RESOLUTION NO.
A RESOLUTION AS IT PERTAINS TO EMERGENCY
DEBRIS REMOVAL CAUSED BY HURRICANE.IKE AND THE
RIGHT OF ENTRY PROGRAM
WHEREAS, the City of Nederland, Port Neches, and Groves went
out for proposals for debris removal; and
WHEREAS, the cities of Nederl<~nd, Port Neches, Groves, and thce
City of Port Arthur received the exact same terms, conditions, anal
pricing for debris removal; and
WHEREAS, the prices for the haul rate are as delineated in tY:~e
response to the Supplemental Quesi~ionnaire and said rates will be
used by DRC Emergency Services, LLC; and
WHEREAS, it is in the public's interest if the City worked
with the cities of Nederland, Port Neches, and Groves via their
Cooperative Purchase Agreement for• Disaster Recovery Services, ar.~d
this will facilitate reimbursements from FEMA; and
WHEREAS, the City of Port Arthur has reviewed the Cooperative
Purchase Agreement and agrees to the terms and conditions thereof
and further agrees to the fair and reasonableness of the pricing;
and
WHEREAS, it is in the best interest of the citizens to al~;o
sign the Cooperative Purchase Agreement, in substantially the same
form as noted in Exhibit "A"; and

WHEREAS, the City of Port Arthur wants to expedite debris
removal once the Right of Entry Program is implemented as to remove
debris on private property, which will be reimbursed by FEMA; anal
WHEREAS, to facilitate the processing of invoices and tx-uckin.g
of the debris removal, the following rates are applicable:
Gather/collect, haul to TDSRS, process, chip/mulch
and haul out will be $16.04/cy as the actual debris
is substantially equally located between less than 15
miles and less than 25 miles to the TDSRS.
Gather/collect, haul to TDSRS, process, open burn and
haul out will be $15.64/cy as the actual debris is
equally located between less than 15 miles and less
than 25 miles to the TDSRS.
and
WHEREAS, the cost associated with landfill disposal fees will
be a pass-through cost, with DRC invoicing the City at actual cost.,
without any additional fees or markup; and
WHEREAS, DRC submitted the proposals, as denoted in Exhibit
"B", which was in response to a Request by Proposals by the City of
Galveston, as it pertains to their rate for the Right of Entry
Program; and
WHEREAS, the City deems it ir.~ the public interest of the City
to also adopt said pricing for the Right of Entry Program, which
the City agrees to the fair and reasonableness of the pricing; and
WHEREAS, the Right of Entry Program will only be at the option
of the City and will only be implemented as Notices to Proceed aY-e
issued by the City and the City ca.n use other companies if it deems

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble aY•e
true and correct.
Section 2. That the City Manager is herein authorized to
sign the Cooperative Purchase Agreement as noted in Exhibit. "A".
Section 3. That the City accepts the rates for the Right
of Entry Program, as delineated in. Exhibit "B", as to the fair anal
reasonableness of the pricing.
Section 4. That DRC will also sign this Resolution
agreeing to the terms thereof.
Section 5.
That a copy of the caption of this Resolution
be spread upon the Minutes of the Corporation.

The City of Port Arthur, herein represented by its
duly authorized officer, has a desire to enter into a
Cooperative Purchase Agreement for Disaster Recovery
Services, under the same terms and conditions as the
agreement between DRC Emergency Services, LLC and the
cities of Nederland, Port Neches, and Groves, which
agreement with the cities of Nederland, Port Neches, and
Groves has an effective date of May 22, 2007, and which is
adopted herein and incorporated by reference, which
agreement resulted from a competitive RFP.
The City of Port Arthur has reviewed the above
referenced agreement and agrees to the terms and conditions
thereof and further agrees to the fair and reasonableness
of the pricing, which is the exact same terms, conditions,
and prices, as denoted in the City's agreement with DRC, as
approved by Resolution No.'s 07-544 and 07-223. The prices
for the haul rate are as delineated in the Response to the
Supplemental Questionnaire and said rate will be used by
DRC.
DRC Emergency Services, LL,C hereby agrees to provide
such services under the same price(s), terms, and
conditions as the referenced contract with the cities of
Nederland, Port Neches, and Grc>ves.
As to facilitate the processing of invoices and
trucking of the debris removal, the following rates are
applicable:

A. Right of Entry (ROE} Debris Removal, Leaners, Bangers, and Stamps
I . The cost associated with picking up, loading and hauling of vegetative debris from the
rights-of-entry to a Debris Management Site will be as follows:
