{Project: West Port Arthur Road Elevated Storage Tank}
Introduction:
The intent of this Agenda Item is to seek City Council's approval of Change Order #1 for the
City of Port Arthur West Port Arthur Road Elevated Storage Tank with A&M Construction
and Utilities, Inc. as the contractor (project designed and managed by Schaumberg & Polk,
Inc.) On August 4, 2020, the Council passed Resolution No. 20-246, which awarded A&M
Construction and Utilities, Inc. with the construction phase of the West Port Arthur Road
Elevated Storage Tank contract, in the original contract amount of$635,800.00. Change Order
#1 has a net decrease of$18,000 on the total cost, by deducting $40,000.00 for lead abatement
and adding $22,000.00 for new six (6') foot tall chain link fence with three strands of barb
wire and twenty (20') foot double swing drive gate, resulting in a net decrease of$18,000.00
for a new contract amount of$617,800.00.
Background:
On August 4, 2020, the Council passed Resolution No. 20-246, which awarded A&M
Construction and Utilities, Inc. with the construction phase of the West Port Arthur Road
Elevated Storage Tank contract, in the original contract amount of$635,800.00.
Budget Impact:
Change Order #1, if passed by Council, will decrease the original contract amount by
$18,000.00 to a new contract amount of$617,800.00, without extending the completion date.
Funds are available in Account No. 405-1621-532.85-00, Water System; Project No. R19267.
Recommendation:
It is recommended that City Council adopt Proposed Resolution No. 21747, thereby decreasing
the contract amount by $18,000.00, to a new contract total of$617,800.00.

A RESOLUTION AUTHORIZING THE CITY MANAGER
TO EXECUTE CHANGE ORDER #1 TO THE CONTRACT
BETWEEN THE CITY OF PORT ARTHUR AND A&M
CONSTRUCTION AND UTILITIES, INC. OF ROWLETT,
TEXAS FOR THE WEST PORT ARTHUR ROAD
ELEVATED STORAGE TANK PROJECT, DECREASING
THE CONTRACT AMOUNT BY $18,000.00, BRINGING
CONTRACT TOTAL TO $617,800.00; ACCOUNT NO. 405-
1621-532.85-00,WATER SYSTEM; PROJECT NO. R19267.
WHEREAS, pursuant to Resolution No. 20-246, City Council awarded a contract to
A&M Construction and Utilities, Inc. of Rowlett, Texas for the construction phase of the West
Port Arthur Road Elevated Water Storage Tank for the amount of$635,800.00, which includes a
base bid lead abatement item with an amount of$40,000.00; and,
WHEREAS, Change Order #1 reassigns a portion of the unused funds for lead
abatement to a new 6-foot-tall chain link fence with barbed wire and 20-foot double swing gate;
and,
WHEREAS, the contract amount would be a net decrease of $18,000.00, bringing the
new contract amount to $617,800.00; and,
WHEREAS, Schaumberg & Polk, Inc., Project Engineer, has submitted Change Order
#1 (attached hereto as Exhibit "A") to the construction of the West Port Arthur Road Elevated
Storage Tank, decreasing the contract amount by $18,000.00; and,
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:

THAT, the facts and opinions in the preamble are true and correct; and,
THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to
approve Change Order #1 to the contract with A&M Construction and Utilities, Inc. of Rowlett,
Texas of Rowlett, Texas, decreasing the contract by $18,000.00, to a new contract total of
$617,800.00.
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.
