BACKGROUND:
An application was first filed with the Planning and Zoning Commission on October 9, 2018, requesting
a Zoning Amendment for the property referenced above. The Commission held a public hearing on
November 19, 2018, where citizens were invited to express their support or opposition to said
request. Based on the discussion, the Planning and Zoning Commission voted unanimously to
recommend the zoning amendment's approval.

Planning Staff prepared a resolution requesting a second public hearing with the Po rt Arthur City
Council; however, the hearing was canceled due to unforeseen circumstances.
The property owner submitted a request to resubmit the application for consideration on December
23, 2020.
ANALYSIS:
Section 19 of the Zoning Ordinance provides di strict regulations for development in said district.
The purpose of the “PD” planned development district is to provide greater flexibility and innovation
opportunities in projects. Generally, greater detail is necessary about the proposed uses and the site
plan for a PD development than required for the same use(s) in another district.
ACCESS:
The project entrance(s) is located on 13th Street.
PUBLIC NOTICE:
On Saturday, January 16, 2021, nineteen (19) notices were mailed to adjacent property owners within
a 200 ft. Radius and published in the Port Arthur Newspaper, fifteen (15) days before the P&Z public
hearing scheduled for February 1, 2021.
FISCAL IMPACT/BUDGET IMPLICATIONS:

RECOMMENDED ACTION:
Staff recommends that the Planning and Zoning Commission accept the request to amend Planned
Development District – 15 (PD) to allow for uses associated with the Light Commercial (LC) zoning

PLANNED DEVELOPMENT DISTRICT – 15
SECTION 1. AREA
That the zoning designation of the following described tract of land be and the same is
hereby zoned “PD-15”, Planned Development – 15 District under the provisions of Section 19:
Being all of Block 28, and Lots 1-9, Block 35, City Addition and all of Lots 10 and 11, Block 35,
Beachway Addition.
SECTION 2. PERMITTED USES
Use regulations for the “PD-15”, Planned Development – 15 District permits uses as
prescribed in Section 7 for:
1. All of Block 28 shall allow for uses permitted in the “HC”, Heavy Commercial District.
2. All of Lots 10 and 11, Block 35, Beachway Addition shall allow for uses permitted in the “LC”
Light Commercial District.
SECTION 3. DEVELOPMENT STANDARDS
The density, coverage, off-street parking, off-street loading, height, fence and wall, and yards
shall equal or exceed the standards established for the “LC”, Light Commercial District for all uses.
Noise standards shall be those established for the Commercial District for all uses.

allow stormwater to drain towards Mechanic Street. Also noting that “no stormwater shall drain onto
adjacent properties before and after structures are built.”

October 2020.
As a result of the investigation and analysis and by the opinion of a licensed and qualified real estate
appraiser, a fair and reasonable consideration for the proposed acquisition of said right -of-way is
$99,500.
RECOMMENDED ACTION:
Staff recommends that the Planning and Zoning Commission accept the request to abandon portions
of the street right-of-way referenced above.
