Introduction:
The intent of this Agenda is for the City Council to authorize the City Manager to enter into a
contract with SCS Engineers of Houston, Texas for Engineering Services for the City of Port
Arthur Landfill for an amount not to exceed $314,000.00.
Background:
The City of Port Arthur Landfill will require significant improvements to accommodate a
future client. The City of Port Arthur requested qualified engineers to send their qualifications
to the City. The City evaluated the six (6) qualified engineers and SCS Engineers was deemed
the most qualified to assist the city to improve the landfill.
Budget Impact:
Funds are available in Landfill Professional Services, Account number 403-1274-533.54-00
Recommendation:
Approval of P. R. No. 21724 authorizing the City Manager to enter into a contract with SCS
Engineers for Engineering Services for the City of Port Arthur Landfill.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER
INTO A CONTRACT FOR $314 , 000 . 00 WITH SCS ENGINEERS
OF HOUSTON, TEXAS FOR ENGINEERING SERVICES FOR THE
CITY OF PORT ARTHUR LANDFILL. FUNDS ARE AVAILABLE

WHEREAS, pursuant to Resolution 20-379, the City Council
authorized the City Manager to negotiate a contract with SCS
Engineers to perform the engineering services for the
Landfill; and,
WHEREAS, the City Council of the City of Port Arthur
finds it to be in the interest of the citizens of Port Arthur
to enter into a contract with SCS Engineers for $314, 000 . 00,
in substantially the same form as Exhibit "A"; and,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
Section 1 . That the facts and opinions in the preamble
are true and correct.
Section 2 . That the City Manager is authorized to enter
into a contract with SCS Engineers on behalf of the City of
Port Arthur for the Engineering Services for the Landfill in
the amount of $314, 000. 00, in substantially the same form as
Exhibit "A".
Section 3 . That a copy of the Resolution shall be spread
upon the Minutes of the City Council.

AGREEMENT FOR PROFESSIONAL SERVICES
That this Agreement is made between the City of Port Arthur, Texas hereinafter
referred to as "City" and SCS Engineers of Houston Texas hereinafter referred to as the
"Contractor."
I. DURATION AND TERMINATION
That this Agreement shall begin as soon as the contract is signed and has been
executed. And shall remain in effect until the contract to transport dirt to the landfill is
complete. Either party may terminate this Agreement upon thirty (30) days written
notice without cause, or for cause by giving the other notice in writing five (5) days
prior to termination. It is understood and agreed that if Contractor is incapable of
performing the services described herein, all rights to further compensation under this
Agreement are to be invalid.
II. PROFESSIONAL SERVICES TO BE PERFORMED
See Attached Scope of Services (Attachment A)
III. COMPENSATION
Contractor shall be compensated on the following design schedule completion:
- Task 1 — Complete - $46,000
- Task 2 — Complete - $75,000
- Task 3 — Complete - $65,000
- Task 4 — Complete - $20,000
- Task 5 — Complete — $8,000
- Task 6 — Complete — $40,000
- Task 7 — Complete - $60,000
For a total not to exceed $314,000 for the landfill engineering services. Tasks
are time sensitive and is to be completed and coordinated with the correct entities and
is Contractor's responsibility to perform the tasks in a timely manner. The Contractor
shall safeguard all records and maintain confidentiality of records and information
encountered in the course and scope of this project.
IV. INDEMNITY
It is understood and agreed that Contractor is independent contractor. The CITY
hereby agrees to indemnify CONTRACTOR, to the extent permitted by law or the extent
to which such coverage is available to CITY employees and officials, against any
liability, claim, cause of action, damage, personal injury or death rising out of or in
connection with the services performed or to be performed by CONTRACTOR pursuant
to this Agreement when CONTRACTOR is acting within the scope of his employment.
V. PROFESSIONAL LIABILITY INSURANCE
The City will provide legal services or pay any judgment rendered against Contractor
for any suit or claim arising out of the performance of the Contractor's duties as
outlined herein unless it is determined that said performance was the result of
malfeasance or negligence.
VI. NONDISCRIMINATION
The Contractor hereby agrees that no person shall, on the grounds of race, creed,
color, handicap, national origin, sex, political affiliation, or beliefs, be excluded from, be
denied the benefits of, or be otherwise subjected to discrimination as regards to any
services or activity under this contract; and hereby gives assurance the Contractor will
immediately take any measure necessary to effectuate Agreement.

