P.O. 5307- An Ordinance Amending Chapter t8 (Buildings) Article III of
the Electrical Codes Division 6 (Standards), Section 18-221, Section 18-
227 and Section 18-228 adopting the National Electrical Code 2002
Edition
RECOMMENDATION: Staff recommends the adoption of the 2002 Edition of the National
Electrical Code as the new standard for the installation and repair of electrical apparatuses in
commercial and residential structures.
BACKGROUND: Adoption of this Code will apply to new installations. Buildings that secure
permits after the adoption of this code will have to comply with it's requirements. Existing
structures that do not comply with the requirements of this Code will be permitted to be
continued provided it poses no imminent danger to the occupants. Additional safeguards
have been added to the installation of electrical apparatuses in residential structures which
will be of some additional cost for our citizens. I have attached an Exhibit B which illustrates
those items and their estimated cost for installation. These items provide additional protection
from the possibility of fires and accidental electrocution.
BUDGET AND REVENUE IMPACT: Adoption of the 2002 National Electrical Code will
not require any additional funds.
STAFF LEVEL IMPACT: Adoption of this Code will have no impact on the current staff.

DIVISION 6 (STANDARDS) SECTION t8-221, SECTION 18-227 AND SECTION t8-228 OF
THE CODE OF ORDINANCES OF THE CITY OF PORT ARTHUR, AS TO ADOPT THE
NATIONAL ELECTRICAL CODE, 2002 EDITION PUBUSHED BY THE INTERNATIONAL
ELECTRICAL CODE SERIES; PROVIDING CERTAIN AMENDMENTS THERETO;
REI~EAUNG ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH;
PROVIDING A PENALTY FOR VIOLATION BY FINE NOT EXCEEDING TWO THOUSAND
DOLLARS, AS PROVIDED IN SECTION t8-43 OF THE CODE OR AS OTHERWISE IMPOSED
BY STATE LAW; AND PROVIDING FOR PUBLICATION AND AN EFFECTIVE DATE
IMMEDIATELY AFTER PUBUCATION.
WHEREAS, the City Council deems it in the best interest of the citizens of the City of
Port Arthur to adopt the National Electrical Cede, 2002 Edition, as published by the
National Fire Protection Agency and may make variations thereof that do not
substantially vary from the rules or laws of this State: and
Whereas, the City Council of Port Arthur deems it in the best Interest of the citizens of
the City to adopt the 2002 National Electrical Cede with the exceptions thereto;
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
PORT ARTHUI~
Section 1. The facts and opinions in the preamble are true and correct.
Section 2. That Sections 18-22t, 18-227 and t8-228 Code of Ordinances of the City Of
Port Arthur is amended to read as sat forth in Exhibit "Aw.
Section 3. That all ordinances or parts of ordinances in conflict herewith are herein
repealed, bnt only to the extent of said conflict.
Section 4. That any person who violates any provisions of this Ordinance or who shall
neglect to comply with the terms hereof shall be guilty of a misdemeanor and shall on
conviction thereof be fined in any sum not less than One ($t.00) Dollar nor mo~e than
($2,000) Dollars as provided in the Cede of Ordinances, and each violation shall
constitute a separnte offense.
Section 5. That this Ordinance or its caption and penalty shall be published one (1)
time within ten (10) days after final passage hereof in the official newspaper of the
City of Port Arthur. This Ordinance shall take effect Immediately after the date of
publication.

"Section 18-221. National Electrical Code 2002 Edition
The National Electrical Code, 2002 Edition, hereinafter referred to as the "Electrical
Cede", as published by the National Fire Protection Association, Quincy
Massachusetts, Ninth Edition of the International Electrical Code Series, is herein
adopted as the Electrical Code of the City of Port Arthur, save and except such
portions as are herein deleted, modified, or amended, of which code not less than one
(t) copy has been and now is filed in the office of the City Secretary of the City of Port
Arthur and the same Is hereby adopted and Incorporated as fully as if set out In at
length herein, and from the date on which this Section shall take effect, the provisions
thereof shall be controlling within the limits of the City of Port Arthuc
Section t8-227 Amendments to the National Electrical Code, 2002 Edition
Solid aluminum conductors of 8,10 and 12 (AWG) American Wire Gauge shall be of an
AA-8000 series.
(A) The City of Port Arthur adopts article 80.5. Of the 2002 National Electrical Code.
(B) Article 80.15 of the 2002 National Electric Code - Electrical Board is deleted.
(C) Article 80.t9 of the 2002 National Electric Code - Permits and Approvals are hereby
deleted.
(D) Article 80.27 of the 2002 National Electric Code - Inspectors Qualifications is
hereby deleted."
Section 18-228- Grounding Rods
An accessible external means to connect intersystem bonding and grounding
conductors shall be provided et the disconnecting means for any beilding or structure
by at least one of the following means:
1.ExPosed nonflexlble metallic raceways.
2.ExPosed grounding electrode conductor.
3.Approved means for the external connection of a copper or other corrosion-resistant
bonding or grounding conductor to the grounded raceway er equipment.~

