Change Order No. 1 —Addition of 30 calendar days due to COVID-19 restrictions and delays; Project No.: ST1P06. Introduction: The intent of this Agenda Item is to authorize the City Manager to execute Change Order No. 1 which adds 30 calendar days to the original contract time for the 60th Street Improvement Project: West Port Arthur Road to Canal Street. Background: Pursuant to Resolution No. 19-341, Elite Contractors&Equipment,LTD of Kirbyville, Texas(Contractor)was awarded the project for 60th Street Improvement Project: West Port Arthur Road to Canal Street for the amount of$775,500.00 and a contract time of 288 calendar days. The Contractor had to suspend construction as a result of COVID-19 on March 30, 2020. Work resumed on April 6, 2020 with a skeleton crew that was not able to perform and/or meet benchmarks established. On May 4, 2020, the Contractor was able to reassemble a full crew to resume construction. Change Order No. 1 is being submitted to add 30 calendar days to the contract completion time amending the original contract completion date of July 21,2020 to the new contract completion date of August 20, 2020. Budget Impact: Change Order No. 1 has no impact on funds in the Capital Improvement Account for the Street Maintenance and Repair, Account No. 307-1601-591.86-00. Project No. ST1P06. Recommendation: It is recommended that the City of Port Arthur City Council approve PR 21479 with Elite Contractors & Equipment, LTD of Kirbyville, Texas (Contractor)authorizing the City Manager to execute Change Order No. 1 adding 30 calendar days to the contract completion time amending the original contract completion date of July 21, 2020 to the new contract completion date of August 20, 2020. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 1 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND ELITE CONTRACTORS & EQUIPMENT, LTD OF KIRBYVILLE, TEXAS FOR THE 60TH STREET IMPROVEMENT PROJECT FROM WEST PORT ARTHUR ROAD TO CANAL STREET THAT ADDS 30 CALENDAR DAYS TO THE ORIGINAL CONTRACT COMPLETION DATE OF JULY 21, 2020 CHANGING IT TO THE NEW CONTRACT COMPLETION DATE OF AUGUST 20, 2020. THERE IS NO BUDGETARY IMPACT TO THE CAPITAL IMPROVEMENTS STREET ACCOUNT NO. 307-1601-591.86-00. PROJECT NO. ST1P10. WHEREAS, pursuant to Resolution No. 19-341, the City of Port Arthur City Council awarded a contract for the 60th Street Improvement Project: West Port Arthur Road to Canal Street to Elite Contractors & Equipment, LTD of Kirbyville, Texas (Contractor) for the amount of $775,500.00 and the contract time of 288 calendar days.; and, WHEREAS, the Contactor had to suspend construction as a result of COVID-19 on March 30, 2020 because of limited availability of workforce; and, WHEREAS, the Contractor was able to assemble a full crew and resume construction operations by May 4, 2020; and, WHEREAS, Change Order No. 1 is being submitted by Elite Contractors & Equipment, LTD of Kirbyville, Texas (Contractor) for the addition of 30 calendar days to the changing the original contract completion date from July 21, 2020 to the new contract completion date of August 20, 2020. See Exhibit A; and, WHEREAS, Change Order No. 1 does not increase the original contract price of $775,500.00; and, PR No. 21479 7/31/2020 mje Page 2 of 4 WHEREAS, approval of Change Order No. 1 is herein deemed an appropriate action; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct; and, THAT, Change Order No. 1 is herein approved and the City Manager is authorized to execute said Change Order No. 1 to the contract between the City of Port Arthur and Elite Contractors & Equipment, LTD of Kirbyville, Texas (Contractor) for the addition of 30 calendar days changing the original contract completion date from July 21, 2020 to the new contract completion date of August 20, 2020, attached hereto in substantially the same form as Exhibit"A"; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
