Introduction:
Approval of Proposed Resolution No. 21750 authorizing the City Manager to execute a change
order to the contract with SETEX Construction Corp. of Port Arthur, Texas for the Sabine Pass
area ditch cleanout in an amount not to exceed of$14,707.00.
Background:
This change order will allow for the rental of additional equipment needed in the area between
Hwy 87 and the Sabine Pass High School football field. The ground in this area was too soft,
not allowing for the use of dump trucks and other heavy equipment. Additional equipment
will have to be rented, i.e.,tracks and a marsh dump buggy, in order to clean this area.
Budget Impact:
Funds are provided in Account No. 001-1204-531.34-00, Public Works Department Drainage
Division— Drainage Maintenance.
Recommendation:
It is recommended that City Council authorize the City Manager to approve P. R. No. 21750,
as discussed and/or outline above.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO
EXECUTE CHANGE ORDER NO. 1 TO THE CONTRACT WITH
SETEX CONSTRUCTION CORP. OF PORT ARTHUR, TEXAS,
FOR THE SABINE PASS AREA DITCH CLEANOUT
INCREASING THE CONTRACT AMOUNT BY $14,707.00 TO A
NEW CONTRACT TOTAL OF $80,302.31. FUNDING
AVAILABLE IN PUBLIC WORKS DEPARTMENT DRAINAGE
DIVISION—DRAINAGE MAINTENANCE ACCOUNT—001-1204-
531.34-00.
WHEREAS, on October 13, 2020, per Resolution No. 20-345, the City Council awarded
a contract for the Sabine Pass area ditch cleanout to SETEX Construction Corp. of Port Arthur,
Texas, in the amount of$65,595.31; and,
WHEREAS, during construction of the project, it was determined that the ground in the
area between Hwy 87 and the Sabine Pass High School football field was too soft to maintain
heavy equipment requiring additional rental equipment to complete the project; and,
WHEREAS, SETEX Construction Corp. has submitted Change Order No. 1,Exhibit"A",
for the project and the Public Works Department staff recommends approval; now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
THAT,the facts and opinions in the preamble are true and correct; and,
THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to
execute, on behalf of the City of Port Arthur, Change Order No. 1 to the contract between the City
of Port Arthur and SETEX Construction Corp. increasing the contract amount $14,707.00. to a
new total of$80,302.31; and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.

This will serve as our proposal to Excavate, Grade and Remove sediment build up on both sides of the
700 ft ditch discussed. Sediment, Grass & Debris will be moved to a Location Across 11"'Ave. Costs
include supervision insurance, material, labor and equipment

• Moving any City Water/Sewer Tap
• Gas lines
• Bores for water or Sewer across road ways
• Sales Tax
• Hydroseeding or Sod Replacement
• The scope of work under this contract expressly does NOT include investigation, detection,
abatement,replacement, removal or detoxification of a Hazardous Environmental Condition.
• 'Hazardous Environmental Condition" means any type or form of Chemicals, Oils, Sewage,
asbestos, lead or Petroleum byproducts.
• Performance and payment bonds.
• Unforeseen items beyond scope/underground obstructions.
Total Proposed Cost $ 14,707.00
We estimate approximately(5)working days' total duration.
