A RESOLIITION AS IT PERTAINS TO TRIITH & EDIICATION AND THE RADIO STATION WHEREAS, per Resolution No. 04-420, the City Council entered into a License to Use Agreement with the Truth & Education Corporation for the use of Room 201 of the City Hall annex; and WHEREAS, this License to Use was modified, per Resolution No. OS-228, Resolution No. 06-033, and No. 07-237; and WHEREAS, per Resolution No. 07-237, the City Council extended the term of the License to Use as to Room 201 to January 1, 2013; and WHEREAS, Truth & Education is considering relocating the radio station and has requested that the City Council bid out the old Maritime Building lot on 4th street, a copy of the request is attached as Exhibit "A"; and WHEREAS, the City Council is concerned about the need for City staff to utilize Room 201 of the City Hall annex and is reviewing other office space availability, including the basement in City Hall; and WHEREAS, Truth & Education has expressed concerns as to the restrictions on the radio station programming that must be z.pr14760 placed on the radio station since it is operating out of City facilities; and WHEREAS, the "parties recognized the options to terminate the agreement, as denoted in Sections 2.01, 2.02, 2.03, 2.04, 2.05, 15, and as otherwise provided in the Agreement; and WHEREAS, the usage of the radio station was to: a) provide charitable assistance to the needy, b) engage in activities necessary to promote self-help programs for needy citizens, c) to implement education programs, and d) to engage in other charitable and educational, tax-exempt activities; and WHEREAS, pursuant to Resolution No. 07-491, the City of Port Arthur has also paid $15,000 as an underwriter wherein the City was to receive the following additional services: "1. Youth training for approximately amount of four (4) hours a day for two (2) to three (3) days per week. Said training consists of the following: a. instructing youth ages 12 to 18 on the use of radio broadcasting equipment, equipment maintenance, etc.; and b. allowing youth to appear on air to make radio announcements, and to conduct interviews; and c. allowing youth to showcase their individual talents on the air; and z.pr14760_updated Paget d. conducting programs and broadcasts with local elementary, middle school, and high schools. 2. Broadcasting of over 125 public interest programs to the community." WHEREAS, the City is concerned that Truth & Education has not been able to broadcast the youth training in the approximate amount of 4 hours per week for 2 to 3 days per week WHEREAS, Truth & Education has indicated that they have not received the youth participation as they had hoped for. NOW THEREFORE, BE IT RESOLVED BY THE CITY COIINCIL OF THE CITY OF PORT ARTHIIR TEBAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. The City Council takes, the following actions as to the relocation of Truth & Education Corporation: Section 3. That the City Secretary shall send a true and correct copy of this Resolution to the .Truth & Education Corporation.
