The City Council of the City of Port Arthur met in Regular Session on Tuesday, January 5, 2021 at 11:07 a.m. in the City Council Chamber, City Hall, with the following members present: Mayor Pro Tem Charlotte Moses; Councilmembers Ingrid Holmes, Cal Jones, Thomas Kinlaw, III, Kenneth Marks and Donald Frank; City Manager Ron Burton; City Secretary Sherri Bellard; City Attorney Valecia R. Tizeno and Sergeant At Arms Police Chief Tim Duriso. Mayor Thurman Bill Bartie was absent from the Regular Meeting. II. PROCLAMATIONS Proclamations The Mayor Pro Tem issued the following Proclamation(s): January 5, 2021 as "Dr. William George Day" January 5, 2021 as "Port Arthur Memorial Titan Football Team Day" III. CONSENT AGENDA Upon the motion of Councilmember Frank, seconded by Councilmember Kinlaw and carried, the following Consent Agenda items were adopted: Voting Yes: Mayor Pro Tem Moses; Councilmembers Holmes, Jones, Kinlaw, Marks and Frank. Voting No: None. A. Travel Request — None B. Expense Reports - None C. Minutes — None D. Resolutions (1) P.R. No. 21663 — A Resolution Authorizing The Execution Of A Homebuyer's Written Agreement For The Down Payment Assistance And Closing Fees Associated With The Purchase Of 1021 Reverend Dr. Ransom Howard Street, Port Arthur, Texas, Through The City's Homebuyer's Assistance Program Proposed Resolution No. 21663 was adopted becoming Resolution No. 21-001. (2) P.R. No. 21730 — A Resolution Authorizing The City Manager To Execute Change Order #1 To The Contract Between Perry Construction Of Cypress, Texas For The Installation Of Three Additional Concrete Piers To The Permanent Scale Construction At The City Of Port Arthur Municipal Landfill Increasing The Contract Amount By $20,651.00 To A New Contract Amount Of $292,976.00. Funding Is Available In Account No. 625-1801-533.92-00 Proposed Resolution No. 21730 was adopted becoming Resolution No. 21-002. (3) P.R. No. 21731 — A Resolution Authorizing The Police Department To Purchase 13 Protech Titan Heavy Ballistic Vests And Accessories For The Police Department SWAT Team From GT Distributors Under Buyboard Contract #603-20 With Funds Awarded From The 2020 Law Enforcement Terrorism Prevention Program (LETPP) Grant In The Amount Of $26,937.05 With No Cash Match Requirement. Funding Available In Account 107-1118- 521.29-00, Project Code R20395 Proposed Resolution No. 21731 was adopted becoming Resolution No. 21-003. (4) P.R. No. 21736 — A Resolution Authorizing The City Manager To Enter Into An Interlocal Agreement Between The City Of Port Arthur And The Department Of Information Resources (DIR) Allowing Use Of The DIR Shared Services Program Proposed Resolution No. 21736 was adopted becoming Resolution No. 21-004. VII. ITEMS REQUIRING INDIVIDUAL ACTION — NON-CONSENT A. Resolutions - None B. Ordinances (1) P.O. No. 6925 — An Ordinance Extending The Declaration Of Disaster Pursuant To §418.108(b) Of The Texas Government Code The Mayor Pro Tem introduced the above-mentioned Proposed Ordinance. Upon the motion of Councilmember Jones, seconded by Councilmember Holmes and carried, Proposed Ordinance No. 6925 was adopted becoming Ordinance No. 21-01. Voting Yes: Mayor Pro Tem Moses; Councilmembers Holmes, Jones, Kinlaw, Marks and Frank. Voting No: None. City Council Minutes Regular Meeting —January 5, 2021 2 The caption of Ordinance No. 21-01 reads as follows: ORDINANCE NO. 21-01 AN ORDINANCE EXTENDING THE DECLARATION OF DISASTER PURSUANT TO §418.108(B) OF THE TEXAS GOVERNMENT CODE VIII. *CLOSED MEETING (EXECUTIVE MEETING) Closed Meeting: (1) Section 551.071 Government Code — To Discuss And Receive Legal Advice From The City Attorney Regarding Potential And/Or Pending Litigation And Other Legal Matters Involving The City Of Port Arthur (2) Section 551.072 Government Code — To Discuss or Deliberate The Purchase, Exchange, Lease, Or Value Of Real Property Located In The City's Industrial District/ET] (3) Section 551.087 Government Code — To Discuss Economic Development Incentives In The City's Industrial District/ET) The City Council recessed their meeting at 11:30 a.m. to meet in Executive Session to consider the above-mentioned topics and reconvened their meeting at 12:49 p.m. with the following members present: Mayor Pro Tenn Moses; Councilmembers Holmes, Jones, Kinlaw, Marks and Frank; City Manager Burton; City Secretary Bellard; City Attorney Tizeno and Sergeant At Arms Chief Duriso. IX. ADJOURNMENT OF MEETING Upon the motion by Councilmember Frank, seconded by Councilmember Kinlaw and carried unanimously, the City Council adjourned their meeting at 12:51 p.m. An audio-tape of this meeting is on file in the office of the City Secretary and is made a part of the official minutes of this meeting.
