A RESOLUTION AUTHORIZING THE CITY MANAGER TO BIND THE CITY OF PORT ARTHUR FOR THE HEALTH DEPARTMENT LIABILITY INSURANCE COVEP. AGE WHEREAS, the existing liability insurance coverage for the Health Department expires on December 31, 2002; and WHEREAS, the City has received the attached correspondence (Exhibit "A") from Bob Lazarus indicating that due to difficulties in the insurance market, we will not have renewal quotations or bids, if at all until, December 27, 2002. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are 'true and correct. Section 2. That the City Council herein schedules a Special Meeting on the __ day of December 2002 at p.m. to consider this matter. Section 3. That if the City Council is unable to meet on December , 2002, the City Council herein authorizes the City Manager to bind the City for Health Department Liability Insurance Coverage subject Attorney. Section 4. to review and approval by the City That the City Council reserves the right to review such insurance at the next available council meeting, and to pay for the earned premiums if there is a need of a cancellation or adjustment thereof. Section 5. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. This comes at no surprise in light of the chaotic conditions which currently exist in the insurance marketplace. As a matter of fact, the insurance market has been in a ~ste of turmoil Mace September 11th. 200t. Nearly all organizatJor~ have experienced material changes tn pricing and coverage in one form or another, Oepending on the c~ase of busine~. V~th specific reference to medical malpracfice coverage, there has been a eignJficanUy reduced capacity to under~wite this coverage because of the class of business, and further, in light of the number oT carriers which have decided to stop writing t~ls type of coverage. The forgoing situation has been further compounded W undee, vritara reluctance to release renewal quotations until at least 24 to 72 hours pdor to the renew'al date for certain c~asee~ of business, such as for example, medical ma[prscl~ce. !n light of these conditions, we recommend that the deadline for submi~ng competitive ~da be extended to December 2§m or December 27~. I cannot stress the Importance of accommodating the whims of underwriters at this particular dine. e~peciaily because it is a eellem market We therefore hove no alternative but to be es flexible as possible in terms of giving underwriters a, the ~Jme they require to aubmt= e bid If you have any questions, please do not hesitate to contacl me.
