BACKGROUND Attached is a list of found and/or abandoned bicycles that are currently being stored at Port Arthur Police Department's property and evidence section. Attempts were made to contact the owner(s) of such property, if known; however, the results were negative. These bicycles are no longer needed in the prosecution of any cases. BUDGETARY/FISCAL EFFECT None SUMMARY I recommend that the City Council adopt Proposed Ordinance No. 5880 authorizing the donation of forty four (44) bicycles to Emily Bond, Warden of the Leblanc Unit far the purposes of helping underprivileged persons in the surrounding area. These events range from an Employee Appreciation Day event to a unit Christmas party to collecting gifts and/or food items for the underprivileged in our surrounding azea, as well as many others. Donations from corporations oY businesses, organizations or associations, and any individual interested in contributing to our fund raisers help offset the costs of such endeavors, and show our staff they are appreciated in the community. This is where my request to you comes in.. I have been informed the Port Arthur PolicC Department may have some bicycles available for donation. AN ORDINANCE AUTHORIZING THE DONATION OF FORTY-FOUR (44) ABANDONED BICYCLES TO EMILY BOND, THE WARDEN OF THE LEBLANC UNIT, FOR PURPOSES OF HELPING THE UNDER- PRIVILIGED IN THE SURROUNDING AREA. WHEREAS, the City of Port Arthur has abandoned or unclaimed property, to wit: Bicycles; and WHEREAS, the Police Department has indicated that an attempt to locate the owners, as required by Article 18.17 of the Code of Criminal Procedure, has been made and it has been unsuccessful; and WHEREAS, the City's Assistant Finance Director has indicated the fair market value of each bicycles is less than Five Hundred ($500.00); WHEREAS, therefore, the property can be donated under Article 18.17 of the Code of Criminal Procedure; and WHEREAS, it has been determined it would be in the best interest of the City to donate the bicycles under the procedures as delineated in Article 18.17 of the Code of Criminal Procedure. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CTI'Y OF PORT ARTHUR: PO No. 5880 Section 1. That Mark Blanton, Chief of Police, is hereby authorized, pursuant to Article 18.17 of the Code of Criminal Procedure; to donate the bicycles, said property being shown in detail as the forty-four (44) bicycles listed in Exhibit "A". Section Z. That all Ordinances in conflict herewith shall be repealed to the extent of the conflict only. Section 3. That a copy of the caption of this Ordinance be spread upon the Minutes of the City Council. READ, ADOPTED AND APPROVED this day of April, 2008, A.D., at a Meeting of the City Council of the City of Port Arthur, Texas, by the following vote: AYES: Mayor Councilmembers: NOES: Mayor PO No. 5880' Section 1. That Mazk Blanton, Chief of Police, is hereby authorized, pursuant to Article 18.17 of the Code of Criminal Procedure; to donate the bicycles, said property being shown in detail as the forty-four (44) bicycles listed in Exhibit "A".
