A RESOLUTION AUTHORIZING THE CITY OF PORT ARTHUR SECTION 4A ECONOMIC DEVELOPMENT CORPORATION TO TERMINATE THE REMAINDER OF THE CONTRACT WITH CATS RESOURCES AND ENTER INTO AN AGREEMENT WITH PANAMA EQUIPMENT FOR THE ENGINEERING, CONCRETE BASE, GENERATOR SERVICE, ENCLOSURE AND PLATFORM FABRICATION ASSEMBLY, AND GENERATOR SETTING FOR THE 500K DIESEL GENERATOR (THE "PROJECT") DONATED BY CHRISTUS ST. MARY'S HOSPITAL FOR THE 549 4TH STREET PROPERTY (THE PRESS BUILDING) IN THE AMOUNT OF $249,425.66; FUNDS AVAILABLE IN PAEDC ACCOUNT NO. 120-1429-582.53-00 WHEREAS, it is deemed in the best interest of the citizens of Port Arthur to create an environment that promotes business, entrepreneurial and community development; and WHEREAS,Christus St.Mary's Hospital has donated a 500k Diesel Generator to support the development of the Community and Business Center (the "Press Building") for use at 549 4th Street; and WHEREAS, per Resolution 20-054, the City Council approved the City of Port Arthur Section 4A Economic Development Corporation ("PAEDC") entering into an agreement with CATS Resources for the removal of the 500KW Diesel Generator and to transport to a designated storage location at a cost not to exceed$30,610.13; and WHEREAS, Matthew Truett, the Technician employed by CATS who is to provide the scope of work for the Project,ceased employment with CAT5 and began employment with Panama Equipment; and WHEREAS, the Operations Director for CAT5 Resources has agreed to cancel the remainder of their contract for the generator install for the PAEDC and have been paid for the removal of the generator(see attached documentation attached as Exhibit"A"; and WHEREAS, Panama Equipment submitted attached Exhibit "B" as their quote for the new scope of work; and WHEREAS, the PAEDC Board of Directors at their Board Meeting of September 14, 2020, approved the quote with Panama Equipment for the removal, rebuild and replacement of both turbo,replacement 0 rings for the coolant tubes, complete service(change 18 gallon oil, 3 oil filters, 2 fuel filter, change 30 gallon of coolant, 2 coolant filters, lift and install generator on to sub base tank, bolt generator to tank, plumb fuel suction and return lines, generator base tank and generator enclosure to meet generator specs). NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Council of the City of Port Arthur hereby approves PAEDC terminating the remainder of the contract with CATS Resources and entering into an agreement with Panama Equipment to provide the scope of work as detailed in Exhibit "A" at a cost not to exceed $249,425.66. Section 3. That a copy of the caption of this Resolution shall be spread upon the Minutes of the City Council.
