NO. 14717 - AWARDING A CONTRACT TO SKR CONSTRUCTION FOR THE REPLACEMENT OF ANIMAL CAGES IN THE ANIMAL CONTROL BUILDING COMMENT RECOMMENDATION: Staff recommends that the Ciry Council adopt P. R. No. 14717 authorizing the City Manager to execute a contract with SKR Construction in the amount of $18 500.00 for the replacement of animal cages in the Animal Control Building. BACKGROUND: Bids for replacing the animal cages were opened on April 23, 2008. SKR Construction is the low bidder• their bid is $18 500.00 to be completed within thirty (30) days from the date they receive a Notice to Proceed. Bid award is based on the lowest and most responsive bid. K-T Maintenance Company, Inc. bid $19,830.00 (30 days); and Heat & Power Boiler Service, Inc. bid $22,400.00 (73 days). **Cardinal Fence Company bid $6,750.00 (days not specified); attached is a letter from Cardinal Fence Company explaining their misunderstanding of the specifications. Based on that information, their bid is not being considered. BUDGET AND REVENUE IMPACT: Acceptance of this recommendation will not require a budget amendment. Funding is available in Account No. 00]-1401 551.32-00. STAFF LEVEL IMPACT: Acceptance of this recommendation will have no effect on current staffing level. SUMMARY: Staff recommends that the City Council adopt P. R. No. 14717, thereby authorizing the execution of a demolition contract between the City of Port Arthur and SKR Construction in the amount of $18,500.00. DTP RESOLUTION NO. P. R. No. 14717 05/02/08 DTP A RESOLUTION AWARDING A CONTRACT TO SKR CONSTRUCTION IN .THE AMOUNT OF $18,500.00, AND AUTHORIZING THE EXECUTION OF THE CONTRACT TO REPLACE ANIMAL CAGES IN THE ANIMAL CONTROL BUILDING; TO BE CHARGED TO ACCOUNT NO.001-1401-551.32-00. WHEREAS, the City of Port Arthur's Animal Shelter is in need of replacing its anima] cages; and WHEREAS, the City received four (4) bids from K-T Maintenance Company, Inc.; SKR Construction, Heat & Power Boiler Service, Kamp's Junction, Inc. Cardinal Fence Company, and WHEREAS, the lowest bidder was Kamp's Junction, Inc. dba Cardinal Fence Company; however, this bid was later withdrawn as denoted in Exhibit "A"; and WHEREAS, the next lowest responsible bidder is SKR Constmction of Port Arthur, Texas. NOW "THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the Ciry Council of the City of Port Arthur hereby awards a contract for the replacement of the animal cages in the Animal Control Building to the lowest and most responsible bidder to-wit:. SKR Construction; and, THAT the City Manager of the City of Port Arthur is hereby authorized and directed to execute on behalf of the Ciry of Port Arthuz an agreement between the City of Port Arthur and SKR Construction, for the contract price of $18,500.00 (a copy of said contract is attached hereto as Exhibit "B"); and, 'THAT said contract is a duplicate of the standard form Contract previously approved by the City's Ixgal Department except fox the changes shown on the Certificate of Standard Foxm Contract, a copy of which is attached hereto and is hereby incorporated by reference as Exhibit "C", and said changes are hereby approved; and, TI-IA'T a copy of the caption of this Resolution be spread upon the Minutes of the Ciry Council. 1 P. F. ~rl EXHIBIT "B" REPLACEMENT OF ANIMAL CAGES AT THE ANIMAL CONTROL BUILDING THIS AGREEMENT, made this 20`" day of Mav, 2008, by and- between the City of Port Arthur, a municipal corporation organized under the laws of the State of Texas,. hereinafter called "OWNER" OR "CITY" and SKR CONSTRUCTION, a(n) herein acting Individual, firm, partnership or corporation by and through JOSE I. SANCHEZ, hereinafter called "CONTRACTOR". WITNESSETH: That for and in consideration of the payment terms, conditions and agreements set forth herein, OWNER and CONTRACTOR agree as follows: I.
