NO. 21808 — A resolution calling for a public hearing to consider a proposed abandonment for 1 .425-acre of land consisting of portions of city street rights-of-way. Introduction: The intent of this Agenda Item is to request a public hearing to consider a proposed abandonment for 1.425-acre of land consisting of portions of the following rights-of-way: • 100' x 380' portion of Houston Avenue • 80' x 300' portion of 4th Street The Port of Port Arthur has agreed to simultaneously dedicate utility easements for existing and proposed utilities as well as dedicated ingress/egress easements providing legal access to current adjoining property owners. Background: The Port of Port Arthur submitted a request to the City for the abandonment of the above-referenced portions of rights-of-way for the purpose of managing public traffic entering into designated areas owned/controlled by the Port. On February 1 , 2021 , the Port Arthur Planning and Zoning Commission held a public hearing to discuss the proposed abandonment; however, did not take action on this request due to one of three commissioners in attendance recusing themselves because of a potential conflict of interest or lack of impartiality. The Commission will reconvene on this matter on February 15, 2021. In accordance with Article VI, Section 94.383(b)(2) of the Port Arthur Code of Ordinances, thirteen (13) notices were mailed to each property owner within 200 feet and published in the official newspaper of the city, which was published in the Port Arthur News on January 16, 2021 . There were no property owners to speak in opposition of the proposed request on February 1, 2021. Budget Impact: None Recommendation: It is recommended that City Council approve P.R. A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER A PROPOSED ABANDONMENT FOR 1.425-ACRE OF LAND CONSISTING OF A PORTIONS OF THE HOUSTON AVENUE AND FOURTH STREET RIGHTS-OF-WAY ADJACENT TO BLOCK 136, CITY OF PORT ARTHUR, JEFFERSON COUNTY, TEXAS A21-02 (PORT OF PORT ARTHUR) WHEREAS, the applicant — Port of Port Arthur, is requesting that the City of Port Arthur consider this abandonment for the area delineated in Exhibit "A"; and, WHEREAS, Article VI, Section 94-383 authorizes the calling of a public hearing to consider the abandoning, vacating and relinquishing streets, alleys and easements; and, WHEREAS, the City Council has the authority to vacate, abandon or close a street under Section 311.001 and 311.007 Transportation Code; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: SECTION 1. That the facts and opinions in the preamble are true and correct. SECTION 2. That the Planning and Zoning Commission heard this case on February 1, 2021. SECTION 3. That upon abandoning and vacating the alleys, the City shall have the right, if it so desires, to retain utility easements. SECTION 4. That a public hearing to consider whether to grant the applicant the abandonments as delineated in Exhibit "A" shall be held on March 16, 2021, at 6:00 p.m. telephonic and videoconference. SECTION 5. That notice of the public hearing shall be published at least fifteen (15) days before the date of the hearing in the official newspaper of the City pursuant to 211.006 of the Texas Local Government Code.
