ORDINANCE NO.
AN ORDINANCE AMENDING ORDINANCE NO. 20-68 PERTAINING
TO THE CONDUCT OF THE NOVEMBER 3, 2020 GENERAL ELECTION
IN THE CITY OF PORT ARTHUR, TEXAS IN ACCORDANCE WITH
CHAPTER 271 OF THE TEXAS ELECTION CODE (REQUESTED BY
MAYOR BARTIE).
WHEREAS, pursuant to Ordinance No. 20-89, City Council the City of Port Arthur
amended its Original General Election Ordinance No. 20-68 pertaining to the conduct of
both general and special elections in the City of Port Arthur; and
WHEREAS, it has been proposed that Section 5 of Ordinance No. 20-89 be
amended with regard to the date of the runoff election.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That Section 5 of Ordinance 20-89 is amended as follows:
That pursuant to Section 67.003 of the Texas Election Code, the City Council of the
City of Port Arthur shall meet on November 17, 2020, which is within fourteen (14) days
following election day (November 3, 2020) and officially canvass the returns and declare
the results of said Election. The respective candidate receiving a majority of the votes cast
at said election for Districts 1, 2, 3, 4 and Positions 7 and 8 shall be declared to be elected.
in the event that a candidate does not receive the majority of votes cast in the General
Election, a runoff election shall be held as provided in Section 2.025(a) of the
Texas Election Code on December 12, 2020.

Section 3. That an ordinance Ordering of a Runoff Election shall be presented to
City Council for consideration and final approval consistent with the requirements of Section
2.2024 of the Texas Election Code.
Section 4. That this Ordinance shall take effect immediately from and after its
passage.
Section 5. That a copy of the caption of this Ordinance be spread upon the
Minutes of the City Council.
READ, ADOPTED AND APPROVED on this day of November, A.D., 2020, at a
Council Meeting of the City Council of the City of Port Arthur, Texas, by the following vote:
