AN ORDINANCE AF~ENDIN~ SECTION 86-83 TO THE CODE OF ORDINANCES AS IT PERTAINS TO COMMERCIAL WHOLESALE REFUSE CUSTOMERS WHEREAS, on October 15, 2002, the City Council approved Resolution 02-52,which added Section 86-83 to the Code of Ordinances as it pertains to wholesale refuse customers; and WHEREAS, Section 86-83 of the Code of Ordinances should be amended as denoted in Exhibit UA" as to reflect wholesale rates for non-compacted material to be $4.50/cubic yard instead of $4.90/cubic yard; WHEREAS, Subsection 6 is customer responsibility for substances. being added to address prohibited or hazardous NOW THEREFORE, BE IT ORDAINED THE CITY OF PORT ARTHUR: Section 1. WHOLESALE REFUSE COMMERCIAL CUSTOMERS For Commercial Customers who commit and do bring in at least 10,000 cubic yards per month, the following policies shall apply: (1) The refuse disposal rate shall be as follows: $5.90/cubic yard compacted material $4.50/cubic yard non-compacted material (2) The City will determine the volume of each load based on truck-mounted packer body capacity, capacity of roll-off boxes, or capacity of other delivery methods. (3) The City will, consistent with its landfill permit, endeavor to change its gate times through the Texas Commission on Environmental Quality as to accommodate to the maximum extent possible the expected usage of the landfill by commercial customers. (4) City will provide documented/identified gate tickets at the end of each day to customer. The company will pay for each day's business on the next business day,' or on a weekly or monthly billing schedule as may be arranged with the City Manager or his designee. (6) Any customer who deposits prohibited and/or hazardous substances in the City's landfill for which the City is not permitted to take, shall be responsible to the City and shall indemnify the City for any and all costs, penalties and fines that may be assessed up to the maximum available by law. z.po5299 3
