AN ORDINANCE AMENDING CHAPTER 78, ARTICLE II, DIVISION 5 OF THE PERSONNEL POLICY OF THE CITY OF PORT ARTHUR ADDING SECTION 78-191 TO THE CODE OF ORDINANCES PROVIDING FOR A COVID-19 HEALTH AND SAFETY POLICY WHEREAS, on March 13, 2020, a Declaration of State of Disaster was issued by Governor Greg Abbott as a result of the wide-spread danger to the public as a result of COVID-19; and WHEREAS, pursuant to Ordinance No. 20-23, the Mayor and City Council of the City of Port Arthur declared a Public Health Emergency as a result of the COVID-19 pandemic; and WHEREAS, on March 24, 2020, the Mayor issued a Declaration of Disaster due to the far-reaching impact of the disease and its impact on the community which has been extended and is currently in effect; and WHEREAS, in order to reduce the risk of exposure to COVID-19 in the workplace, it is necessary for the City to implement procedures which strictly comply with guidance issued by federal, state, and local authorities. The proposed policy will outline the specific steps that the City will take to reduce the risk of employee exposure to COVID-19 in the workplace; and WHEREAS, it is deemed in the best interest of the City to implement this ordinance as it sets forth the preventative measures required as it relates to work practice controls, cleaning and disinfecting procedures, what to do if a worker becomes sick, and s.po6932 personal protective equipment ("PPE"). Moreover, individual departments may have additional protocols based on the nature of the job duties and work setting. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City of Port Arthur's COVID-19 Healthy and Safety Policy attached hereto as Exhibit "A" is hereby adopted. Section 3. That this being an ordinance that does not require publication, it will be effective immediately upon passage. Section 4. That all ordinances and parts of ordinances in conflict herewith are herein repealed to the extent of the conflict. The personnel policies to the employees shall also be amended accordingly. Section 5. That a copy of the caption of this Ordinance be spread upon the Minutes of the City Council.
