TECHNICALLY BASED LOCAL LIMTS (TBLLS) PROJECT, PHASE 2 IN THE AMOUNT OF $177,000.00 WATER UTILTIES ADMINISTRATION INTEROFFICE MEMORANDUM Date: October 14, 2020 To: The Honorable Mayor and City Council Through: Ronald Burton, City Manager From: Donald Stanton, Interim Director of Water Utilities RE: PR 21578 – Contract from Freese and Nichols, Inc.—Technically Based Local Limits(TBLLs) Project, Phase 2 in the Amount of$177,000.00 Introduction: The City of Port Arthur, despite its commercial and industrial growth, has not scientifically revised its Technically Based Local Limits in over 20 years. The City's current local limits in its TCEQ approved Industrial Pretreatment Program(IPP) are outdated and pose challenges for the pretreatment staffto enforce compliance on the Industrial Users(IUs). The intent of this Agenda Item is to seek City Council's approval enter into a contract between the City of Port Arthur and Freese and Nichols, Inc. (FNI), of Pearland, Texas, for Phase 2 of a multiphase Development of Technically Based Local Limits (TBLLs) Project for the Main and Port Acres Wastewater Treatment Plants (WWTPs). FNI was selected by an RFP (Res. 19-220). The Scope of Work for these Professional Services includes execution of the sampling plan for collection of data needed and development of new Technically Based Local Limits(TBLLs) for both the Main and the Port Acres WWTPs in accordance with the EPA local limit guidance manual and appropriate state regulations. Also included in this Scope of Work is coordination with TCEQ, analytical laboratory, and other stakeholders; on the new TBLLs. The Scope of Work does not include legal review by an attorney or other modifications to the Industrial Pretreatment Program(IPP). Professional Services include: 1. FNI will coordinate the execution of the sampling plan with the City of Port Arthur and the analytical laboratory for: a. 7-day influent and effluent sampling at each plant b. 7-day sludge sampling at each plant c. 7-day domestic/commercial sampling at five collection system locations 2. FNI will collect and review the data from the sampling plan execution. FNI will collect and review WWTPs and industrial flows to determine the industrial and the non-industrial loadings. 3. FNI will develop the TBLLs based on the EPA and TCEQ pretreatment program guidance for both the Main Wastewater Treatment Facility (TPDES permit #WQ0010364001) and the Port Acres Wastewater Treatment Facility (TPDES permit #W0010364002): a. Calculate WWTP removal efficiency for the POCs. b. Develop Maximum Allowable Headworks Loading (MARL) based on Texas Surface Water Quality Standards, TexTox modeling toxicity limits, process inhibition standards, and sludge disposal criteria. c. Develop Maximum Allowable Industrial Loading(MAIL). d. Calculate TBLLs for the POCs. 4. FNI will prepare two (2) copies of the Draft TBLL Report and provide to the City of Port Arthur for review. Incorporate City of Port Arthur review comments prior to final submittal to TCEQ. One electronic copy in PDF format will also be provided to the City of Port Arthur. 5. FNI will submit two (2) copies of the TBLL Report to TCEQ and provide City of Port Arthur with one (1) copy of the Final report. One electronic copy in PDF format will also be provided to the City of Port Arthur. Phase 1, pursuant to Res. 19-220, allowed for the determination of a TCEQ approved a site sampling plan and list of contaminants to test(to avoid unnecessary expenses in Phase 2); Phase 2, consists of execution of a sampling and analysis plan, special services performed by Eastex Environmental of Coldspring, Texas for influent sampling and laboratory testing, drafting and submittal of the plan to the Texas Commission on Environmental Quality(TCEQ) in an amount not to exceed $70,000.00. Background: The City is required by the TCEQ to re-evaluate the TBLLs for the Main and Port Acres Wastewater Treatment Plants, as part of the Texas Pollution Discharge Elimination System (TPDES)permit renewal. The Main plant permit renewal has been completed and the Port Acres Plant renewal is still being processed by the TCEQ. Technically Based Local Limits (TBLLs), also commonly called local limits, are a crucial component of the Industrial Pretreatment Program. These are limits on harmful pollutants that industrial customers shall not exceed in their wastewater discharge to the City's collection system. The TBLLs are essential to protect the WWTP operation and to ensure the plant complies with its effluent and sludge regulations. The TBLLs in the City's current pretreatment program are more than 25 years old and are outdated. The limits are not representative of the current flow characteristics at the WWTPs, industrial sources, and pose some challenges in implementation and compliance. In order to ensure that the City remains in compliance with its approved Industrial Pretreatment Program and remains current on the treatment capabilities of the WWTPs, a TBLL redevelopment is necessary. The City of Port Arthur, despite its commercial and industrial growth, has not scientifically revised its TBLL in over 