Professional Engineering Services for the City of Port Arthur Landfill
RFQ-P20-65
Dear Mr. Elefano:
As you know,the City of Port Arthur has been challenged with a soil cover deficit at the City's landfill,
which has resulted in a significant annual expense for importing off-site cover for use in daily cover
and other landfill operations. The City now has the opportunity to minimize that expense by
embarking on this critical project for importing large quantities of soil to the City's Landfill.This
project, importing soil to the City's Landfill, has the potential to bring significant annual savings for
many years for the City. In order to realize these benefits, the City issued RFQ-P2O-65 to engage a
highly qualified engineering firm to provide the professional engineering services associated with this
project. Proper execution of this project will require a firm with significant experience in Municipal
Solid Waste (MSW) landfill planning, permitting and construction projects in Texas. SCS meets your
qualifications for the broad range of expertise required, including having direct, extensive experience
with the City's Landfill, and understands the needs of the City of Port Arthur.
The import soil will be required to be stockpiled at designated landfill areas for subsequent use as
daily cover as well as in other landfill construction projects. These projects include the construction
of stormwater detention ponds, intermediate cover,final cover,final cover drainage features and
other site construction.
To accommodate 500 dump trucks a day, on top of the regular landfill traffic, may require the
permitting, design and construction of additional highway access lanes and turning lanes. This
would require the preparation of design plans,technical specifications, bid documents, engineer's
estimates, and driveway permits. The public highway traffic control plans, construction plans and
specifications for the driveways and highway improvements would require the approval and
permitting with TxDOT.
To prevent the tracking of mud and debris onto State Highway 73,the facility may consider
constructing a combination of paved roads and truck wheel-wash facilities. Paved roads may include
gravel, asphalt or concrete paving, as appropriate,for the location and conditions. Additional paved
road sections,especially gravel and asphalt, may be required as stockpiling and earthwork
construction activities progress.
Our Houston office will manage this and utilize engineers and technical staffs from our offices
around the state, including Dallas/Fort Worth and Austin. Also, if needed, we have further expertise
available with our specialized experts from around the United States.

This is a highly visible project for The City of Port Arthur and we stand ready to help you successfully
achieve your goal. With this submittal, we make our solid commitment to provide the services
specified. To this end,SCS proposes the following scope of services.
SCOPE OF SERVICES
Task 1 - Initial Project Set-Up and Management
Successful execution of this project will entail close coordination with the project generating the
exported soil. To address this need from the outset of the project, SCS would plan a meeting with
City Staff and Bechtel's project manager(either Zoom or similar or face-to-face or combination
thereof)to discuss the project, determine reporting lines of communications between City, City
contractors and the import soil generator and define the roles of the various project entities.
Additionally, this task includes the management of the project, budgets, preparation of project status
memoranda and invoices,and participation at regular scheduled monthly meetings with City staff for
the duration of the project. Activities may include day-to-day and weekly communications as well as
monthly progress reports for all project tasks throughout the duration of the project.
Consistent with the information provided by Bechtel to the City, for the purposes of this proposal,the
project is anticipated to have an 18-month duration through the bidding and start of the import soil
stockpile operations.
Task 2 -Limited Scope Permit Amendment
SCS will prepare a Limited Scope Permit Amendment(LSPA)for submittal to the TCEQ to revise the
facility's operations and development to accommodate the receipt of the import soil. This LSPA
would include updates to the permit to address the increase of waste intake, revision of operating
hours, additional facility construction,and operational changes associated with the import soil.
The following changes in the permit are required:
• Revisions to the Traffic Section
• Revisions to entrance facilities to address increased truck traffic
• Addition of wheel-wash facility to minimize mud on access road
• Revisions to the surface water management plan
• Revisions to the Site Operating Plan
• Revision of the Landfill Operating Hours to enable disposal services 24 hours a day, 7
days a week
• Add operations of truck wheel wash facility
• Add dewatering facilities(TBD)
Based on our review of the TCEQ rules and discussions with a TCEQ MSW Team Leader, it has been
determined these proposed changes will required the submittal and approval of a LSPA, consistent
with 30 TAC §305.62(i)(2) and 30 TAC §330.135.(a), as well as other TCEQ requirements.
SCS will update the Transportation Section (Section 8 of Parts I/II, General Information)to reflect the
increase in truck traffic at the site associated with this project. We will communicate with the Texas

