RE: A Resolution Approving a Settlement in the Amount of $36,977.91 Against Texas
Municipal League (TML) for Flood related Damages to the Water Meter Transmitters and
Components
Nature of the request: On August 30, 2017, the water meter transmitters and components
sustained damages during the flooding from Hurricane Harvey.
Staff Analysis, Considerations: The City has Flood insurance coverage through Texas
Municipal League (TML). Texas Municipal League (TML) has offered the City a settlement of
$36,377.91, less the 1% deductible of the value of the equipment in the amount of $9,679.00,
making the final settlement offer $26,698.91. This amount is sufficient to cover all current
property damages for the water meter transmitters and components. If additional damages are
discovered, Texas Municipal League (TML) may issue a supplemental payment.
Recommendation: I recommend approval of Proposed Resolution No. 21575 authorizing the
property damage settlement against Texas Municipal League (TML) for damage sustained to
water meter transmitters and components. Texas Municipal League (TML) has offered to settle
the claim for $36,377.91, less the 1% deductible of the value of the building in the amount of
$9,679.00, making the final settlement offer $26,698.91. This is considered a fair and reasonable
settlement.
Budget Considerations: The funds received will be deposited in the Insurance Proceeds
Account#147-0000-369.85-00, Project#082617.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER
TO EXECUTE THE SETTLEMENT OF A CLAIM IN THE AMOUNT OF $36,377.91
MADE AGAINST TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL
(TML-IRP) AS A RESULT OF THE FLOOD DAMAGE TO THE WATER METER
TRANSMITTERS AND COMPONENTS
WHEREAS, on August 29, 2017, Hurricane Harvey struck the City of Port Arthur,
resulting in flood damage to the water meter transmitters and components used by
meter readers; and,
WHEREAS, as a result of the damage, a claim was filed with Texas Municipal
League Intergovernmental Risk Pool (TML-IRP); and,
WHEREAS, Texas Municipal League Intergovernmental Risk Pool (TML-IRP) has
offered to settle the claim for $36,377.91 , less the 1 % deductible in the amount of
$9,679.00, making the final settlement offer $26,698.91 , which has been determined
to be a fair and reasonable settlement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUR, TEXAS:
Section 1 . That, the facts and opinions in the preamble are true and correct.
Section 2. That, the City Manager is hereby authorized to execute the settlement
for flood damage to water meter transmitters and components in the amount of
$36,977.91 , less the 1 % deductible in the amount of $9,679.00. This amount is based
on an estimated cost for flood-related repairs; therefore, if additional flood-related costs are
incurred, Texas Municipal League Intergovernmental Risk Pool (TML-IRP) may issue a
supplemental payment.