20 years. Cost Analysis: A redevelopment of TBLL requires extensive sampling and analytical testing of the city's WWTPs as well as the sanitary sewer collection system. This sampling is done over a set period of days and require substantial time and resources to perform. Furthermore, various technical reports and communication with the TCEQ is required during the entire process. FNI has worked on numerous water and wastewater projects for the City of Port Arthur and therefore has extensive knowledge of the city wastewater treatment facilities and processes. In order to minimize the budgetary impact of the TBLL study, the project will be conducted in phases. The first phase will provide a regulatory required baseline assessment of the WWTPs influent. Based upon this assessment, the 2nd phase can be tailored to the specific needs of the city. FNI has since presented a contract for Phase 2, Development of Technically Based Local Limits (TBLLs) project for the Main and Port Acres WWTPs. Phase 1, approved by Res. 19-220, consisted of developing a sampling and analysis plan which include sampling the influent of both plants in the amount of$70,000.00 which include Special services (Laboratory analysis). The Phase 1 of the TBLL study will identify the pollutants of concern that require development of new local limits. With the identified pollutants of concern in Phase 1, the level of effort and cost of Phase 2 was accurately calculated. The projected budgetary impact for Phase 2 will be $177,000. Schedule: Phase 2 of the project: the expected start date of Phase 2 of the TBLL study was in October 2020, which is on track as projected. Budget Impact: The not to exceed amount of$177,000.00 is dedicated to Phase 2 of the Technically Based Local Limits Project. The Account Number 410-1260-532.54-00, Water Utilities Department, Regulatory Services Division, is to be used. Recommendation: It is recommended that City Council adopt Proposed Resolution No. 21578, which authorizes City Manager to enter into a contract with Freese and Nichols, Inc., to execute the new Technically Based Local Limits for both the Main and Port Acres WWTPs, to be funded through Account 410-1260-532.54-00, Water Utilities Department, Regulatory Services Division, in the amount of$177,000.00 for Phase 2. WHEREAS, the City of Port Arthur is being required by the Texas Commission on Environmental Quality (TCEQ) to re-evaluate the Technically Based Local Limits (TBLLs) for the Main and Port Acres Wastewater Treatment Plants (WWTPs), as part of the Texas Pollution Discharge Elimination System(TPDES)permit renewal;and, WHEREAS,the City's current local limits in its TCEQ approved Industrial Pretreatment Program(IPP) are outdated and has not been redeveloped in nearly 20 years and pose challenges for the City's WWTPs,industrial and commercial facilities as well the pretreatment staff ability to adequately enforce US Environmental Protection Agency(EPA)and TCEQ mandated compliance on Industrial Users(IU); and, WHEREAS, Purchasing issued and advertised Request for Proposals on December 4, 2018 and December 9, 2018;and, WHEREAS,two(2)companies provided proposals as delineated in Exhibit"A"; and, WHEREAS, a committee made up of City staff evaluated all of the proposals and Freese and Nichols of Pearland, Texas was ranked as the most reasonably qualified company (see evaluation matrix attached hereto as Exhibit"A"); and, P. ARTICLE I BASIC SERVICES: FNI shall render the following professional services in connection with the development of the Project: A. General FNI will perform general administrative duties associated with the Project including progress monitoring, scheduling, general correspondence, office administration, and invoicing. These duties include day-to-day contact and liaison with the OWNER,TCEQ,and project staff: ensuring the needs of the OWNER are met in a timely manner; providing project communication; and monitoring work on the project. FM will represent the City in dealing with TCEQ on all TBLL development activities and work with the City staff to meet the TCEQ's required schedule for TBLL development.The parties recognize that FNI,OWNER and TCEQ each play a role in meeting these schedules. FNI shall not be responsible for any delays over which it does not have control. B. Meetings 1. Hold one(I)meeting to kick-off TBLL sampling with OWNER and project team. 2. Hold one(1)meeting to review proposed TBLLs with OWNER. 3. Conduct one(1)coordination meeting to with TCEQ on the proposed TBLLs. 4. Conduct one(1)meeting with industries and other stakeholders to discuss the proposed TBLLs. 