P.O. 5307- An Ordinance Amending Chapter t8 (Buildings) Article III of the Electrical Codes Division 6 (Standards), Section 18-221, Section 18- 227 and Section 18-228 adopting the National Electrical Code 2002 Edition RECOMMENDATION: Staff recommends the adoption of the 2002 Edition of the National Electrical Code as the new standard for the installation and repair of electrical apparatuses in commercial and residential structures. BACKGROUND: Adoption of this Code will apply to new installations. Buildings that secure permits after the adoption of this code will have to comply with it's requirements. Existing structures that do not comply with the requirements of this Code will be permitted to be continued provided it poses no imminent danger to the occupants. Additional safeguards have been added to the installation of electrical apparatuses in residential structures which will be of some additional cost for our citizens. I have attached an Exhibit B which illustrates those items and their estimated cost for installation. These items provide additional protection from the possibility of fires and accidental electrocution. BUDGET AND REVENUE IMPACT: Adoption of the 2002 National Electrical Code will not require any additional funds. STAFF LEVEL IMPACT: Adoption of this Code will have no impact on the current staff. · Page I ORDINANCE NO. P.O.5307 LB/LB AN ORDINANCE AMENDING CHAPTER 18 (BUILDINGS) ARTICLE III ELECTRICAL CODES DIVISION 6 (STANDARDS) SECTION t8-221, SECTION 18-227 AND SECTION t8-228 OF THE CODE OF ORDINANCES OF THE CITY OF PORT ARTHUR, AS TO ADOPT THE NATIONAL ELECTRICAL CODE, 2002 EDITION PUBUSHED BY THE INTERNATIONAL ELECTRICAL CODE SERIES; PROVIDING CERTAIN AMENDMENTS THERETO; REI~EAUNG ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT THEREWITH; PROVIDING A PENALTY FOR VIOLATION BY FINE NOT EXCEEDING TWO THOUSAND DOLLARS, AS PROVIDED IN SECTION t8-43 OF THE CODE OR AS OTHERWISE IMPOSED BY STATE LAW; AND PROVIDING FOR PUBLICATION AND AN EFFECTIVE DATE IMMEDIATELY AFTER PUBUCATION. WHEREAS, the City Council deems it in the best interest of the citizens of the City of Port Arthur to adopt the National Electrical Cede, 2002 Edition, as published by the National Fire Protection Agency and may make variations thereof that do not substantially vary from the rules or laws of this State: and Whereas, the City Council of Port Arthur deems it in the best Interest of the citizens of the City to adopt the 2002 National Electrical Cede with the exceptions thereto; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUI~ Section 1. The facts and opinions in the preamble are true and correct. Section 2. That Sections 18-22t, 18-227 and t8-228 Code of Ordinances of the City Of Port Arthur is amended to read as sat forth in Exhibit "Aw. Section 3. That all ordinances or parts of ordinances in conflict herewith are herein repealed, bnt only to the extent of said conflict. Section 4. That any person who violates any provisions of this Ordinance or who shall neglect to comply with the terms hereof shall be guilty of a misdemeanor and shall on conviction thereof be fined in any sum not less than One ($t.00) Dollar nor mo~e than ($2,000) Dollars as provided in the Cede of Ordinances, and each violation shall constitute a separnte offense. Section 5. That this Ordinance or its caption and penalty shall be published one (1) time within ten (10) days after final passage hereof in the official newspaper of the City of Port Arthur. This Ordinance shall take effect Immediately after the date of publication. Code Language: 550.25 Arc-Fault Circuit-Interrupter Protection. (A) Definition. Arc-fault circuit interrupters are defined in 210.12(A). (B) Bedrooms of Mobile Homes and Manufactured Homes. All branch circuits that supply 125-volt, single-phase, 15- and 20-ampere outlets installed in bedrooms of mobile homes and manufactured homes shali be protected by arc-fault circuit interrupter(s). Analysis of the Change: The addition of this new section provides the same type of protective rules involving arc-fault circuit interrupters for wiring in mobile hom~ and manu- factured home bedrooms as does 210.12 for dwellings covered by that article. This rule is not included in NFPA 501 or the HuD Part 3280 rules at the present time. This rule differs from the requirement for