NO. 21807 —A resolution calling for a public hearing to consider a proposed abandonment for approximately 0.2754-acre of land consisting of portions of city street right-of-way. Introduction: The intent of this Agenda Item is to request a public hearing to consider a proposed abandonment for approximately 0.2754-acre of land consisting of portion of the following right-of-way: • 60' x 200' portion of South 10th Avenue The purpose of this request is to abandon a portion of unimproved public right-of-way for residential use/development (i.e., single-family home) The City's Public Works Departments has requested that the property be graded to allow stormwater to drain towards Mechanic Street. Also noting that "no stormwater shall drain onto adjacent properties before and after structures are built." Background: The applicant, Henry J. Semour submitted a request to the City for the abandonment of the above-referenced portion of right-of-way for the purpose of resolving a cloud currently on the title due to residential structure being built on right-of-way. A cloud on title is any document, claim, unreleased lien, or encumbrance that might invalidate or impair a title to real property or make the title doubtful. Clouds on the title are usually discovered during a title search. On February 1, 2021, the Port Arthur Planning and Zoning Commission held a public hearing to discuss the proposed abandonment. In a vote of 3:0, the Commission recommended that the request is approved to allow the applicant to proceed with the sale of real property. In accordance with Article VI, Section 94.383(b)(2) of the Port Arthur Code of Ordinances, five (5) notices were mailed to each property owner within 200 feet and published in the official newspaper of the city, which was published in the Port Arthur News on January 16, 2021. There were no property owners to speak in opposition of the proposed request. Budget Impact: None Recommendation: It is recommended that City Council approve P.R. No. 21807, calling for a public hearing to consider a proposed abandonment for approximately 0.2754-acre of land consisting of portion of the following right-of-way: • 60' x 200' portion of South 10th Avenue A public hearing shall be held on Tuesday, March 16, 2021, at 6:00 p.m. "Remember,we are here to serve the Citizens of Port Arthur" P.O. SEMOUR) WHEREAS, the applicant — Henry J. Semour, is requesting that the City of Port Arthur consider this abandonment for the area delineated in Exhibit "A"; and, WHEREAS, Article VI, Section 94-383 authorizes the calling of a public hearing to consider the abandoning, vacating and relinquishing streets, alleys and easements; and, WHEREAS, the City Council has the authority to vacate, abandon or close a street under Section 311.001 and 311.007 Transportation Code; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: SECTION 1. That the facts and opinions in the preamble are true and correct. SECTION 2. That the Planning and Zoning Commission heard this case on February 1, 2021. SECTION 3. That upon abandoning and vacating the alleys, the City shall have the right, if it so desires, to retain utility easements. SECTION 4. That a public hearing to consider whether to grant the applicant the abandonments as delineated in Exhibit "A" shall be held on March 16, 2021, at 6:00 p.m. by telephonic and videoconference. SECTION 5. That notice of the public hearing shall be published at least fifteen (15) days before the date of the hearing in the official newspaper of the City pursuant to 211.006 of the Texas Local Government Code.
