No. 21864 —A resolution calling for a public hearing to consider granting a permit for the drilling of an oil and gas well. Introduction: This Agenda Item intends to request a public hearing to consider a permit for drilling an oil and gas well on Section 9, T&NO RR Survey, Abstract No. 242, Port Arthur Jefferson County, Texas. An application was submitted by Aspect Energy, LLC in accordance with Chapter 66, Section 66-3 of the Code of Ordinances. Background: On August 14, 2019, Acadian Land Services, LLC, submitted an application on behalf of Aspect Energy, LLC requesting a permit to drill, deepen, or operate a well within the City's regulated area. The Port Arthur City Council approved Permit No. 172 (Res. No. 19-450) on October 7, 2019, at a regularly scheduled meeting. The term of the permit was for one year from the date of execution and renewable yearly thereafter, after applying for such extension in writing to the Director of Planning & Development Services and City Council throughout the duration of drilling or commercial operations pursuant to such permit. The permit expired on October 7, 2020; therefore, requiring the applicant to resubmit an application for the issuance of a new permit. On February 22, 2021, Aspect Energy, LLC submitted a new application for a permit to drill, deepen, or operate a well within the City's regulated area. In accordance with Chapter 66, Section 66.3(c) of the Code of Ordinances, the decision of whether or not to grant the application shall be within the city council's discretion after public hearing and shall not be subject to review. Budget Impact: In accordance with Chapter 66, Section 66-3(b)(2), each application shall be accompanied by a cashier's check for $1,500.00 made payable to the City, which shall be a filing fee. Recommendation: It is recommended that City Council approve P.R. No. 21864, calling for a public hearing to consider a permit for drilling an oil and gas well on Section 9, T&NO RR Survey, Abstract No 242, Port Arthur Jefferson County, Texas. A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER GRANTING A PERMIT FOR THE DRILLING OF AN OIL AND GAS WELL, REQUESTED BY ASPECT ENERGY, LLC WHEREAS, the applicant—Aspect Energy, LLC, is requesting that the City of Port Arthur consider granting a permit for the drilling of an oil and gas well on Section 9, T&NO RR Survey, Abstract No. 242, Port Arthur, Jefferson County, Texas, as delineated in Exhibit "A"; and, WHEREAS, pursuant to Chapter 66, Section 66.3(c) of the Code of Ordinances, the decision of whether or not to grant the application shall be within the city council's discretion, after public hearing and shall not be subject to review. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT the facts and opinions in the preamble are true and correct. THAT in accordance with Chapter 66, Section 66-3(c) a public hearing to consider whether to grant this applicant a permit for the drilling of an oil and gas well on Section 9, T&NO RR Survey, Abstract No. 242, Port Arthur, Jefferson County, Texas, as delineated in Exhibit "A", shall be held on April 27, 2019 at 9:00 a.m. through telephonic or videoconferencing. THAT notice of the public hearing shall be published in the official newspaper of the City at least ten days before going to the City Council. THAT a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
