BACKGROUND:
The Planning and Zoning Commission is being asked to consider a replat request for Lot
8, in the McHanks Addition to produce two re;sidential lots to be called Tract 8A (2.8869
acres) and Tract 8B (2.4877 acres ), of the subdivision in the City of Port Arthur, Texas.
The lot is located east of Proctor Avenue and. south of Seventh Avenue by Gifford Pond
Lane. The zoning is still for residential use. Tfotices were sent out in compliance with the
Texas Local Government Code as well as the publication was done on May 25, 2008,
more than 15 days prior to the public hearing
Applicant- Arceneaux and Gates Engineering & Surveyors Owner- Hong Vo
RECOMMENDATION:
Staff has no objections to this request and all requirements have been met
BUDGETARY/FISCAL EFFECT:
None
STAFFING/EMPLOYEE EFFECT:
None
SUMMARY:
The plat should be approved as it conforms to all the City's plating rules and ordinances

BACKGROUND:
The Planning and Zoning Commission is bevig asked to consider a replat request for Lot
10 Block 15 in Port Acres, to produce two residential lots to be called Tract 10 A
(0.1508) and Tract 10 B (0.1773), Block 15 of the subdivision in the City of Port Arthur,
Texas. The lot is located north of 60th Street and west of Jade Avenue. The zoning is still
for residential use. Notices were sent out in compliance with the Texas Local
Government Code as well as the publication was done on May 25, 2008, more than 15
days prior to the public hearing
Applicant- Soutex Surveyors, Inc. (honer-Kathy Walters
RECOMMENDATION:
Staff has no objections to this request and all requirements have been met.

ORDINANCE NO.
AN ORDINANCE GRANTING AN EXCAVATION PERMIT
ISSUED PURSUANT TO ARTICLE VII (EXCAVATIONS) OF
THE CODE OF ORDINANCES OF THE CITY OF PORT
ARTHUR TO ANGEL INVESTMENTS LOCATED SOUTH OF
61sT STREET AND WEST OF RAY AVENUE .
WHEREAS, pursuant to Article VII (Excavations) of the Code of Ordinances of the City of
Port Arthur, the Planning and Zoning Commission has recommended approval of issuing a permit
to Angel Trace Investments, for excavation of earth material in the City of Port Arthur, upon
certain conditions and assurances for the public health, welfare and safety and to protect the
development of the surrounding area; and also contingent on approval feedback from DD7, and
the Port Arthur Engineering and Public Works Department
WHEREAS, the City Council hereby concurs in the recommendation and findings of the
Planning and Zoning Commission; now, therefore;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
SECTION 1. That an excavation permit is hereby granted to Angel Trace Investments for the
excavation of a detention pond on the following tract of land:
A 71.54 ACRE TRACT OF LAND OUT OF AND PART OF
T & N.O.R.R. SURVEY, ABSTRACT N0.316,
(PROPOSED THE ANGEL TRACE SUBDIVISION), PORT ARTHUR,
JEFFERSON COUNTY, TEXAS
LOCATED ON THE WEST SIDE OF RAY AVENUE AND SOUTH 61sT STREET
EXHIBIT "A"
SECTION 2. That this permit is subject to the terms and conditions of Article VII of the
Code of Ordinances of the City of Port Arthur, and Exhibit "A" attached hereto and which are
incorporated and made part hereof by reference.

SECTION 3. That this permit shall be for a time period of ten (10) years. Excavation operations
thereafter shall constitute a violation of City Ordinances.
SECTION 4. That Angel Trace Investments shall signify acceptance of the Permit by subscription
of a certified copy thereof.

PUBLIC HEARING
E08-01 -Kirk Thomas -Permit for excavation of a borrow it - 90 a re
tract of land ont of and part of T86N0 Rail Road Survey, Abstract No. 242.
Port Arthur. Jefferson County, Texas -Sections 6, 7, 9, Abstract 242, 239,
416 - Eaatside of West Port Arthur Road North of FM 365.
Speaking For: Kirk Thomas, applicant. Mr. Thomas said that he is aware of the
requirements for excavations in support of agricultural activities as stated in
the Port Arthur Excavation Ordinance. He said his purpose for the soil
excavation is to create a stock pond to provide water for his cattle. He said that
after he had decided to seek this permit, he was approached by a business that
wants to purchase the soil from the pit. He stressed that his purpose for the pit
is agricultural in nature, not to make a commercial fill-dirt site.
Speaking Against: None
Fernando Ramirez moved to close the Public Hearing, seconded by Inell Moore.
Vote: All Yes.
REGULAR MEETING

Port Arthur, Jefferson County, Texas -Sections 6, T, 9, Abstract 242, 239,
416 - Eaatside of West Port Arthur Road North of FM 365.
Ms. Russell explained that the proposed excavation complies with the new
Excavation Ordinance requirement for excavations in support of Farm and
Ranch activities. Staff recommends approval with the following requirements:
• The proposed size of the pit should be 20 acres with a maximum depth of
25 feet.
• No excavation shall be made within 30 feet of any existing pipeline or
pipeline easement unless the pipeline has been abandoned or removed in
compliance with U.S. Department of Transportation and/or Texas
Railroad Commission rules and regulations.
• No excavation shall be made within 30 feet of any existing well unless
abandoned in compliance with Texas Railroad Commission rules and
regulations. The Texas Railroad Commission shall be notified prior to any
excavation within 30 feet of any abandoned well.
Ms. Inell Moore made a motion to accept the staff recommendation. Mr.
Fernando Ramirez seconded the motion.
Vote: All Yes
Report on Westside Redevelopment
Mr. Byron Marshall was unable to attend the meeting to deliver this report.
Retort from the Director
Ms. Russell advised the commissioners that she had received a letter from
Commissioner E.B. Chatelain stating that he must resign effective immediately.
She also discussed the unexpected death of Commissioner Phillip Todora, who
passed away April 26, 2008.
