
the City of Port Arthur will furnish containers of proper size for ample storage between
collections. Charges will be made for the service according to the size of the container
and the number of weekly pickups as follows:
