COMMENTS
RECOMMENDATION:
Staff is recommending the adoption of Proposed Ordinance No. 5300. On October 15, 2002,
Ordinance No. 02-49 was adopted by City Council. The ordinance grants developers refunds on
tap fees for the building of four (4) new residential homes. The refund is granted toa developer
after the new homes have been constructed. The request for the refund can only be made in
January, after the completion of the construction of the homes from the previous year. This
ordinance changes the effective date to allow applicable fees paid between November 13, 2002,
and December 31,2002, to be included with the 2003 requests for refunds.
BACKGROUND:
This proposal is being recommended as a part of the City of Port Arthur's effort to stimulate
economic growth in the area and to provide an economic incentive for the construction of new
homes.
BUDGET/FISCAL EFFECT:
Tap fees for new single-family residential homes range between $600 to $750 per structure.

(CONNECTIONS) OF ARTICLE II (WATER) AND
PARAGRAPH (5) IN SECTION 110-168 OF DIVISION 2
(CONNECTIONS) OF ARTICLE III (SEWER) OF THE
CODE OF ORDINANCES, CITY OF PORT ARTHUR; SAID
CHANGES REPEAL ALL ORDINANCES AND PARTS OF
ORDINANCES IN CONFLICT HEREWITH; AND
DECLARING THE EFFECTIVE DATE HEREOF.

WHEREAS, the City desires to promote economic development and provide
incentives for new construction under Chapter 380, Local Government Code, V.C.T.A.;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
Section 1. Paragraph (b) (7) of Section 110-61 of Division 2 (Connections), Article II
(Water) of Chapter 110 (Utilities) of the Code of Ordinances, City of Port Arthur, is amended
to read as follows:
"Sec. 110-61. Service connection."

In order to provide incentives for building residential units in the City, water tap
fees shall be refunded for new single-family residential structures when the
following conditions are met:
(a) The customer has completed four (4) or more new single-family residential
homes during the preceding calendar year within the City.
(b) Requests for refund may be made only between January I and January 31
each year for the tap fees paid during the preceding calendar year,
(c) The customer requesting a refund shall be the same customer that paid the
tap fees being considered for refund.
(d) The refund shall be for the actual tap fee paid for each home with a
maximum of $450 per home.
(e) This incentive is only appficable for refunds wherein it pertains to building
permits issued after November 13, 2002. Applicable fees paid between
November ~3, 2002, and December 31, 2002, will be included with the 2003
fees for refunds.
(f) The City may enter into Development Participation Agreements with terms
as delineated at the discretion of the City Council.

Section 2. Paragraph (5) of Section 110-168 of Division 2 (Connections), Article 111
(Sewer) of Chapter 110 (Utilities) of the Code of Ordinances, City of Port Arthur, is amended
to read as follows:
"Sec. 110-168. Fees."

fees shaft be refunded for new single-famfty residential structures when the
foflowing conditions are met: .,
(a) The customer has completed four (4) or more new single-famfty residential
homes dur!ng the preceding calendar year within the City.
(b) Requests for refunds may be made only between January 1 and January 31
each year for the tap fees paid dudng the preceding calendar year.
(c) The customer requesting a refund shall be the same customer that paid the
tap fees being considered for refund
(d) The refund shall be for the actual tap fee paid for each home with a
maximum of $300 per home.
(e) This incentive is only applicable for refunds wherein it pertains to building
permits issued after November 13, 2002. Applicable fees paid between
November 13, 2002, and December 31, 2002, will be included with the 2003
fees for refunds.
(f) The City may enter into Development Participation Agreements with terms
as delineated at the discretion of the City Council.
Section 3. That this being an ordinance not requiring publication, it shall be effective
immediately.
Section 4. That this Ordinance repeals and supercedes Ordinance No. 02-49.

Council.