5. Assist OWNER with one(I)presentation to the City Council on the proposed TBLLs. Attachment SC FNI SC-1 OWNER C. TECHNICALLY BASED LOCAL LIMITS 1. SPECIAL SERVICES: FNI shall render the following professional services in connection with the development of the Project: TBLL Sampling and Analytical Testing 1. Sampling includes the 7-day pollutant sampling at the Main and Port Acres WWTP and the collection system to develop the TBLLs for the pollutants of concern identified in the Sampling Plan(Refer to "Appendix A—TBLL Sampling Pollutants". FNI will coordinate with the analytical laboratory for the execution of the sampling plan. FNI will coordinate with the analytical laboratory and the OWNER on the set-up of autosamplers at the Main and Port acres WWTP and domestic sampling locations, sample collection, and analysis. Services will include costs of analytical testing of the sampling locations,sample collection,and analysis. ARTICLE II ADDITIONAL SERVICES: Additional Services to be performed by FNI, if authorized by Owner, which are not included in the above described basic services,are described as follows: A. Any additional sampling required by the TCEQ in addition to the pollutants listed in Appendix A. B. Additional meetings,presentations and workshops in excess of the quantity included in Basic Services. C. Update and/or coordination of new sewer use ordinance and program with the OWNER's existing ordinance and program. Changes to the ordinance under this contract will be limited to those sections Attachment SC FNI SC-2 OWNER affecting the Technically Based Local Limits calculations. D. Modifications to the City Sewer Use Ordinance(SUO),Enforcement Response Plan(ERP),and Standard Operating Procedures(SOP). E. Preparing data and reports for assistance to OWNER in preparation for hearings before regulatory agencies, courts, arbitration panels or any mediator, giving testimony, personally or by deposition, and preparations therefore before any regulatory agency,court,arbitration panel or mediator. F. Assisting OWNER in the defense or prosecution of litigation in connection with or in addition to those services contemplated by this AGREEMENT. Such services, if any, shall be furnished by FNI on a fee basis negotiated by the respective parties outside of and in addition to this AGREEMENT. G. Providing basic or additional services on an accelerated time schedule. The scope of this service includes cost for overtime wages of employees and consultants, inefficiencies in work sequence and plotting or reproduction costs directly attributable to an accelerated time schedule directed by the OWNER. H. Preparing statements for invoicing or other documentation for billing other than for the standard invoice for services attached to this professional services agreement. ARTICLE III TIME OF COMPLETION: FNI is authorized to commence work on the Project upon execution of this Agreement and agrees to complete the services in accordance with the following schedule: • TBLL Development Kick-off Meeting— 15 days from Notice to Proceed • Execution of Sampling Plan—30 days from receiving Notice to Proceed • Draft TBLL Report—60 days from receiving sampling plan results from analytical laboratory • Final TBLL Report to TCEQ — 15 days from receiving comments from OWNER on the draft TBLL report If FNI's services are delayed through no fault of FNI, FNI shall be entitled to adjust contract schedule consistent with the number of days of delay. These delays may include but are not limited to delays in Owner or regulatory reviews, delays on the flow of information to be provided to FNI,governmental approvals, etc. These delays may result in an adjustment to compensation as outlined on the face of this Agreement and in Attachment CO. ARTICLE IV RESPONSIBILITIES OF OWNER: OWNER shall perform the following in a timely manner so as not to delay the services of FNI: A. Legal review of the IPP Ordinance and Certifications by an attorney. B. Development of financial programs, revenue sources, equipment, staffing and organizational chart of those positions which will be employed to implement the pretreatment program. C. Designate in writing a person to act as OWNER's representative with respect to the services to be rendered under this AGREEMENT. Such person shall have contract authority to transmit instructions, receive information,interpret and define OWNER's policies and decisions with respect to FNI's services for the Project. Attachment SC FNI__ SC-3 OWNER D. Assist FNI by providing all available information pertinent to the Project including previous reports and any other data relative to the Project. E. Provide all criteria and full information as to OWNER's requirements for the Project, including objectives,constraints, performance requirements, and any budgetary limitations; and furnish copies of all pertinent standards which OWNER will require to be included in the project. F. Arrange for access to and make all provisions for FNI to enter upon public and private property as required for FNI to perform services under this AGREEMENT. G. Examine all studies,reports, sketches, drawings,specifications,proposals and other documents presented by FNI,obtain advice of an attorney,insurance counselor and other consultants as OWNER deems appropriate for such examination and render in writing decisions pertaining thereto within a reasonable time so as not to delay the services of FNI. H. Furnish approvals and permits from all governmental authorities having jurisdiction over the Project and such approvals and consents from others as may be necessary for completion of the Project. I.
