Contract Amendment between the City of Port Arthur and the
Department of State Health Services for the WIC Program
RECOMMENDATION:
It is recommended that the City Council approve Proposed Resolution No. 14725 approve the
FY 2007-08 contract between the City of Port Arthur and the Texas Department of State Health
Services to continue the WIC program.
BACKGROUND:
This is a contract amendment. The WIC program provides supplemental food vouchers and
nutrition education to enhance good health care at no -cost to low-income pregnant and
postpartum women, infants, and children identified to be at nutritional risk. This amendment is
to increase the current reimbursement rate of $11.22 per participant to $11.83 and to provide
additional funding to implement the Electronic Benefits Transfer (EBT) system.
STAFFING/EMPLOYEE EFFECT:
None..
BUDGETARY EFFECT:
The increase in WIC reimbursement will offset the cost of personnel, fringe benefits, travel,
equipment, and supplies for 12 employees.
SUMMARY:
It is recommended that City Council approve P.R. No. 14725 to amend the FY 2007-08 contract
between the Texas Department of State Health Services and. the City of Port Arthur, as such
contract will provide for an increase in the reimbursement rate and additional funding for EBT
implementation.

RESOLUTION NO.
A RESOLUTION TO AMEND THE FY 2007-08 CONTRACT
BETWEEN THE CITY OF PORT ARTHUR AND THE
DEPARTMENT OF STATE HEALTH SERVICES; WIC CARD
PARTICIPATION
WHEREAS, the contract between the City of Port Arthur and the Department of State
Health Services, will provide financial assistance to the Port Arthur City Health Department to
supplement the delivery of public health services; and,
WHEREAS, WIC Card Participation. provides for supplemental food instruments,
nutrition education -and counseling to enhance good health care at no cost to low-income
pregnant and postpartum women, infants and children identified to be at nutritional risk of which
the grant awazd is based on monthly client participation; and,
WHEREAS, the FY 2007-08 contract was approved by Resolution No. 07-459 on
October 9, 2007; and,
WHEREAS; the Texas Department of State Health Services wishes to amend the
existing FY 2007-08 contract to increase the participant-rate and provide additional funding to
implement the Electronic Benefits Transfer (EBT) system.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
Section 1. That, the facts and opinions in the preamble are true and correct.
Section 2. That, the City Council of the City of Port Arthur hereby approves the
Amendment to the contract between the City of Port Arthur and the Department of State Health
Services.

Section 3. That, the City Council deems it is in the best interest of the City to
approve and authorize the City Manager and the Director of the City's Health Department to
execute the Amendment to the contract between the Department of State Health Services and the
City of Port Arthur, TX to continue the Women. Infants and Children (WIC) program as
delineated in Exhibit "A".
Section 4. That,. a copy of the caption of this Resolution be spread upon the Minutes of
the City Council.

To
The Department of State Health Services (DSHS) and PORT ARTHUR CITY HEALTH DEPARTMENT
(Contractor) agree to amend the Program Attachment # 001 (Program Attachment) to Contract # 2008-
024650 (Contract) in accordance with this Amendment No. OOIA : NSS -WIC CARD PARTICIPATION ,
effective 05/01/2008
The purpose of this Amendment is To increase participant rate extra fundine (increase by $12 810) reouired

Therefore, DSHS and Contractor agree as follows:
SECTION ZI. SPECIAL PROVISIONS, first paragraph under section titled PARTICIPANTS SERVED PER MONTH
MAXIMUM REIMBURSEMENT, is replaced with the following:
PARTICIPANTS SERVED PER MONTH MAXIMUM REIMBURSEMENT:
During the term of the contract Attachment, Contractor shall earn administrative funds at the rate of
$1 1.83 for each participant served. as defined above.
SECTION II.. SPECIAL PROVISIONS, fourth paragraph under section titled PARTICIPANTS SERVED PER MONTH
MAXIMUM REIMBURSEMENT, subparagraphs 1 and 2, are are revised and replaced with the following:
Contractor agrees that:
(1) Contractor shall identify and document separately not less than 19% of total administrative costs
as expenditures directly related to nutrition education and counseling vith tl~e exception f the
m n h of the Contractor's electronic benefits transfer (EBTI implementation and the

documentation of participant attendance ornon-attendance within the DSHS WIC Program.

education and counseling, but not more than is earned based on actual participation not to exceed

DSHS.
