BACKGROUND: The City will submit the 34th Year Consolidated Plan as an application -for a grant of $1,358,218 Community Development Block Grant Funds (CDBG) and a grant for $435,802 in HOME funds. BUDGETARY/FISCAL IMPACT: The Consolidated`Plan refers to a grant to be made by the United States Department of Housing and Urban Development fora Community Development Block Graht of $1,358,218 and for HOME funds $435,802 for the 2008 program year. STAFFING/EMPLOYEE EFFECT: Funding will.not have an effect on our staffing level. THE CONSOLIDATED PLAN WILL BE SUBMITTED TO THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT. WHEREAS, pursuant to the Housing and Urban Development Act of 1974, as amended, Public Law 93-383, the City will submit to the United States Department of Housing and Urban Development (HUD) the 34`k (2008 Program Year) Consolidated`Plan as an application for a grant of $1,358,218 Community Development Block Grant Funds (CDBG) and a grant for $435,802 in HOME funds; and, WHEREAS, the 34`h Year Consolidated Plan will include a proposed list of Projects for 2008 and certifications. The Consolidated Plari sets forth the City of Port Arthur's long-term goals for community development, housing, non-housing and homeless services. Through the collaborative efforts of the City of Port Arthur, its citizens, nonprofit organizations and. service agencies, afive-year investment plan was derived. The Consolidated Plan establishes the City's goals for providing decent housing, suitable living environments and expanding economic opportunities for its citizens. These strategies will be achieved through the allocation of federal funds from the Community Development Block Grant (CDBG) and Home Investment Partnership (HOME) programs and other sources received over the next fve years. ACTION PLAN The 2008 Consolidated Action Plan summarizes the major housing and community development needs oflow-moderate income households in Port Arthur. The program year begins on June 1 and ends on May 31. The Department of Housing and Urban Development (HUD) has notified the City that the following funds will be available: • $1;358,218 in Community Development Block Grant (CDBG) funds • $ 435,802 in Home Investment Partnership (HOME) funds The City of Port Arthur anticipates generating $48,899 in program income during the 2008 program year. The primary sources of program income are loan repayments through CDBG and HOME housing programs and demolition repayments. Program income from the HOME program will fund new home construction and rehabilitation/reconstruction activities. CDBG funds returned to the loan program are used for future lending. The Action Plan also serves as the City of Port Arthur's annual application to HUD for these funds. The objectives and activities funded in this plan also provide a framework for assessing the City's performance in achieving its overall community development goals. CITIZEN PARTICIPATION PROCESS In an effort to increase public participation in the Consolidated Plan process; the City of Port Arthur conducted two public hearings. The hearings were held at City Hall. City Hall is located in the low- incomedowntown area of the City and is adjacent to several other low-income areas. City Hall has handicapped parking spaces and accommodations for wheelchairs. The public hearing meetings were held on the following dates: ° Monday, November 26, 2007 Monday, March 24, 2008 The purpose of the hearings was to inform the public of the consolidated planning process and to solicit comments and suggestions on the allocation of funds. Notices for the hearings were published in the Port Arthur News and direct mailings. The city will7evolve:all program income back into the Housing Assistance Program. 6 PRIORITI( Housing Community Development Needs Texas Department of Housing & Community Affairs' (TDHCA) Community Development Block Grant (CDBG) Disaster Recovery Program U.S. Departmerit of Housing and Urban Development approved the State of Texas' Action Plan for Disaster Recovery that describes the proposed use of U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) funding associated with the Department of Defense Appropriations Act, 2006 (PublicLaw 109-148, approved December 30, 2005) for disaster relief of unmet housing and infrastructure needs resulting from Hurricane Rita in the most impacted and distressed areas of Texas. Public Law 109-148 (effective December 30, 2005) provided $11.5 Billion of supplemental appropriation for the CDBG program for necessary expenses related to disaster relief, long-term recovery, and restoration of infrastructure in the most impacted and distressetl areas related to the consequences of Hurricanes Rita, Katrina and Wilma. Of this amount, $74,523,000 was specifically allocated to Texas by the Secretary of HUD to address the consequences of Hurricane Rita, of which a minimum of 55 percent was to be provided for housing activities. The funds are intended by HUD to be used toward meeting unmet housing, infrastructure, public service, public facility and business needs in areas of concentrated distress. The Federal Register (Volume 71, Number 29) includes a definition of "unmet housing needs" as including, but not being limited to, those of uninsured homeowners whose homes had -major or severe damage; and "concentrated distress" is defined as the total number of housing units with major or severe housing damage in counties where 50 percentor more of units had more or severe damage. As provided for in Public Law 109-148, the funds may not be used for activities reimbursable by or for which funds are made available by FEMA or the Army Corps of Engineers. The availability of funding was formally announced in the Federal Register (Volume 71, Number 29) on February 13, 2006. The CDBG Disaster Recovery Program housing allocation must be used solely for expenses related to disaster relief, .long-term recovery, and restoration of housing in the most impacted and distressed areas, and will: Meet urgentand unmet housing needs resulting from damage caused by Hurricane Rita; Eliminate safety and health hazards resulting from Hurricane Rita in eligible homes and communities; and . , Preserve and improve the community's housing stock. - TDHCAwill disallow expenditures if it is determined that funds provided