Department of Transportation (TxDOT), consistent with 30 TAC 33O.61(i)(4). In view of the significant
number of trucks hauling soil to the site,TxDOT may require a traffic study to aid in defining the
access road improvements, including a deceleration lane and an acceleration lane. (See further
discuss under our Additional Services section.)
In order to accommodate the anticipated large number of trucks hauling imported soil,the capacity
of the entrance facilities as well as on-site roads needs to be expanded. SCS will revise the entrance
facility design and related permit documents to address increased truck traffic. Depending on the
outcome of a traffic study(if required) and communications with TxDOT,this may entail adding a
deceleration lane and an acceleration lane on State Route 73(SR 73). In addition,the design of the
on-site roads will be improved to provide for increased truck traffic associated with the imported soil.
Also, based on our current understanding of the number of trucks hauling imported soil, we
anticipate that additional provisions will be needed to properly account for the soil, i.e., adding
another scale with an RFID system to efficiently account for the incoming material.
The permit documents will also be revised to provide for a truck wheel-wash facility to minimize mud
on SR 73.
The significant quantity of soil to be imported and stored on site will necessitate revisions to the site
development as detailed in the current permit. In particular, large soil stockpiles to be developed on
the eastern portion of the site(also known as Closed Landfill 0009)will require the development of a
drainage plan and associated erosion control measures that will minimize discharge of sediment into
the adjacent water bodies and wetlands.
SCS will revise the Site Operating Plan to address changes in operation for the management of
imported soil: Personnel, Equipment, Mud and Dust Control,Access Control, Hours of Operation,
Site Signs,Soil Management, and General Site Safety.
The facility's currently permitted hours of operation are as follows:
"The operating hours for receipt of waste and for all landfill related operations at the MSW facility
shall be any time between the hours of 6:00 a.m.and 7:00 p.m. Monday through Saturday. There
shall be no waste acceptance or waste placement performed outside the permitted operating hours
and days."
SCS will revise the operating hours for receipt of waste and for all landfill related operations to be 24
hours a day, 7 days per week.
It is important to note that(1)TCEQ's rules governing LSPAs state that"...only the portions of the
permit and attachments to which changes are being proposed are required to be submitted"and
(2) depending on the discretion of the TCEQ reviewer,the extent of revisions required may be more
extensive than our experience would suggest. In determining the scope of the LSPA, we have
reviewed the landfill permit application and the appropriate rules. Based on our review, in addition to
the documents described in the above subtasks, we will provide the following list of changes to be
included in the LSPA to be submitted to the TCEQ:
• Updating the Adjacent Landowners Map consistent with §33O.59(A)to include all property
owners within 1/4 mile of the facility.

