Sec. 14-32. Duties.
The duties of the beautifcatian commission
shall be advisory in nature to the city. manager
and the city. council. Its duties, among others,
shall be to promote public interest in improving
the environment; plan and coordinate programs
for litter control in cooperation' .with businesses,
industries, governmental agencies end private
citizens; make studies and recommendations for
~mproving health, sanitation, safety and c!e~Ji-
through beautification of streets, yards, lots
and other open spaces; aid in the removal and
limitation of trash and debris and encourage
beantification, including the planting and preset-
vation of trees, lowers, plants, shrubs, and other

The beautification commission shall act as an
executive commktee and as such, among other
powers, shall have the power to establish stand-

There is created a citizen's pipeline advisory
committee of the city, and such committee shall
consist of nine members, ail of whom shall be
resident citizens and qualified voters of this City.
(1) Such members of the citizen's pipeline

major pipelines permits as defined in sec-
tion 66-53 at an agTeed upon specified
ti.me and place or at such other times as
set by the committee. Special meetings
shall be called by the committee chairman
or by three committee members.

Sec. 14-73. Functions and duties.
The function and duties of the cit/zen's pipeline
advisory committee shall be as follows:
(1) Advise and consult with the city engineer
during the permitting process for major
pipelines only, as defined in section 66-53
of this Code, providing input as to the
potential economic impact, impact on the
general safety, concerns generated by the
placement of pipelines near urban devel-
opment, impact on existing and future
urban development, and make appropri-
ate recommendations-
(2) The ad hoc commlt-tee created from among
members of the committee will a~tvi.se and
consult with the city eng4neer and direc-
tor of planning on furore major revisions
to the pipeline ordinance as may be needed
from time to time, and make appropriate
recommendations.
(3) Adopt rules and procedures as necessary
to carry out the business of the commit-
tee.
(4) Promote citizen awareness of pipeline lo-
cations, construc~on, maintenance and
safety to foster better u~derstanding of an
industry vital to the economy of the city
and the surrounding area.

gtect of duty, malfeasance or the unexcused ab-
sence from four consecutive meetings, or the

Sec. 14-513. Functions-
The industrial development corporation may,
under the conditions set forth in this a~/c!s, issue
obligations on behalf of the unit, acquire, lease,
sell or convey certain properties and make loans
for the promotion and development of coggner-
cial, Industrial and manufacturing enterprises to
promote and encourage employment and the pub-
lic we~are. The unit shall not lend its c.rsdi, t or
grant any public money or thing of value m md of · issued
the corporation. Furthermore, obligations
by the corporation, with the approval of the unit,
s~all be deemed not to constitute a debt of the
state, of the unit or of any other political corpora-
tion, subdivision or agency of the state or a pledge
of the faith and credit of any of them, but such
obligations shall be payable s'olely from the funds

be authorized to incur financial obligatxons which
cannot be paid from proceeds of the obligations or
from revenues realized from the lease or sale of a

Sec. 14-514. Articles of incorporation and
bylaws.

nance any agweement to issue bondJ, including
refunding bonds, adopted by the industrial deve!-

bonds. Furthermore, no issue of bonds, including
refunding bonds, shall be sold and delivered by
the corporation without a wri~en ordinance of the
city council adopted no more than 60 days pr,or to

Sec. 14.559. Trust fund.
The trust fund create_ed by Ordinance No. 80-51

SECTION 25. BOARD OF ADJUST~IENT
25-100. Organization.
There is hereby created a board of adjustment
consisting of four members amd a chairman. Each
shall be appointed by the mayor with approval of
the city council for a term of two years. The
members are removable for cause by counc~ upon
written charges and after public hearing. Vacan-
cies shall be filled for the unexpired term of any
member, whose place becomes vacant for anY
cause, in the san%e mz/xner as the original appoint-
ment. Each member reappointed, or each new
appointee, shall serve for a full tefax of two years
unless removed. Four alternate members may
also be appointed or removed in the sarae manner
and for the sarae term. Alternate members may
serve in the absence of one or more regUlar
members when requested to do so.
25-200. Procedure.
The board ef adjustment sha. ll adopt rules to
govern its proceedings. The rules'must be consis-
tent with this ordinance or statutes of the State of
Texas. Meetings of the board of adjustment shall
be held at the call of the chairman and at such
other times as the board of adjustment may
determine. The chairman, or in his absence, the
ac~ing chairman, may administer oaths and com-
pel the attandance of witnesses. All meetings of
the board shall be open to the public. The board of
adjustment shall keep minutes of its proceedings,
showing the vote of each member upon each
question, or if absent or failing to vote, indicate
such fact, and shall keep records of its examina-
tions and other ol~icial actions, all of which shall
be immediately f~led in the office of the board and
shall be a public.record.

lot or tract occupied by such build-
ing. Permit reconstruction of a struc-
ture less than 60 percent destroyed.
Permit the addition to off-street park-
ing or off-street loading to a noncon-
forming use.
b. Require the discontinuance by a spe-
cific time of nonconforming uses of
land or structures under an amorti-
zation plan. The amortization plan
shall consider the general character
of the neighborhood, the necessity of
all property to conform tO the regu-
lations of this ordinance, and the full
value of the structure and facilities.
Any discontinuance shall consider
both the property rights of the per-
sons affected and the public welfare.
(3) Permit variances in specific cases where
special conditions will make literal en-
forcement of the provisions of the ordi-
nance an unnecessary hardship. AnY such
variance must not be contrary to the pub-
lic interest. In granting a variance, the
board of adjustment shall make three, of
the four following findings:
a. Special circumstances e~st relating
to size, shape, area, topography, sur-
rounding conditions and location that
do not apply generally to other prop-
erty in the same area and the same
zoning district.
b. Avariance is necessary to permit the
applicant the same rights in the use
of this property that are presently
enjoyed under the ordinance, by other
properties in the vicinity and zone.
c. The granting'of the variance on the
specific property will not adversely
affect the land use pattern as out-
lined by the land use plan~md that it
will not adversely affect any other
feature of the comprehensive plan of
the City of Pore Arthur.
The variance, if ~anted, will be no
material detriment to the public wel-
fare or injury to the use, enjoyment
or value of property in the vicinity.

Actions of the board
The board of adjustment may change or
affirm the action appealed. In making its
decision~ the board may also impose rea-
sonable conditions on the applicant. The
board shall conform to V.T.C.A., Local
Government Code §§ 211.008 and 211.009.
(2) The concurring vote of four members of
the board of adjustment shall be neces-
sary to rev/se any order, requirement,
decision or determination.
(3) Any person or persons, jointly or sever-
ally, aggrieved by any decision of the
board of adjustment or any taxpayer or
any officer, department or board of the
municipality, may present to the court of
record a petition, duly verified, setting
forth that such decision is illegal, in whole
or in part, specifying the grounds of ille-
gality. Such petition shall be presented to
the court within ten days afker the filing
of the decision by the board of adjustment
and its recommendation in the minutes
and not thereafter.
