AN ORDINANCE AUTHORIZING A JOINT ELECTION AGREEMENT BETWEEN THE CITY OF PORT ARTHUR AND JEFFERSON COUNTY PERTAINING TO THE CONDUCT OF THE NOVEMBER 3, 2020 GENERAL ELECTION FOR THE PURPOSE OF ELECTING SIX (6) COUNCILMEMBERS, IN THE CITY OF PORT ARTHUR, TEXAS WHEREAS, pursuant to Ordinance No. 20 - the City Council ordered a General Election for the purpose of electing six (6) councilmembers, in the City of Port Arthur, Texas; and WHEREAS, a Presidential Election is being held on November 3, 2020 by the County; and WHEREAS, pursuant Section 418.016 of the Texas Government Code, the Governor suspended Sections 41.0052(a) and (b) of the Texas Election Code to the extent necessary to allow political subdivisions to move their elections for 2020 only to the next uniform date, occurring on November 3, 2020. WHEREAS, the Jefferson County Clerk has proposed a Joint Election Agreement, attached in substantially the same form as attached hereto as Exhibit "A", to coordinate, supervise, and handle the General Election as it pertains to the Presidential election as well as other municipal and local elections in Jefferson County; and WHEREAS, there will be changes as to the voting locations and the hours, as denoted in Exhibit "A"; and WHEREAS, the early voting locations and hours are delineated in Exhibit "A". NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: z.po6887 Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the conduct of the General Election for the purpose of electing six (6) councilmembers shall be delineated in the Joint Election Agreement with Jefferson County, which is attached as Exhibit"A". Section 3. That pursuant to Sections 31.093 and 42.0621(c) of the Texas Election Code all county election officers, if requested by an affected political subdivision are required to enter into a contract to furnish election services requested. Pursuant to the Proclamation signed by Governor Greg Abbott on March 18, 2020, any political subdivision who postponed their election to November 3, 2020, under the authority of the Governor's proclamation may require county election officials to contract to furnish election services. Section 4. That the election day and early voting polling locations and voting hours shall be as delineated in Exhibit "A". Section 5. That the City Manager shall sign the Joint Election Agreement in substantially the same form as denoted in Exhibit "A". Section 6. That the Mayor shall cause a Notice of General Election to be published in a form to be approved by the City Attorney, which may be consolidated with other entities as to save costs. Section 7. That this being an Ordinance amending an Ordinance which does not carry a penalty, and does not require publication shall take effect immediately from and after its passage. Section 7. That any and all portions of Ordinance No. 20- in conflict herewith is herein repealed as to the extent of the conflict only. z.po6887 Section 8. That a copy of the caption of this Ordinance be spread upon the Minutes of the City Council.