• Updating the Landowners List consistent with §330.59(B)to include all property owners
within 1/4 mile of the facility.
• Completing the Part I Application form (TCEQ 0650).
• Supplying three complete copies of the Permit Application to be made available in a public
place in the Port Arthur area.
• Placing the information on a publically accessible URL on the SCS Engineers web site
• Updating the TxDOT county map
• Supplementary technical report.
• Statement of Applicant's appointments(i.e.,SCS Engineers).
• Submit the Limited Scope Amendment to the TCEQ, including the TCEQ permit fee.
• Numerous drawing to reflect the proposed revisions in the on-site access roads and well as
deceleration and acceleration lanes on Highway 73.
This Task includes the budget for all items preceding the submittal of the LSPA; all subsequent effort
by SCS on the LSPA will be addressed under Task 7.
Task 3 -TxDOT Permitting and Design Bid Package
SCS will develop a plan to accommodate the peak additional vehicle traffic (dump trucks)with the
regular traffic and operations of the landfill. The additional dump trucks will be delivering clay to the
landfill. Some of the clay may be saturated,which will need to be considered in the development of
the on-site stockpiles.SCS will develop a traffic plan in accordance with the TxDOT driveway
standards. Based on our review of TxDOT's on-line manuals,the following auxiliary lanes may be
required:a deceleration lane on the east side of the driveway entrance and an acceleration lane on
the west side of the landfill exit. SCS will meet with local district TxDOT office personnel to discuss
the proposed plan and get their concurrence on the concept to be implemented.
Once the concept is agreed on,SCS will develop a driveway permit in accordance with the TxDOT
requirements. Additionally,SCS will develop construction plans and specifications for the required
driveway and lane improvements. For the purposes of this proposal, it is anticipated that the
improvements will include the previously referenced deceleration and acceleration lanes.
These road construction plans will include:
• Cover Sheet
• Sediment and Erosion Control Plan Sheet
• Traffic Plan Sheet
• Plan and Profile Sheets(2)
• Drainage Plan Sheet
• Pavement Detail Sheets
• Drainage Detail Sheets
• Traffic Detail Sheets
• Sediment and Erosion Control Detail Sheet
Additionally, SCS will prepare plans and specifications for on-site road and drainage improvements
that will not require TxDOT's review and approval. This will include new entrance paving,a paved
area for a new temporary scale to be utilized by the import soil haulers,a road from the scale to the

soil stockpile area,culverts and ditches around the soil stockpile area,and a sediment/detention
basin for the soil stockpile area.
This task includes the following:
• Development of performance-based plans and specifications for the installation of a
temporary scale and RFID system for the incoming soil trucks.
• Development of performance-based specifications for the installation of a truck wheel-wash
facility.
These items will be incorporated into a bid package with the TxDOT plans or as separate bid
packages at the City's preference. In either event,we will provide the technical support materials for
the City to issue the bid package(s).
It is assumed that the City will provide a small portable building for housing the scale read-out
equipment.
Since the acceleration and deceleration lanes will be for the exclusive use of vehicles using the City's
landfill,we have assumed that TxDOT will agree that this project will be bid by the City. As such, SCS
will prepare a bid document in accordance with the City of Port Arthur's standard bid documents with
the construction plans and bid documents. SCS will prepare an engineer's estimate of the proposed
work.
SCS will conduct a pre-bid meeting, issue notes from the pre-bid meeting,answer contractor's
questions on the bid documents, review and evaluate the bids,and issue a recommendation on the
received bids.
Task 4 Soil Stockpile Operations Bid Package
Rather than requiring the City to purchase additional equipment and hire additional staff for the 18-
month period of importing the soil,we anticipate that the City would prefer to outsource the
operation of this massive soil stockpile.To this end,SCS will prepare a bid package for the 18-month
operation of the soil stockpile. The City will select a contractor to operate the on-site soil stockpile,
including:
• Directing incoming soil trucks where to deposit the load;
• Grading the soil stockpile(s) in accordance with a fill sequence plan;
• Maintaining all associated haul roads, including control of dust and mud;
• Maintaining the culverts, ditches and sediment/detention pond;and
• Maintaining the truck wheel-wash facility.
It is assumed that the City will provide staff to operate the scale house for the dedicated temporary
scale and monitor the incoming soil trucks.
SCS will prepare a detailed fill plan for the contractor's use in stockpiling the soil. SCS anticipates
producing five fill sequence drawings, including an initial topographic map of the area to receive the
fill,three intermediate phases and a final phase based on the projected volume(1.55 million cubic
yards as provided by the City).

