No. 14752 -Triangle Waste Solutions - leachate Hauling at City Landfill DATE: May 29, 2008 , RECOMMENDATION: - It is recommended that Proposed Resolution No. 14752 authorizing the City Manger to execute the second year of a three (3) year renewable "contract with Triangle Waste. Solutions of Port Arthur, Texas to provide leachate hauling from the City's Landfill to the Port Acres-Sewer Treatment Plant: The fee will be $54.03 per hour with-each subsequent .year being based on the Consumer Price Index (CPI). Funds are available in Account No. 403-1274-533.59-00 in the Public Works Solid Waste Division FY 2008 Budget. BACKGROUND: leachate is the liquid result of blodegradation of the garbage and trash that is placed within the landfill. This leachate is collected in onsite tanks and needs to be transported to the nearest Wastewater Treatment -Plant (WWTP). Currently; this transportation is done with a vacuum truck by Triangle Waste Solutions. Triangle, Waste's first year's price was $52.00/per hour and is being increased to $54.03/per hour ,which is.a 3.9% increase (see Exhibit A). BUDGETARY/FISCAL EFFECT: - , Funds are available in the Public-Works-Solid Waste Division FY 2008 Budget, Account. 403-1274-533.59-00, which has an unencumbered balance of $241,641.71. ~ " EMPLOYEE/STAFF EFFECT: Acceptance of this recommendation will have no effect on staffing levels at this time. SUMMARY: ' It is recommended that Proposed Resolution. SECOND YEAR CONTRACT BETWEEN THE CITY' OF PORT ARTHUR AND TRIANGLE WASTE SOLUTIONS OF-PORT ARTHUR FOR LEACHATE HAULING AT THE CITY LANDFILL FOR A FEE. OF $54.03 PER HOUR WITH THE. SUBSEQUENT RATE ADJUSTED ACCORDING TO THE CPI AT THAT TIME. FUNDING IS AVAILABLE IN ACCOUNT NO. 403-1274- 533.59-00. WHEREAS, the City must haul the leachate generated at the Landfill to the Port Acres Wastewater Treatment.Plant; and, WHEREAS ,per Resolution No. 67-199, the City Council approved a one year contract agreement. with Triangle Waste wherein the,City had the option to renew the contract for an additional two`(2) yearn upon specific yearly approval of the City Council WHEREAS, the contract specification provided for an adjustment based on the Consumer Price Index; and, WHEREAS, the Consumer Price Index has increased by 3.9% with this new rate being $54.03 per hour (see Exhibit A); and; WHEREAS, Triangle Waste Solutions original bid was based on future price adjustments controlled. by the Consumer Price Index; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF-PORT ARTHUR, TEXAS: P. R. No. 14752 . 05/29/08 psb Page 2 THAT, the City Manager be and he is hereby authorized"to execute the second year of a three (3) year contract with Triangle Waste Solutions of Port Arthur, Texas; and, THAT, the subsequent year's rate shall be adjusted according to the consumer price index (CPI); and, THAT, funding is available in FY 2008 Budget Account No. 403-1274-533.59-00; and, THAT, Triangle Waste shall sign this Resolution agreeing to the terms of the renewal; and, THAT, a copy of this Resolution be sent to the Contractor; and, THAT, a copy of the caption of this Resolution be spread .upon the Minutes of the City Council. The updated expenditure weights for these indexes replace the 2003-2004 weights that were introduced effective with the ]anuary 2006 CPI release. As originally announced by BLS in December 1998, CPI expenditure weights will continue to be updated' at two year intervals subsequent to the 2008 updating. ' Each year with the release of the January CPI; seasonal adjustment factors are recalculated to reflect price movements from the just-completed calendar year. This routine annual recalculation may result in revisions to seasonally adjusted indexes for the previous 5 years. BLS made available recalculated. seasonally adjusted indexes, as well as recalculated seasonal adjustment factors, for the period January 2003 through December 2007, on Friday, February 15, 2008. This change will mean-automatic. increases in payments from Social Security's Old-Age, Survivors, and Disability Insurance (OASDI) and Supplemental Security Income (SSI) programs.