Summary of the Change: A new section has been added to require 125-
volt, single-phase, 15- and 20-ampere outlets installed in bedrooms of
mobile homes and manufactured homes to be AFCI protected.
Code Language: 550.25 Arc-Fault Circuit-Interrupter Protection.
(A) Definition. Arc-fault circuit interrupters are defined in 210.12(A).
(B) Bedrooms of Mobile Homes and Manufactured Homes. All branch
circuits that supply 125-volt, single-phase, 15- and 20-ampere outlets
installed in bedrooms of mobile homes and manufactured homes shali
be protected by arc-fault circuit interrupter(s).
Analysis of the Change:
The addition of this new section provides the same type of protective rules
involving arc-fault circuit interrupters for wiring in mobile hom~ and manu-
factured home bedrooms as does 210.12 for dwellings covered by that article.
This rule is not included in NFPA 501 or the HuD Part 3280 rules at the
present time.

Analysis of the Change:
The addition of "kitchens" to this section v, dll now require that all 125-volt,
single-phase, 15- and 20-ampere receptacles installed in kitchens located in
offices, schools, restaurants, and so forth, have ground-fault protection for
personnel. This rule differs from the requirement for kitchens located in
dwellings. Provisions in 210.8(A)(6) require GFCI protection for all 125-volt,
single-phase, 15- and 20-ampere receptacles instalIed to serve countertop
surfaces. The revised wording in 210.8lB) does not limit this requirement to
countertop receptacles.

field marking on electrical equipment to warn qualified persons of po-
tential electric arc-flash hazards.
Code Language: 110.16 Flash Protection. Switchboards, panelboards,
industrial control panels, and motor control centers in other than dwell-
ing occupancies and are likely to require examination, adjustment,
servicing, or maintenance while energized shall be field marked to warn
qualified persons of potential electric arc-flash hazards. The marking
shall be located so as to be' clearly visible to qualified persons before
examination, adjustment, servicing, or maintenance of the equipment.

Summary of the Change: The provisions in 210.7 of the previous Code
have been relocated in ne~v Article 406 under 406.3 General Installa-
tion Requirements. New wording has been added in 210.7(A) to refer-
ence Part III of Article 210 relative to the location of outlets in branch
circuits and Article 406 for specific requirements for receptacles.

(A) Receptacle Outlet Location. Receptacle outlets shall be located in
branch circuits in accordance with Part III of Article 210.
(B) Receptacle Requirements. Specific requirements for receptacles
are covered in Article 400.
(C) Multiple Branch Circuits. Where more than one branch c~rcuit sup-
plies more than one receptacle on the same yoke, a means to simultaneously
disconnect the ungrounded conductors supplying those receptacles shall
be provided at the panelboard where the branch circuits originated.
Analysis of the Change:
The relocated material is more'appropriate for Article 406 because that new
article covers general requirements on how receptacles are installed. This
change to relocate text to Article 406 and to add the new wording to 210.7

the last sentence have been deleted, and the wording "listed to pro-
vide protection of the entire branch circuit" has been added..
Code Language: 210.12(B) Dwelling Unit Bedrooms. All branch circuits
that supply 125-volt, single-phase, 15- and 20-ampere outlets installed in
dwelling unit bedrooms, shall be protected by an axe-fault circuit inter-
rupter listed to provide protection of the entire branch circuit.
Analysis of the Change:
This change will extend the arc-fault circuit-interrupter protection to all out-
lets in dwelling unit bedrooms. The requirement previously applied only to
the receptacle outlets. The addition of the wording "listed to provide protec~
tion of the entire branch circuit" emphasizes the coverage of the rule. The
sentence specifying the date for the rule on AFCIs to become effective has
been deleted. The January 1, 2002, effective date allowed the rule to be in-
cluded in the 1999 NEC without it having to be enforced in order to provide
time for more review of the performance of AFCI devices. The resulting data
proved to be sufficient to justify a mandatory requirement in the 2002 Code
for AFCI protection of branch circuits. This rule ~vill add an important level
of safety in dwellings.

section has been restructured. The wording "Access and" has been removed

tence has been added to the newly designated "(2) Large Equipment" to read,
'SYhere the entrance has a personnel door(s), the door(s) shall open iffthe
direction of egress and be equipped with panic bars, pressure plates, or other

(1) Minimum Required. At least one entrance of sufficient area shall b,e

vices, or control devices, there shall be one entrance to the required
working space not less than 610 mm (24 in.) wide and 2.0 m (6 1/2 ft) high
at each end of the working space. Where the entrance has a personnel
door(s), the door(s) shall open in the direction of egress and be equipped
withpanic bars, pressure plates, or other devices that are normally latched
but open under simple pressure.
A single entrance to the required working space shall be permitted where
either of the conditions in 110.26(C)(2)(a) or (b) is met.
