No. 14761 calling a public hearing with regard to proposed assessments for improvements on 9tb Avenue from 67th Street to 60th Street. Section 402 of the Local Government Code provides that the assessments shall be apportioned between-the benefited property and the owners of the property in accordance with the front foot rule. This allows the municipality to assess each parcel of benefited property according to the number of lineal feet of 'the parcel that abuts on a public street. Exhibits "B" and "C" estimate the possible cost of the assessments for all the parties involved. In the Resolution it will be necessary to determine the cost per lineal foot and the lineal feet necessary to complete the project. A RESOLUTION CALLING A PUBLIC HEARING WITH REGARDS TO PROPOSED ASSESSMENTS FOR IMPROVEMENTS ON 9TH AVENUE FROM 67TH STREET TO 60TH STREET WHEREAS, the City Council deems it~in the public interest to make improvements on 9th Avenue from 67th Street to 60th Street for a sewer line extension; and WHEREAS, the Director of Utility Operations has provided a letter, attached hereto as Exhibit "A", outlining the scope of the project; and WHEREAS, the scope of the project and. the estimates for 'the entire project are as described in Exhibit "B" attached hereto; and WHEREAS, the names of the property owners. and frontage affected by a base bid only are as described in Exhibit "C" attached hereto; and WHEREAS, the City Council deems it in the public interest to assess the adjacent property owners for these improvements, in accordance with the procedures of Chapter 402 Local Government Code, V.T.C.A.; and WHEREAS, notice of the public hearing shall be published at least three (3) times in the official newspaper of the City of Port Arthur; and WHEREAS, written notice of the hearing shall be given to the z.pr14761 adjacent property owners. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That a public hearing on the proposed assessment is set for Council Chambers, 5th Floor, City Hall. Plans and specifications are ready for advertisement. We could amend ,the P&S to have a Base Bid portion terminating at the PAISD's point of service (estimated at $240,000), and provide for an Alternate Bid to include the balance of the project (an open-cut section estimated at $110,000). The base bid portion requires many deep bores under streets, driveways, and/or pipelines, and will serve only the UBM, the PAISD, Frank Pritchard, and the Gulf Health Care Center. The Alternate Bid portion would serve the Our Lady of Guadalupe Church, along with opening up the Ly and Doornbos properties for development. I have attached a small sketch of the proposed project and two spreadsheets showing the cost apportionment to the properties served, one for the Entire Project and one for the Base Bid Portion only. As previously discussed; the City contribution is $100,000, well over the minimum for a conventional assessment. Becky tells me we have enough money in a Fund 419 account to cover our costs.
