Comeaux, P.E., Director of Public Works SUBJECT P.O. #5879 -Establish Construction Speed Zone for US 69 DATE April 14, 2008 RECOMMENDATION: I recommend that the City Council approve Proposed Ordinance No. 5879, establishing a temporary construction speed zone along US 69 from Jimmy Johnson Boulevard to SH 73 BACKGROUND: The Texas Department of Transportation (TxDOT) is scheduled to let a construction project in May 2008 that will replace an existing bridge over Main. B Canal and construct new exit/entrance ramps and a new bridge over the canal. The construction will require lowering the speed limit from the existing 70 mph to 60 mph at times during the project when activities such as closing median breaks, establishing new ramps, establishing detours, etc. require the change. The speed zone will alldw the Police DepartmenYto enforce the lowered speeds, and TxDOT will post signs when needed. -The construction speed zone will remain in effect until the project is complete. BUDGETARY/FISCAL EFFECT: None. EMPLOYEE/STAFF EFFECT: None. SH 73 in Port. Arthur. This project will consist of the. replacement of an existing bridge and approaches; as well as the construction of a new bridge, exit, and entrance ramp. 1Ne request the city of Port Arthur pass the necessary ordinance to establish a construction speed zone of 60 mph to enhance safety to the project locatidn. This construction -speed zone is necessary for construction purposes only during the duration of the project. When the project is complete, the construction speed zone will terminate and the current posted speed zone will resume. It will be the city's responsibility to enforce the posted speeds during-all phases of this ` process. Please include along with the,ordinance, the city secretary certification and original seal. AN ORDINANCE DESIGNATING A TEMPORARY CONSTRUCTION SPEED ZONE ON US :HIGHWAY 69, PROVIDING FOR AN EFFECTIVE DATE, AND FOR PUBLICATION WHEREAS, the -Texas Department of Transportation (TxDOT) is planning improvements and repairs to US Highway 69 between Jimmy Johnson Boulevard and State Highway 73 in the City of Port Arthur; and, WHEREAS, for the safety of travelers and workers, TxDOT has requested the City establish a construction speed zone from May 2008 until the end of the project; and, WHEREAS, the cohstruction speed zone will reduce the existing speed limit on US 69 from 70 miles per hour (mph) to 60 mph at various times as required by the construction activities; and, _ WHEREAS, TxDOT will post the necessary signage to allow the City of Port Arthur Police Department to enforce the posted speeds; and, WHEREAS, the City Council deems it in the best interests to establish a temporary construction speed zone for this project as requested by TxDOT; and, NOW, THEREFORE, BE IT ORDAINED BY •THE CITY COUNCIL OF -THE CITY OF PORT ARTHUR, TEXAS: ` Section !. That the facts and opinions in the preamble. are true and correct; and, Section 2. That a temporary construction speed zone be designated along US Highway 69 from .Jimmy Johnson. Boulevard to State Highway 73, reducing the speed 9 P.O. 5879 , Page 2 limit from ,70 mph to 60 mph as needed by TxDOT according to the construction activities, .and that TxDOT will place appropriate signage wheri required, allowing enforcement of the speed limits; and, Section 3. That this being an Ordinance which requires publication, its caption shall be published at least one (1) time within ten (10) days after final passage hereof in the official newspaper of the City of Port Arthur, and this Ordinance shall take effect immediately after the date of•publieation; and, ' Section 4. That, a copy of the caption of this Ordinance be spread upon the Minutes of the City Council. .
