Planning and Zoning Commission Minutes Monday, June 16, 2008 Regular Meeting 5:30 p.m. Commissioners Present: Richard Cox, Alrna LeBlanc and Morris Simon Jr. Commissioners Absent: Fernando Ramirf:z and Inell Moore Staff Present: Colleen Russell, Paul Brown and Dale Watson Chairman Richard Cox welcomed Ms. LeBlanc and Mr. Simon to their first meeting as Planning and Zoning commissioners, their having only been appointed at the most recent City Council meeting. PUBLIC HEARING RO8-06 -Hong T. Vo - Replat of one tract into two tracts - to form Tract 8A (2.8869 acres) and 8B (2.4877 acres) Lot 8, McHanks Addition, Volume 2, Page 98 M.R.J.C. Port Arthur, Jefferson County, Texas Speaking For: Ms. Hung Vo, 1101 6~ Ave:., Port Arthur, explained that she wants to create two tracts of land and tie each to one of the two houses on the existing single tract of land. She said that she currently receives three tax bills each year, one for the tract of land and two more for the two houses on the tract, which is confusing, she said. She would prefer to receive two tax bills, one bill for a house and its related tract of land and the second bill for the second house and land. Mr. Peter Loukas, 3434 Procter St., Port Arthur, said he just wanted to ask a question about the replat. He asked if Ms. Vo intended to build "low-rent homes" on the proposed two tracts. Ms. Vo explained that two homes already exist on the main tract of land, so she does not intend to build any other homes on the proposed two tracts, if approved. Chairman Cox added that Ms. Vo would be required to return to the P8vZ Commission if she decided in the future to build any additional houses on either of the two proposed tracts of propf:rty or for any further subdivision of the tracts. R08-07 - Kathv Walters-Replat- Tract 10-A & 10-B 1.6855 Acres Of Land Part Of Lot 10, Block 15 Port Acres, City Of Port Arthur, Jefferson County, Texas. Speaking For: Kathy Walters, 2903 60th St., Port Arthur. She said that the property originally belonged to her father, who subdivided it to give a portion to her grandparents when they moved to Port Acres. Her grandmother recently passed away and willed that portion of the original tract to Ms. Walters, who intends to move her grandmother's house off the property and build a new house. She wants to separate a portion of her mother's tract and combine it with the property from her grandmother. Staff recommends approval. Alma LeBlanc moved to approve staff recommendation; motion seconded by Mr. Simon. Vote: All For R08-0? -Kathy Walters-Replat- Tract 10-A & 10-B 1.6855 Acres Of Land Part Of Lot 10, Block 15 Port Acres, Citv Of Port Arthur, Jefferson County, Texas. Staff recommends approval. Vote: All For P0805-Lar Properties-Tallow Woods Section III- Plat- Port Arthur, Jefferson County, Texas -65 Lots No Reserves Dale Watson explained that this prelimin<~ry plat is for the other half of the Tallow Wood Subdivision west of the former Hollywood Cinema between 39~ Street and the Texas 73 eastbound service road. The final plat will be presented for approval when all the infrastructure has been completed and accepted by the city for future maintenance. Staff recommends acceptance. Ms. LeBlanc moved to accept the preliminary plat; motion seconded by Mr. Simon. Vote: All For P0806- Roy & Judy Breaux -Highland Ranch Subdivision -Plat -Port Arthur, Jefferson County, Texas - 409 Lots No Reserves. Mr. Watson said that this is a fairly large development located on West Port Arthur Road at the main entrance to the Federal Prison. Only about 1,000 feet of the development is actually inside the city limits, with the rest located in the city's Extra-Territorial Jurisdiction (ETJ). At some point in the future, part of the area in the city limits will need to be :rezoned to allow for the commercial and residential development since the arE°a is currently zoned for Agricultural and Industrial use. For developments inside the city, the P8vZ Commission will consider the zoning and subdivision ordinances, while outside the city, only the Subdivision Ordinance can be considered. Staff recommends acceptance. Mr. Simon moved to accept the preliminary plat; motion seconded by Ms. LeBlanc. Votes: All For. Page 3 of 4 E0802 -Angel Investments--Angel Trace Subdivision -Excavation For Detention Pond- 71.54 Acres Of Land Out Of T. Ss N.O. R.R. Survey Sec. No. 275, Abstract 316 City Of Port Arthur Jefferson County, Texas. George Newsome, engineer for the subdivision, said the excavation is necessary to dig a 9 acre detention/retention pond for the subdivision as required by DD7 for drainage. Staff recommends approval. Mr. Simon moved to recommend that the City Council approve the excavation permit; motion seconded by Ms. LeBlanc. Vote: All Yes. Report from the Director Ms. Russell said the intends to have a joint P8sZ and ZBA meeting to go over the different rolls the two boards fulfill. The zoning is still for residential use. Hence the SUP is a overlay, for this use -because only beauty shop is mentioned our Zoning Ordinance. Many definitions require updating and more specific wording as . relating to our zoning districts. SUPS are based on the variables such as traffic, residential spacing, noise, and other residential amenities.
