NOTICE IS HEREBY GIVEN, PURSUANT TO SECTION 211.007, LOCAL GOVERNMENT
CODE, THAT A REGULAR MEETING OF THE ZONING BOARD OF ADJUSTMENTS OF THE
CITY OF PORT ARTHUR, TEXAS WILL BE HELD ON THURSDAY MAY 22, 2008 AT 4:00 P.M.

REQUESTED ACTION: Consider a request. for a variance to permit the construction of
an on-premise sign at less than the required 15 feet„

with an 8' setback rather than the 15 feet required.

STAFF ANALYSIS AND RECOMMENDATION
The applicant is making a variance request related to signage at this location. The request
is to permit a sign to be constructed with an 8 foot setback rather that the required 15 feet.
In granting a variance, the Zoning Ordinance requires that the Zoning Board of
Adjustment make three (3) of the four (4) following findings.
A. Special circumstances exist related to size, shape, area, topography,
surrounding conditions and location that do not apply generally to other
property in the same area and the same zoning district.
The property is located on a corner increasing the distance from the travel lanes.
In addition TXDOT has purchased addiitional right-of--way for a future expansion
of Hwy 365. This also increases the distance from the travel lanes.
B. A variance is necessary to permit the applicant the same rights in the use of
this property that are presently enjoyed under the ordinance, by other
properties in the vicinity and zone.
The adjacent property has a sign that was constructed prior to the current
ordinance at less than the required setback.
C. The granting of a variance on the specific property will not adversely affect
the land use patterns outlined by the land use plan and that it will not
adversely affect any other feature of the comprehensive plan of the City of
Port Arthur.
The request will not adversely affect the land use patterns in the area.
D. The variance, if granted, will be no material detriment to the public welfare
or injury to the use, enjoyment or vallue of property in the vicinity.
The requested variance would not be detrimental to the property in the area.
The Staff recommendation is for approval of this variance based on the applicant's
request meeting all four of the findings as required by the Zoning Ordinance.
