McMahen, P.E., Director of Public Works P.R. #12000 November 11, 2002 RECOMMENDATZON It is recommended that the City Council adopt Proposed Resolution No. 12000 authorizing funds in the estimated annual amount of $120,000 for Texas Commission on Environmental Quality [formerly Texas Natural Resource Conservation Commission CTNRCC)] annual fees paid in quarterly installments of approximately $30,000 each for the waste disposed of at the City of Port Arthur Landfill Facility, Permit No. 1815, and authorize the Director of Public Works to make said quarterly payments to the Texas Commission on Environmental Quality. BACKGROUND The Texas Commission on Environmental Quality, in accordance with 30 Texas Administrative Cede ('FAC), Section 330-602, requires all Type I Municipal Landfills to pay quarterly fees, based on the amount of tonnage received at the landfill per quarter. In 2001 the total fees paid were $85,619.10, and in 2002 the total was $98,603.11. The additional fees for 2002 were due to increased volume and a more accurate cubic yardage accounting procedure. The volumes for FY 2003 are expected to continue to rise, especially with the additional matedal to be brought in by Eastex Waste Systems. BUDGETARY/FISCAL EFFECT Quarterly fees will be paid from Account No. 403-1274-533.59-01. These fees are figured into the FY 2003 budget, at $100,000, which was approved prior to the contract agreement with Eastex. Additional funds to pay the extra $20,000, if needed, are available from other line item accounts in the Solid Waste Division of Public Works. STAFFING/EMPLOYEE EFFECT Acceptance of this recommendation has no effect on staffing levers at this time. WHEREAS, the Texas Commission on Environmental Quality (formerly TNRCC) in accordance with 30 Texas Administrative Code ('fAC), Section 330.602, requires all Type T Municipal Landfills to pay quarterly fees, based on .the amount of tonnage received at the landfill per quarter; and, now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the City Council of the City of Port Arthur hereby authorizes payment of funds in the estimated amount of One Hundred, Twenty Thousand and no/100 Dollars ($120,000) payable to the Texas Commission on Environmental Quality (formerly T.N.R.C.C.), payable in quarterly installments of $30,000 each, and that the Director of Public Works is hereby authorized to make said quarterly installments of $30,000 each, and that the Director of Public Works is hereby authorized to make said quarterly payments as they are billed; and, THAT funding is available in ~ 2003 Account No. 403-1274-533.59-01 and other Public Works-Solid Waste Division accounts in which balances exist; and, THAT a copy of the caption of this Resolution be spread upon the minutes of the City Council.
