COMMENTS
RECOMMENDATION
I recommend that the City Council approve Proposed Ordinance No. 5901 to amend the Code of
Ordinances Section 110-191 Rate Schedule; due date, of Division 3 SERVICE CHARGES, of
Article III Sewers, of Chapter 110 UTILITIES.
BACKGROUND
This section of Chapter 110 of the Code of Ordinances deals with Liquid Waste Hauler Disposal
Fees and establishes a sewer rate for users with a direct dischazge of such waste into the City's
Sanitary Sewer Collection System. Currently Liquid Waste Haulers aze required to transport to
and dischazge at the Port Acres WWTP. These users will now be allowed, or encouraged, to
construct dischazge facilities to directly discharge such waste directly to our collection system.
These users will still be required to obtain discharge permits from the City per our Pretreatment
Ordinance; where restrictions on dischazges are enumerated and enforced. Direct dischazge saves
the City money in manpower and deterioration at our W WTP facility that was never designed for
heavy truck traffic. Also; a dischazge directly into our collection system reduces our exposure
should a classified pollutant be inadvertently received at our WWTP. We would still have first
enforcement authority, but clean-up or remediation would be at the user's expense. These users
will be required to meter their' discharge continuously, providing a better accountability of usage.
The current rate for liquid waste haulers is $0.048/gallon based on 80% of the truck capacity,
yielding an effective rate of $0.0384/gallon for a full truck. We recommend a discounted rate of
$0.033/gallon (about a 0.5¢ discount off the effective rate) for direct discharge.
BUDGET/FISCAL EFFECT
This rate decrease is not expected to decrease revenues, as it will make local liquid waste haulers
more competitive and-may easily increase our likelihood of receiving more waste.
STAFFING/EMPLOYEE EFFECT
None.
SUMMARY
I recommend approval of Proposed Ordinance No. 5901 amending the Code- of Ordinances
Section 110-191 Rate Schedule; due date, of Division 3 SERVICE CHARGES, of Article III
Sewers, of Chapter 110 UTILITIES.

AN ORDINANCE AMENDING SECTION 110-191 OF
DIVISION 3 (SERVICE CHARGES) OF ARTICLE III
(SEWER) OF CHAPTER 110 (UTILITIES) OF THE
CODE OF ORDINANCES, -CITY OF PORT
ARTHUR; SAID AMENDMENTS ESTABLISHING A
SEWER RATE FOR LIQUID WASTE HAULER
DIRECT DISCHARGES AND REPEALING ALL
ORDINANCES AND PARTS OF ORDINANCES IN
CONFLICT HEREWITH; AND DECLARING THE
EFFECTIVE DATE THEREOF.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
Section 1. Pazagraph (a) (3) of Section 110-191 of Division 3 (Service Charges) Article III
(Sewer) of Chapter 110 (Utilities) of the Code of Ordinances, City of Port Arthur, is amended in
it entirety to read as follows:
"(3) Disposal Fees.
For transportation to a City Wastewater Treatment Facility: All
liquid waste hauler disposal fees will be based on 80 percent of the truck's
maximum capacity. There will be no other allowance for partial loads.
Fees for portable toilet or holding tanks waste (domestic sewage):
Beginning 10/01/OS - $0.048/gallon
For direct discharge into the City Wastewater Collection System: All
portable toilet, holding tank, or other transported liquid waste dischazged
directly into the City Sanitary Sewer Collection System shall be based on
metered usage as metered through an approved metering device per each
facility's Industrial User Dischazge Permit as issued by The City of Port
Arthur:
Beginning 07/01/08 - $0.033/gallon"
Section 3. The above provisions aze to be inserted in the Code of Ordinances, City of Port Arthur
Texas in the sequence required by their designation; and,
Section 4. All ordinances and parts of ordinances in conflict herewith are hereby repealed, but
only to the extent of such conflict; and,
Section 5. This being an ordinance not requiring publication, it shall be effective from and after
7uly ],.2008; and,
Section 6. That a copy of the caption of the Ordinance be spread upon the Minutes of the City
Council'.
