A RESOLUTION AS IT PERTAINS TO EXEMPT EMPLOYEES DURING THE FEBRUARY 2021 WINTER STORM WHEREAS, on February 12, 2021, Governor Abbott issued a Disaster Declaration and continued to deploy resources for the severe winter weather that impacted all of Texas; and WHEREAS, on February 14, 2021, President Biden declared that a major disaster exists in the State of Texas and ordered federal assistance to supplement state and local recovery efforts in the areas affected by severe winter storms beginning on February 11, 2021, and continuing; and WHEREAS, certain exempt employees have expended many hours in excess of what is normally expected due to the severe winter weather and the necessary emergency response from through ; and WHEREAS, there is an urgent need to make a reasonable accommodation. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That Ordinance No. 18-35 provides that pursuant to Section 78-53 of the Code of Ordinances of the City of Port Arthur "exempt employees who have accrued compensatory time for hours worked over 40 hours per week during inclement weather, s.pr21823 will automatically earn time and a half(overtime) for hours up to 100 hours and any hours over 100 hours will be accrued as compensatory time after 48 hours per week." Section 3. That due to the severe weather, the City Council authorizes exempt employees to utilize or be paid for comp time effective from to as set forth in Section 78-53 of the Code of Ordinances of the City of Port Arthur. Section 4. That a copy of the caption of this Resolution shall be spread upon the Minutes of the City Council.