SCS will prepare a bid document in accordance with the City of Port Arthur's standard bid documents
with the construction plans and bid documents. SCS will prepare an engineer's cost estimate of the
proposed work.
SCS will conduct a pre-bid meeting, issue notes from the pre-bid meeting, answer contractor's
questions on the bid documents, review and evaluate the bids, and issue a recommendation on the
received bids.
Task 5 Revise Stormwater Pollution Prevention Plan (SWP3)
SCS developed the original SWP3 and prepared prior updates in 2011 and 2016, as required by
TCEQ and EPA rules. SCS will revise the SWP3 to reflect the proposed soil stockpiles and related
changes in the landfill design. In addition, if EPA has issued the changes for the 2021 updates to the
federal Multi-Sector General Stormwater Permit,we will incorporate those changes as well. Also,
following completion of the updated SWP3 for the facility,SCS will also prepare a new Notice of
Intent(N01). Following receipt of the City's concurrence on the SWP3 and the N01, we will submit the
N01 to the TCEQ along with the TCEQ fee, which we assume will be $100.
Task 6: Follow-up to Limited Scope Permit Amendment
The above scope is based on our years of experience with TCEQ permitting and our current
understanding of the LSPA permit procedure. In view of the unprecedented nature of this project,
and the variability of the questions raised by the different TCEQ reviewers, it is difficult to ascertain
the level of effort TCEQ's response to the submittals. The tasks following the submittal of the limited
scope permit amendment include the following:
• Address comments from the TCEQ's Administrative Review Team.
• Communicate with TCEQ's Chief Clerk's Office regarding the notice to be published in the
local newspaper.
• Communicate with the local newspaper regarding publishing the notice in the newspaper.
• Address comments from the TCEQ's Technical Review Team.
• Contact TCEQ Chief Clerk's Office for list of interested parties (local, county,statewide)that
need to be included in our distribution.
• Draft standard letter for the City's signature to be mailed to those on the list(property
owners, listed agencies, interested parties per TCEQ Chief Clerk's Office). We will send these
letters to the City with copies of the notice to be attached, address labels, and instructions
for mailing the letters.
• Draft letter and Certificate of Notice to be sent to Chief Clerk's Office for City's signature after
the prescribed period (as indicated in the TCEQ's"Notice of Technically Complete" Letter).
Task 7: Allowance for Additional Tasks that May be Required
We have prepared the above scope-of-services, including the permit modification, based on our
current understanding of the information available on this project, which is still in the developmental
phase, and our years of providing a broad variety of services at the City's landfill and various other
landfills in Texas.
The following list of additional services that, if needed, could be authorized by the City under Task 7.