under the CDBG Disaster Recovery Program were not disaster related or funds allocated duplicate other benefits. No person, business concern, or other entity may receive CDBG Disaster Recovery funds to assist with anypart of a loss resulting from Hurricane Rita if financial assistance has been received under any other program or from insurance or any other source. In addition, CDBG Disaster Recovery funds may not be used for activities reimbursable by or for which funds have been made available by the Federal Emergency Management Agency or by the Army Corps of Engineers. The Governor's Office has designated the Texas Department of Housing and Community Affairs (TDHCA) as the lead agency to administer the CDBG Disaster Recovery Program housing allocation in the areas impacted by Hurricane Rita. The office of Rural Community Affairs (ORCA) was designated as the administering authority for non-housing funds awarded under the CDBG Disaster Recovery Program. TDHCA has determined that the housing needs of Texas families affected by Hurricane Rita will be best served by contracting directly with regional Councils of Governments (COGs). Housing funding under the CDBG Disaster Recovery Program is provided directly to the following COGs: South East Texas Regional Planning Commission (SETRPC) . Deep East Texas Council of Governments (DETCOG) . Houston-Galveston~Area Council (HGAC) The three (3) regional COGS are providing assistance for activities directly related to Hurricane Rita. Types of assistance available to an affected region are determined by the contractual agreement between the applicable COG and TDHCA, and are limited to: Demolition; Emergency repair; Rehabilitation; . Reconstruction or new construction; Down payment assistance; or Acquisition; and Activities directly related to and/or supporting the above types of assistance. 8 The City of Port Arthur received $5,565,000 to implement a Community Development Block Grant (CDBG) Disaster Recovery Program. The CDBG Disaster Recovery Program is designed and the funds will be used to demolish dilapidated buildings and houses, and conduct feasible rehabilitation and reconstruction to assisf persons and families who are at 80% of the Median Family Area Income and below with unmet housing needs resulting from Hurricane Rita, eliminate health and safety hazards resulting from Hurricane Rita in eligible homes and communities and preserve and improve the community's housing stock. 9. PRIORITY Non-Housing. Community Development Needs The City of Port Arthur has identified the following priority non-housing community development needs eligible for assistance by CDBG: A. Elimination of slums and blight and the prevention of blighting influences that adversely affect the welfare of the community, principally persons of low and moderate income. B. Elimination of conditions which are detrimental to health, safety and public welfare, through code enforcement, demolition, residential rehabilitation assistance, and related activities.. C. Conservation and expansion of the City's housing stock in order to provide a decent home and a suitable living, environment for all persons, but principally those of low and moderate-income. D. Expansion and improvement of the quantity and quality of community services; principally for persons of low and moderate-income, which are essential for sound community development and for the development of a viable urban community. E. Amore rational utilization of land and other natural resources within CDBG eligible afeas. F. The restoration and preservation of properties of special value for historic, architectural, or esthetic reasons. G. The alleviation of physical and economic distress through the stimulation of private investment and community revitalization. 10 i STATEMENT OF SPECIFIC ANNUAL OBJECTIVES In addition to identifying and prioritizing the City of Port Arthur's housing and community development needs, the City's FY 2005 - 2009 Consolidated Plan also established a series of general goals for its housing and community development programs. These goals will remain in effect until the year 2009 unless revised by City Council with an amendment to the Plan. The goals are as follows: , Goal 1: Assist low and moderate income families in becoming first-time homeowners. Goal 2: Assist low income homeowners with rehabilitation of new home construction. Goal 3: Improve infrastructure in low to moderate-ihcome areas of the City. Goal 4: Demolish dangerous residential and commercial structures. Goal 5: Provide effective code compliance. Goal 6: Target social services to meet needs of low-income households. Goal 7: Assist the City of Part ArthurHousing Authority, if necessary, with the replacement of . public housing units. The city's need for housing and the demolition of dangerous structures has increased due to the damages caused by hurricane Rita. Many families were forced to relocate to other cities due to a lack of decent, safe and sanitary housing. . 11 Outcome Performance Measurement System The City of Port Arthur has defined its performance measures for the 2008 activities as follows: I. Because low-income, eldedy, disabled and special needs homeowners reside throughout the City, housing assistance is available citywide. Homeless persons and those-faced with potential homelessness, also residing throughout the city, making the need for sheltering and housing a citywide activity. Assistance for special needs populations (elderly, disabled, persons with drug/alcohol additions, persons with HIVIAIDS) is provided citywide as these populations exist throughout the city. Public Services are also not limited geographically. The city recognizes the need that exists within the target areas. However, the city reserves the right to provide assistance to any area where a demonstrated need exists. HOMELESS AND OTHER SPECIAL POPULATION The City of Port Arthur will continue to partnership with the Southeast Texas Coalition for thet_ Homeless. The Coalition is the only regional resource focused on ending homelessness in Southeast Texas in ten years. NEEDS Of PUBLIC HOUSING The Port Arthur Housing Authority is applying for funding from the Texas Bootstrap Loan Program to build twenty-five single=family homes. The 25 homes are a portion of the 100 homes thafthe Port Arthur Housing