Lawrence Baker, Director of Community Services Date: 12/23102 Re= P.O. 5308- An Ordinance amending Chapter 18 of the Code of Ordinances adding Article XIII adop~ng the International Residential Code RCEOMMENDATION: Staff is recommending the adoption of Article Xlll ( The International Residential Code 2000) to the currant Building Code of Ordinances. This code addresses requirements for mostly residential construction, tt will gives the City of Port Arthur new criteda for Windstorm resistance construction in this area. The adoption of the 2000 International Residential Code will bring the City of Port Arthur up to date on new code regulations being utilized throughout the country. BACKGROUND: The State Legislature enacted Senate Bill 365, which adopted the Intemational Residential Code 2000 edition. The State requested that all municipalities review this code and adopt all or portions of the cede for enforcement. The International Residential Code applies to all construction, alteration, remodeling, enlargements, and repair of residential stnJctures in a municipality. The State recommended that municipalities adopt all or parts of this new Code by December 2001. This Code is being recommended by Staff in order to provide continued protection for the citizens of Port Arthur. BUDGET AND REVENUE IMPACT: Acceptance of this Code will not require any additional funds. STAFF LEVEL IMPACT: Adoption of the International 2000 Residential Code will have no impact on current staff. · Page 1 ~0.5308 1~0~02 ORDINANCE NO. __ AN ORDINANCE AMENDING CHAPTER 18 OF THE CODE OF ORDINANCES OF THE CITY OF PORT ARTHUR BY ADDING A NEW ARTICLE XIII TO THE CODE ORDINANCES OF THE CITY OF PORT ARTHUR AS TO ADOPT THE 2000 INTERNATIONAL RESIDENTIAL CODE AND LOCAL AMENDMENTS THERETO, WITH A PENALTY NOT TO EXCEED $2000 PER VIOLATION AND PROVIDING FOR THE PUBLICATION THEREOF WHEREAS, the City Council deems it in the best interests of the citizens of the City of Port Arthur to add a new Article XIII to the Code of Ordinances, as to adopt the 2000 International Residential Code with the local amendments as per Senate Bill 5; and NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions In the peramble are true and correct. Section 2. That Chapter 18 of the Cede of Ordinances, City of Port Arthur, Texas, is hereby amended by adding a new Article XIII, which section reads as denoted in Exhibit u A ~. Section 3. That all ordinances or parts of ordinances in conflict herewith are herein repealed, but only to the extent of said conflict. Section 4. That any person who violates any provisions of this Ordinance or who shall neglect to comply with the terms hereof shall be be guilty of a misdemeanor and shall on conviction thereof be fined in any sum not less than One ($1.00) Dollar nor more than ($2.000) Dollars as provided In the Code of Ordinances, and each violation shall constitnte a separate offense. Section5. That this Ordinance or its caption and penalty shall be published one (1) time within ten (10) days after final passage hereof In the official newspaper of the City of Port Arthur. This Ordinance shall take effect Immediately after date of publication. Section 6. That a copy of the caption of this Ordinance be spread upon the Minutes of the City Couecll. The International Residential Code dated January 2000 as published by thc International Code Council is hereby adopted, with the following local amendments Section R102.5 Appendices: Adopt appendices A - Sizing and Capacities of Gas Piping B - Sizing of Venting Systems C- Exit Terminals of Mechanical Vent Appliances D - Safety Inspection of Existing Appliances E - Manufactured Housing Used as Dwelling G - Swimming Pools, Spas and Hot Tubs H - Patio Covers J - Existing Buildings and Structures Section R1'05.2 Work exempt from permit: Amend to state that, "Only work whose valuation is less than $,100 dollars shall be exempt from permit/fcc". Section RI 12 Board of Appeals: Amend to add that the "Board of Appeals is the same as thc Construction Board of Adjustment and Appeals as set forth in Section 18-41 of City Codes of Ordinances." Section Ri 12.2.2 Criteria for issuance of a variance for areas prone to flooding: Amend to add that "The Zoning Board of Adjustments and Appeals is authorized to grant variances in flood regions." Section R301.2.1 Design Criteria: Amend to add, "The Southern Building Code Congress International Standard for Hurricane Resistant Residential construction SSTD 10-99 is adopted for usc. Cold- formed steel construction shall be designed in accordance z.po5232 Section Two. .Section Three. with the provisions of this code." Section P2904.5.1 Under Concrete Slabs Amend to add, "Inaccessible water distribution piping under concrete slabs shall be copper water tube minimum type "L"." Section P3002.1 Piping within Buildings: Amend to add, "Piping within buildings shall be schedule 40 PVC DWV pipe and fittings, cast iron, or copper pipe and fittings." Section I>3002.2 Building Sewer: Amend to add, "Building sewer piping shall be a minimum of 4 inches and conform to P3002.1 Six (6") inches and larger sewer may be SDR 35 or better." Section P3102.1 Main Vent Required: Amend to add, "Every building shall have a minimum of a three (3") inch main vent that is either a vent stack or stack vent. Such vent shall run undiminished in size and directly as possible from the building drain through to the open air, extending at least six (6") inches above the roof lowest elevation." Section P3113.1 Size of Vents: Amend to add, "The minimum required size of vent pipes shall be at least 65% of thc required diameter of the drain it serves,' Vents shall not be less than 1% inches in diameter. 9ents exceeding 40 feet in developed lehgth shall be increased by one pipe size for the entire length of vent pipe." The Director of Community Services or hii~designee shall enforce this Code.
