RE: PR 21729—Polymers for Water and Wastewater Treatment
Introduction:
The intent of this Agenda Item is to seek City Council's approval to amend Resolution#20-283
for the purchase of polymers for water purification and wastewater treatment.
Background:
City Council approved Resolution#20-283 on September 8, 2020. An error in the unit cost for
Advanced Oxidation Services, and some additional polymers were left off. Our water
purification and wastewater treatment processes use polymer coagulants to remove solids from
water. Each process uses a unique blend of chemicals for maximum effectiveness. These
polymer blends are sole-source and proprietary in their make-up. This Resolution authorizes the
purchase of each of these products as each is needed so that our treatment personnel may make
use of the most cost-effective treatment system at any given time. All water/wastewater
treatment chemicals are administered by trained employees who are properly certified by the
Texas Commission on Environmental Quality.
Recommendation:
It is recommended that City Council approve P. R. No. 21729, authorizing the purchase of sole
source polymers by Water Utility Operations Department.

A RESOLUTION AMENDING RESOLUTION NO. 20-283
AS IT RELATES TO THE PURCHASE OF SOLE SOURCE
POLYMERS AND CORRECTING PRODUCTS AND
PRICING WITH NO INCREASE IN THE APPROVED
ESTIMATED COMBINED BUDGETARY IMPACT OF
$1,645,000.00. FUNDING AVAILABLE IN WATER
UTILITIES ACCOUNT NOS. 410-1252-532.29-02,
$1,510,000.00, (WATER TREATMENT CHEMICALS) AND
410-1256-532.29-02, $135,000.00 (WASTEWATER
TREATMENT CHEMICALS)
WHEREAS, pursuant to Resolution 20-283 approved on September 8, 2020 and attached
hereto for reference as Exhibit"A",the City Council authorized the Director of Water Utilities to
purchase proprietary sole source chemicals-polymers; and
WHEREAS, a correction in the product price and packaging is required, attached in
substantially the same form as Exhibit"B".
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
THAT,the facts and opinions in the preamble are true and correct; and,
THAT, Resolution No. 20-283 is hereby amended by replacing Exhibit "B"to reflect the
correct products and prices of said polymers; and,
THAT,the Director of Water Utilities shall present the purchase of proprietary chemicals
that are expected to cost more than $25,000 per year without advertising for bids for approval to
City Council; and,
THAT, a copy of the caption of this Resolution shall be spread upon the Minutes of the
Meeting of the City Council.

A RESOLUTION AUTHORIZING THE DIRECTOR OF
WATER UTILITIES TO PURCHASE POLYMERS AND
DELINEATING PROCEDURES FOR THE PURCHASE
OF OTHER CHEMICALS, WITH AN ESTIMATED
COMBINED BUDGETARY IMPACT OF $1,645,000.00.
FUNDING AVAILABLE IN WATER UTILITIES
ACCOUNT NOS. 410-1252-532.29-02, $1,510,000.00,
(WATER TREATMENT CHEMICALS) AND 410-1256-
532.29-02, $135,000.00 (WASTEWATER TREATMENT
CHEMICALS).
WHEREAS, the Director of Utilities is responsible for Water Purification and
Wastewater Treatment Plants; and,
WHEREAS,the Water Purification Plant takes raw water from the Lower Neches Valley
Authority canal, clarifies, disinfects, stabilizes, and treats the water so that it can be distributed as
drinking water for the public; and,
WHEREAS, the Wastewater Treatment Plants receive wastewater from throughout the
City, clarify, disinfect, stabilize, and treat the wastewater so that it can be safely discharged back
into our nation's waterways; and,
WHEREAS, most of the chemicals used for treatment are common commodities of
standard chemical composition, which are sold by numerous distributors, and the City can obtain
these chemicals through the bid process; and,
WHEREAS, these types of common commodities include,but are not limited to: sodium
bi-sulfite, sodium hydroxide, liquid chlorine, anhydrous ammonia, hydrofluosilicic acid, sodium
chlorite,and phosphates;and,
WHEREAS, certain other chemicals are not of standard chemical composition and are
available only from one source because of patents, copyrights, secret processes, or natural
monopolies; and,

WHEREAS, these chemicals are usually polymers used at the treatment plants for
various purposes, see the list in Exhibit A; and,
WHEREAS, these proprietary chemicals have to be tested at the plant to determine if
they can properly treat,and not create adverse conditions to the plant or to the water.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
THAT,the facts and opinions in the preamble are true and correct; and,
THAT,the Director of Water Utilities shall present the purchase of proprietary chemicals
that are expected to cost more than $25,000 per year without advertising for bids for approval to
City Council; and,
THAT, the Director of Water Utilities shall have the discretion to choose the amount of
proprietary chemicals-polymers so long as he does not exceed his yearly budget for this item, the
chemicals are approved by the TCEQ and National Sanitation Foundation, are successfully tested
at the plant. and that the manufacturer thereof is financially stable and has liability insurance. Ii
through testing, Director of Water Utilities discovers other proprietary chemicals that he desires
to purchase in excess of $25,000 per year, he shall submit that chemical to City Council for
adding to the approved list;and,
THAT, a copy of the caption of this Resolution shall be spread upon the Minutes of the
Meeting of the City Council.