• Responding to the City's request for assistance with the tracking and management of the
import soil stockpile operations, including:
Participating in the initial pre-operations meeting with the City staff,the City's
consultant,the contractor and the import soil provider.
Assisting the City in determining how to manage the incoming material; e.g.,
distinguishing soil types for separate stockpiles (topsoil vs. clay, etc.); distinguishing
waste material such as vegetative overburden overlying the soil.
Participating, if requested,to attend monthly meetings via Zoom or other software
with City staff,the contractor,the import soil provider to discuss:
Review of the logs of incoming trucks from the scale house and the logs from
the import soil provider and resolve any discrepancies;
Review the current stockpile operations;
Discuss upcoming operations and schedules;
Tracking incoming import soil totals
Tracking contractor progress and invoices; and
Project Close-Out.
In view of the duration of this project, we recommend a budget of$10,000 for SCS'technical
support for this phase of the project.
• Construction-phase Engineering Services. Construction quality assurance testing(e.g.,for
road and drainage improvements, etc.)and related engineering services during construction.
While it is understood that the City may elect to provide this service, at the City's discretion,
SCS will be available to provide this service upon request.The best time to provide a scope
for the City's consideration will be following completion of the design phase. We recommend
budgeting$20,000 for this service.
• Traffic Study. As indicated above,our scope includes communications with TxDOT pursuant
to obtaining state approval of revisions to State Route 73 (SR 73)for a deceleration lane at
the landfill entrance and an acceleration lane at the landfill exit. Based on our review of
available traffic data for State Route 73 near the landfill and our experience with other TCEQ
permitting projects,the need for a traffic study is not certain. Furthermore, if required,the
scope and fee will vary depending on the comments of TxDOT and TCEQ. If TxDOT or TCEQ
require a traffic study, at the City's discretion, we could procure this service from a qualified
traffic engineering firm utilizing funds in the Task 7 budget OR,this service could be a direct
purchase by the City. Based on our experience,traffic studies can range in scope and fee
from $15,000 to $35,000.
As with any multi-year project of this magnitude, there are certain aspects of the project that may be
encountered in the course of this project that are not possible to anticipate at this time. As such, we
are recommending a budget of$60,000 for this task to address the additional tasks and for
addressing unanticipated aspects of this project. This task budget can also be used for other
engineering services that the City deems necessary during the course of this project. Since no
consultant can guarantee a budget for a project like this that is still being defined at this time, we

appreciate your understanding that this budget is subject to change as additional information
becomes available. In view of the variable scope for these activities, incurring costs for such
services will require the City's prior authorization. Also,following receipt of the City's authorization,
SCS will perform these activities on a time and materials basis using SCS' current fee schedule. In
addition,these additional services will be described in detail on our monthly invoices for the City's
review and approval. No cost to the City will be incurred in Task 7 without the City's authorization.
Assumptions
Landfill Scalehouse. Regarding the scalehouse at the landfill, as discussed,we are assuming that
the City's Purchasing Department is proceeding with the purchase of a mobile home structure to be
retrofitted for use as the scalehouse adjacent to the scale, which is under construction at this time.
Since the size and use of the scalehouse is to be determined, we have not yet attempted to develop
a scope of engineering services for providing water and wastewater service to the gate house.
Nevertheless, we would be pleased to work with the City in developing a scope of engineering
services to address this future need. At the City's preference, these services could be performed
either by the City's current water/wastewater services engineering consultant under contract to the
City or by a subcontractor to SCS.
TCEQ Permit Fees. We have assumed that the City will pay directly for the TCEQ permit fee for the
Limited Scope Permit Amendment.As such,this cost is not included in our fee estimate. Based on
our recent communications with TCEQ, we are advised that the permit fee for a LSPA is now $2,050
due to the changes required by the Texas Legislature, 86th Regular Session.

indicates that the material shipped from the LNG site is not a waste but rather uncontaminated soil
that will not require de-watering at the City's landfill. If the soil were determined to be contaminated,
this would require alternate management procedures, which would entail additional review and
coordination with the TCEQ. If the material quantity changes significantly,this may entail a re-
assessment of the proposed soil management practices.
Soil Borings for Road Design. As noted in Task 3, it is anticipated that a deceleration lane and an
acceleration lane may be required for this project in order to obtain TxDOT and TCEQ approvals.
Based on our further review of TxDOT requirements, we are assuming that TxDOT will not require soil
borings for any lane improvements.
LSPA Permit Procedure. In view of the distance to any residences or businesses, we have assumed
that there will be no opposition to the LSPA and no comments on the draft LSPA that will require
more than 4 hours of professional time. We have also assumed that there will be no requests for
public meetings or public hearings. If any assistance is requested with a public meeting or public
hearing, SCS will prepare a separate proposal for the City's consideration to address those services.
Estimated Fees
As with many complex, multi-year projects, it is anticipated that this project may change as Bechtel
mobilizes and begins implementation of this LNG project. In order to maintain flexibility to adjust to
possible changing conditions, we will manage and invoice this project on a time and materials basis
using our current fee schedule (see attached). Project fees are detailed in Table 1.
