Re: P.R.21743—Center for Transportation and the Environment Contract Extension
Nature of Request: Authorizing the City Manager to extend the contract between Port Arthur Transit
(PAT)and the Center for Transportation and the Environment(CTE)to function as the Project
Manager for the deployment of six(6)zero-emission buses.
Background:In February 2018,PAT signed a contract with CTE to assist with the deployment of six
(6)zero-emission electric buses as part of a Low or No Emission Vehicle Program Grant awarded in
2016. The funding for this grant was adopted by the City Council on June 6,2017 per resolution 17-
145.
In,October 2019,PAT and CTE agreed to eliminate and reduce reporting,contract oversight and on-
sight management elements from the contract. CTE submitted a new project scope and contract
containing these adjustments which was adopted by City Council at the October 22,2019,regular
meeting.
The six(6)electric vehicles were delivered to PAT in December 2020 and will be deployed for
service by February 2020. Per Federal Transit Administration(FTA)reporting requirements,PAT is
required to conduct deployment validation for twelve(12)months. CTE will collect various
operational data points to measure and report actual energy savings,cost savings,and greenhouse gas
emissions reductions resulting from deployment of battery electric buses into revenue service. The
data will be used to generate a series of Key Performance Indicators(KPIs)to validate performance of
battery electric buses against other buses in Port Arthur's fleet. Key performance indicators may
include availability,and energy consumption and costs. By tracking and analyzing these KPIs,PAT
and FTA will be fully informed regarding the overall impact of the electric buses. PAT has elected to
utilize a third-party monitoring equipment from ViriCiti to complete data collection and monitoring.
Recommendation:It is recommended that the City Council approve proposed P.R.21743. This
resolution would authorize the City Manager to extend the contract with CTE. The contract would be
extended by 350 days for a new expiration date of April 1,2022.
Budgetary/Fiscal Effect: Funding to pay for the CTE contract is available in account number 401-
1509-561.93-00 project number 11116A.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE SECOND AMENDMENT TO
THE CONTRACT WITH THE CENTER FOR TRANSPORTATION
AND THE ENVIRONMENT (CTE) OF ATLANTA, GEORGIA FOR
THE ZERO EMISSION ELECTRIC BUS PROJECT, EXTENDING
THE CONTRACT COMPLETION BY DATE TWELVE (12)
ADDITIONAL MONTHS TO A NEW COMPLETION DATE OF APRIL
1, 2022 AT NO ADDITIONAL COST.
WHEREAS, pursuant to Resolution No. 18-045, City Council approved a contract
with the Center for Transportation and the Environment(CTE) of Atlanta, Georgia to act as
the Project Manager for the Zero Emission Electric Bus Project for Port Arthur Transit
(PAT), in an amount not to exceed of$426,500.00; and,
WHEREAS,pursuant to Resolution No. 19-468, City Council authorized a contract
amendment which decreased the contract amount by $206,500.00 to a new contract total of
$220,000.00; and,
WHEREAS, in accordance with the Federal Transit Authority (FTA's) Low or No-
Emission Bus Program Grant, CTE's scope of work included a 12-month Key Performance
Indicator (KPI) data collection and reporting for the implementation for the Zero Emission
Bus Project; and
WHEREAS, due to the delays associated with the procurement. design and
construction of the new transit facility that supports maintenance and charging of the new
zero emission buses,CTE is respectfully requesting an additional 12-months extension from
the original contract completion date as delineated in Exhibit "A", in order to successfully
complete the data collection and reporting with no additional cost.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR, TEXAS:

THAT,the facts and opinions in the preamble are true and correct.
THAT, the City Manager is hereby authorized and directed to execute the second
amendment to the contract with the Center for Transportation and the Environment (CTE) of
Atlanta, Georgia, extending the contract completion time by twelve (12) months from the
original date to a new completion date of April 1, 2022, as delineated in Exhibit "A", at no
additional cost.
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.

SUBJECT: Contract#18-045, PO 212942, 12-Month Contract Extension Request
Dear Mr. Mitchell,
CTE respectfully requests a 12-month extension to Contract#18-045 for Battery Electric Bus Deployment
Services, currently set to expire April 1, 2021.The new contract expiration is proposed to be April 1,
2022.
In accordance with the Federal Transit Administration Low or No Emission Vehicle Grant, CTE's scope of
work includes one year of key performance indicator (KPI) reporting that will not begin until the buses
have entered revenue service. As you are aware,there were delays associated with the procurement,
design, and construction of the new facility building that supports charging that held up the delivery and
deployment of the vehicles.The vehicles are currently expected to be in revenue service by February
2021. An extension of 12 months will allow CTE to complete the required KPI data collection and
reporting and complete the final report.