Authority will build in the next two years. ANTIPOVERTY STRATEGY In other effbrts to raise families out of poverty, Lamar State College - BortArthur Scholarship Program continues to assist residents in receiving a college education. The Program is designed to lower the cost of education making it affordable to anyone desiring to receive either a vocational/technical certificate or complete the first two years of academic college courses. The City by way of CDBG funds provides qualified students with tuition, fees, and cost of books. In order to make affordable housing available to lower to middle income, the City's Housing Department targets low to moderate-income families for housing assistance. LEAD-BASED PAINT HAZARDS The City of Port Arthur has incorporatedeHUD lead=based paint guidelines into its Housing Assistance Program Guidelines According to 24 CFR Parf35, HUD requires that purchasers and. tenants of HUD associated housing constructed priorto 1978 shall be notified: That the property was constructed prior to 1978; That the property may contain lead-based paint; Of the hazards of lead-based paint; Of the symptoms and treatment of lead-_based paint; Of the precautions to be taken to avoid lead-based paint poisoning. 39 MONITORING The City of Part Arthur shall meet all requirements set forth by the Office of Management and Budget and shall comply with the requirements and standards of OMB Circular A-87 and A-133, and with the applicable sections of 24 CFR Part 85. An independerit audit is conducted. annually to ensure that CDBG funds are used in accordance with program requirements. Subreci pient. Monitoring Monitoring subgrantees provides a basis for assessing program operations and identifying problems. A secondary goal of monitoring is to obtain ongoing data for use in determining program achievement. Evaluations will summarize monitoring Endings, program goals and measure progress toward those goals during the provision of services. All subgrantees will be monitored at least once per .year. The City has responsibility for overall CDBG performance and Consolidated Plan compliance, including the. performance of its subgrantees. Clear record keeping requirements for subgrantees are essential for grant accountability. Program and a First Time Homebuyer Assistance Program. The Owner Occupied Rehabilitation and Reconstruction of Housing Program is to assist low and moderate income property owners in maintaining their home, eliminate housing code violations and upgrade neighborhoods. Through this program, the City will help provide decent, safe and sanitary housing for eligible citizens of the city. Homes acquired with HOME and CDBG program funds have to satisfy the. affordability requirements for a time no less than the applicable penod as indicated the table that follows, beginning after a project has been completed. During the affordability period, the following rules related to the buyers investment, the HOME and CDBG program funds are applicable: The dwelling acquired with the HOME subsidy will be the principal residence of the participant and will not be rented or used for other purposes. The Muhicipaliy-will inspect the property to assure that the participant is in compliance with these requirements during the affordability period of the property. The non-compliance -with the terms and condition mentioned in this provision will obligate the participant to reimburse the total amount of the subsidy to the Municipality.- . The affordability period. of the property will be as follows: Homeownership Assistance per Unit Affordability Period (Years) Amount up to $7,500 5 _ Amount up to $20,000 20 If the participant sells the property within the affordability periods and net proceeds are sufficient to repay HOME and/or CDBG homeowner investment, the Municipality will recover the full amount of HOME andlor investment: The participant will recover any amount for investments and apply the following formula for distribution of surplus net proceeds. Other requirements shall apply: The participants will pay $5,000 to cover the cost of legal service in case of breaches of any of the terms and condition of this provision. 43 The participant will allowthat the CDBG & HOME subsidy constitute a second mortgage to their property. . Specific documentation required tq calculate CDBG & HOME and net proceeds. o Housing Unit Sale Price (Settlement Statement) o Homeowner Investments -evidence of down payment, closing costs, payments to principal, owner paid closing costs at the point of sale, and any other capital investment to improve the housing unit. - o Documentation required includes settlement statements for original purchase and sale and. all receipts of capital expenditures. o -Once the documentation is presented, the amount of recapture will be determined on a case-by- case basis. In addition to the recapture restrictions to be incorporated in the deed of sale and promissory note, other provisions will be established to guarantee that the units remain affordable for subsequent homebuyers. These provisions include the following considerations: A provision restricting refinancing and subsequent mortgages of the property, without the written consent of the Municipality.. Refinancing will be limited to capital improvements without equity return. This restriction is necessary, as refinancing with cash return will have the effect of reducing the profit at resale thus violating the purpose of recapture provisions. In addition, a higher monthly payment after refinancing could represents risk of foreclosure due to income adjustments. A requirement that the property will be used as the principal .residence of the homebuyer(s) will not be leased, converted, sold, donated, and pennuted to other such use without written consent of the Municipality. In the implementation of the Homeownership Program, the Department will comply-and will require recipients to comply with the provisions of 24 CFR 92.217, Income targeting Homeownership and 24 CFR 92.254, Qualifications as affordable housing. 44 HOME Tenant•Based Rental Assistance The City of Port Arthur doesn't use HOME funds for tenant-based rental assistance. Forms of Investment The City of Port Arthur will use its HOME funds only in areas of assistance as described. in 24 CFR 92.205. Affirmative Marketing.
