RE: P.R. NO. 21810 — A resolution calling for a public hearing to consider
amending the Zoning Ordinance of the City of Port Arthur by amending
Planned Development District — 15 (PD-15).
Introduction:
The intent of this Agenda Item is to request a public hearing to consider amending the
Zoning Ordinance of the City of Port Arthur by amending Planned Development District—
15 (PD-15) to include approximately 0.3375-acre of land consisting of all of Lots 10 & 11 ,
Block 35, Beachway Addition, Port Arthur, Jefferson County, Texas.
The purpose of this request is to amend the district regulations for the Planned
Development District — 15 (PD-15) to allow for all uses associated in a Light Commercial
zoned district on the property legally described above. The applicant is intending to open
a barber/beauty salon and bar-b-que stand at said location.
Background:
The Planning & Zoning Commission held a public hearing on Monday, February 1, 2021 .
There were no objections from members of the public regarding this zoning amendment
request.
Budget Impact:
None
Recommendation:
It is recommended that City Council approve P.R. No. 21810, calling for a public hearing
to consider amending the Zoning Ordinance of the City of Port Arthur by amending
Planned Development District — 15 (PD-15) to include approximately 0.3375-acre of land
consisting of all of Lots 10 & 11, Block 35, Beachway Addition, Port Arthur, Jefferson
County, Texas for the purpose of operating a barber/beauty salon and bar-b-que stand at
said location.
The public hearing shall be held on March 16, 2021 at 6:00 p.m.

A RESOLUTION CALLING FOR A PUBLIC HEARING TO
CONSIDER AMENDING THE ZONING ORDINANCE OF THE CITY
OF PORT ARTHUR BY AMENDING PLANNED DEVELOPMENT
DISTRICT — 15 [PD-15] TO INCLUDE APPROXIMATELY 0.3375-
ACRE OF LAND CONSISTING OF ALL OF LOTS 10 & 11, BLOCK
35, BEACHWAY ADDITION, CITY OF PORT ARTHUR,
JEFFERSON COUNTY, TEXAS
WHEREAS, the owner/applicant(s) — Jarmon Batiste — is requesting that the City
of Port Arthur consider amending the Zoning Ordinance of the City of Port Arthur by
amending Planned Development District — 15 (PD-15) to include the area delineated in
Exhibit "A" to allow for all use types permitted in a Light Commercial "LC" zoned district;
and,
WHEREAS, pursuant to Chapter 211 in the Texas Local Government Code, a
public hearing must precede any zoning change.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
THAT the facts and opinions in the preamble are true and correct.
THAT the Planning and Zoning Commission reviewed this case on February 1,
2021.
THAT a public hearing to consider whether to grant this applicant the zoning
amendment for approximately 0.3375-acre of land consisting of all of Lots 10 and 11,
Block 35, Beachway Addition in Port Arthur, Jefferson County, Texas, as delineated in
Exhibit "A" shall be held on March 16, 2021 at 6:00 p.m. by telephonic and
videoconference.

THAT notice of the public hearing shall be published at least fifteen days prior in
the official newspaper of the City before going to the City Council.
THAT a copy of the caption of this Resolution be spread upon the Minutes of the
City Council.

SECTION 1. AREA
That the zoning designation of the following described tract of
land be and the same is hereby zoned "PD-15", Planned Development-15
$ District under the provisions of Section 19:
All of Block 28 and Lots 1-9, Block 35, City Addition
SECTION 2 . PERMITTED USES
Use regulations for the "PD-15", Planned Development-15 District
permits uses as prescribed in Section 7 for:
1. All uses in the "HC", Heavy Commercial District.
SECTION 3 . DEVELOPMENT STANDARDS
The density, coverage, off-street parking, off-street loading,
height, fence and wall, and yards shall equal or exceed the standards
established for the "LC", Light Commercial District for all uses.
Noise standards shall be those established for the Commercial
District for all uses.
