"Bob"Bowers Civic Center To: The Honorable Mayor and City Council Through: Ron Burton, City Manager From: Adam J Saunders, Civic Center Dir RE: Proposed Resolution No. 21845 REQUEST: Pursuant to Resolution No. 20-191, City Council authorized the Phase II repairs to the Department Club located at 1924 Lakeshore Drive. The repairs are now completed and the Contractor, McInnis Construction, Inc. of Silsbee, Texas, is requesting that the City accept the Certificate of Substantial Completion for Phase II and authorized the release of Retainage in the amount of$23,137.00. ANALYSIS/CONSIDERATION: Phase II to the renovations of the Department Club is completed and acceptance of the Certificate of Substantial Completion is requested by the contractor. RECOMMENDATION: A proposed resolution to approve and accept the Certificate of Substantial Completion for Phase II Renovations to the Department Club and release of Retainage in the amount of$23,136.99. BUDGETARY AND FISCAL EFFECT Funds available in account 140-1405-551.59-00 PROJECT M97910 (HOTEL OCCUPANCY TAX FUNDS.) STAFFING EFFECT None PR 21845 P.R. No. 21845 03/10/2021 RESOLUTION NO. A RESOLUTION AUTHORIZING THE ACCEPTANCE OF THE CERTIFICATE OF SUBSTANTIAL COMPLETION FOR PHASE II RENOVATIONS TO THE DEPARTMENT CLUB AND RELEASE OF RETAINAGE IN THE AMOUNT OF $23,137.00. FUNDS ARE AVAILABLE IN ACCOUNT 140-1405-551.59-00; PROJECT M97910 (HOTEL OCCUPANCY TAX FUNDS). WHEREAS, pursuant to Resolution No. 20-191, City Council authorized the Phase II repairs to the Department Club, former known as the Federated Women's Club Building located at 1924 Lakeshore Drive; and WHEREAS, the work performed under the Contract with McInnis Construction, Inc. of Silsbee, Texas for renovations to the Department Club has been reviewed and deemed to be substantially complete as of March 10, 2021; and, WHEREAS, the Contractor is requesting approval and acceptance of the Certificate of Substantial Completion and release of the Retainage in the amount of$23,137.00. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That, the City Council hereby approves and accepts the Certificate of Substantial Completion submitted McInnis Construction, Inc. of Silsbee, Texas, and authorize the City Manager to release the Retainage in the amount of$23,137.00, as provided in Exhibit"A". Section 3. That, the City Council deems it is in the best interest of the City to authorize the City Manager to execute said Certificate of Substantial Completion. Section 4. That, a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
