Pursuant to Texas Government Code, Chapter 497, Subchapter A, Section 497.023 - 497.029 goods and services not On a comract term may be purchased without competitive bidding fi-om the Texas Dep~u hnent of Criminal Justice. The total cost for the manufacture and installation of said lockers is $15,009.96. BACKGROUND: The City Council and City Manager have mandated a proactive approach to the provision of recreational activities and facilities for the citizens of Port Arthur. The Recreation Center, due to prolonged neglect over time, and general wear and tear, is in need of maintenance in a number of areas. This maintenance is being accomplished through prudent use of departmental funds and CDBG funds where applicable. Review of the facility's locker mom reveal that they are in a state of significant disrepair. In fact the majority of said lockers are not functional. As we increase programming at the facih'ty, it is reasonable to anticipate increase use ot the locker room area. Additionally, the recommended purchase will provide current users with a locker area that is not only functional, but aesthetically pleasing. The quote provided by the State of Texas certainly allows for locker replacement at a reasonable price. BUDGET/FISCAL EFFECT: Approval of this request would authorize the expenditure of $15, 009.96 from the 28t~ Year CDBG funds. Account Number C-28101. Available funds have been authorized and approved for this purpose. EMPLOYEE/STAFF EFFECT: None. Commodity items and services offered in the Texas industries for the Blind & Handicapped (TIBH) catalogue are reviewed and approved by the Texas Council on Purchasing from People with Disabilities. The council's purpose is to encourage and assist disabled persons to achieve maximum personal independence by engaging in useful and productive activities. Please note the following: If a product is approved, it is set aside from competitive bidding and is put on a General Services Commission (GSC) term contract; and Purchases of services, approved by the Texas Council on Purchases from People with Disabilities, from the TIBH catalogue do not require competitive bidding. Texas Department of Criminal Justice (TDC~J) / Institutional Division (Texas Government Code, Chapter 497, Subchapter A, Section 497,023 - 497,029): Goods and services not on term contracts may be purchased directly from the TDCJ without competitive bidding under the Prison Made Goods Act. In order to use this procedure, the following steps are to be taken: · A written quotation is obtained from TDCJ/Institutional Division (Texas Correctional Industries-TCI). · If the quotation is within the agency's delegation limit (see Section 2.11 General Procedures), the agency issues a purchase order directly to TDCJ - Institutional Division. Note the following on the purchasing documentation, "the award was made under the Prison Made Goods Act and is noncompetitive." Code as a document type 9 when a warrant must be issued or Interagency Transaction Voucher (lTV) to electronically transfer payment. · If the quotation is beyond the agency's delegation, an open market requisition is sent to the GSC with the quotation attached. Note the following on the requisition: "Please award to TDCJ per attached quotation." The GSC will issue an order directly to TDCJ without going to the open market for bids. Prison Made Goods Act Waiver (TDCJ) The Prison Made Goods Act, requires that an agency purchase go_ods made by and services offered by the Texas Correctional Industries (TCl). If a product/service offered by TCI as set forth in its catalog of products and services needs to be purchased from a source other than TCI, a waiver from TCI must be obtained. The w_aiver request can be based on a substantial difference in specifications which could include delivery, or on substantial price differences, or both. Thigpen, Interim Director of Parks and Reereatio,~j~-y RE: Purchase of Gym Lockers from the state of Texas for the Recreation Center Re£ Council Communication 10/30/01 COMMENT The Parks and Recreation Depat~lent is recommending the purchase of 84 lockers from the state of Texas (Texas Department of Criminal Justice) at a cost of $ 15,009.96 - which includes installation.. The department and Purchasing Division attempted to find pricing for a similar locker product in the private sector. While we were able to locate locker prices from various vendors, we were not able to confirm that the prefabricated lockers would be of the same quality as those obtained from the state of Texas. Further, none oftbe vendors provided assembly or installation. It should be noted that the state of Texas (TDCJ) is the vendor used by the local school district (PAISD) to provide lockers for the various schools in the district. It should also be noted that arrangements have been made with TDCJ to remove the existing lockers at no cost to the City. The crew will salvage sound doors from the lockers in the men's locker room to replace damaged/non-working doors in the ladies' locker room. Based on the foregoing burden &assembly and installation, the un-verifiable quality match, and the history of the vendor (TDCJ) with the local school district, it was determined to be in the best interest of the City to approve the purchase &the manufacture and installation of the 84 lockers at the Recreation Center to the state of Texas (TDCJ). tt is our position that the price is fair and reasonable for the quality of product to be manufactured/installed and for the work involved in the process.