kitchens located in dwellings. Provisions in 210.8(A)(6) require GFCI protection for all 125-volt, single-phase, 15- and 20-ampere receptacles instalIed to serve countertop surfaces. The revised wording in 210.8lB) does not limit this requirement to countertop receptacles. Code Language: 110.16 Flash Protection. Switchboards, panelboards, industrial control panels, and motor control centers in other than dwell- ing occupancies and are likely to require examination, adjustment, servicing, or maintenance while energized shall be field marked to warn qualified persons of potential electric arc-flash hazards. The marking shall be located so as to be' clearly visible to qualified persons before examination, adjustment, servicing, or maintenance of the equipment. New wording has been added in 210.7(A) to refer- ence Part III of Article 210 relative to the location of outlets in branch circuits and Article 406 for specific requirements for receptacles. · Code Language: 210.7 Branch-Circuit Receptacle Requirements. (A) Receptacle Outlet Location. Receptacle outlets shall be located in branch circuits in accordance with Part III of Article 210. (B) Receptacle Requirements. Specific requirements for receptacles are covered in Article 400. (C) Multiple Branch Circuits. Where more than one branch c~rcuit sup- plies more than one receptacle on the same yoke, a means to simultaneously disconnect the ungrounded conductors supplying those receptacles shall be provided at the panelboard where the branch circuits originated. Analysis of the Change: The relocated material is more'appropriate for Article 406 because that new article covers general requirements on how receptacles are installed. Code Language: 210.12(B) Dwelling Unit Bedrooms. All branch circuits that supply 125-volt, single-phase, 15- and 20-ampere outlets installed in dwelling unit bedrooms, shall be protected by an axe-fault circuit inter- rupter listed to provide protection of the entire branch circuit. Analysis of the Change: This change will extend the arc-fault circuit-interrupter protection to all out- lets in dwelling unit bedrooms. The requirement previously applied only to the receptacle outlets. The addition of the wording "listed to provide protec~ tion of the entire branch circuit" emphasizes the coverage of the rule. The sentence specifying the date for the rule on AFCIs to become effective has been deleted. The January 1, 2002, effective date allowed the rule to be in- cluded in the 1999 NEC without it having to be enforced in order to provide time for more review of the performance of AFCI devices. The resulting data proved to be sufficient to justify a mandatory requirement in the 2002 Code for AFCI protection of branch circuits. This rule ~vill add an important level of safety in dwellings. Vegetation such as trees shall not be used for support of overhead conductor spans. Analysis of the Change: 'l~e exception that read, "Exception: For temporary wiring in accordance w/th Article 305" has been deleted. This exception was to a rule prohibiting the use of vegetation to support overhead spans. Neither Article 305 of the 1999 Code nor Article 527 in the 2002 NEC permits such use. The wording "Access and" has been removed from the title and it wi]J now read "Entrance to Working Space." A new sen- tence has been added to the newly designated "(2) Large Equipment" to read, 'SYhere the entrance has a personnel door(s), the door(s) shall open iffthe direction of egress and be equipped with panic bars, pressure plates, or other devices that are normalJy latched but open under simple pressure." · Code Language: 110.26(C) Entrance to Working Space. (1) Minimum Required. At least one entrance of sufficient area shall b,e provided to give access to working space about electrical equipment. (2) Large Equipment. For equipment rated 1200 amperes or more and over 1.8 m (6 ft) wide that contains overcurrent devices, switching de- vices, or control devices, there shall be one entrance to the required working space not less than 610 mm (24 in.) wide and 2.0 m (6 1/2 ft) high at each end of the working space. Where the entrance has a personnel door(s), the door(s) shall open in the direction of egress and be equipped withpanic bars, pressure plates, or other devices that are normally latched but open under simple pressure.
