A substation is to be built. The site was scheduled to have a public hearing as planner was unaware until researching the history that the si1:e had changed in 2006 to Light Commercial "LC" and then a Planned Development "PD" for all "LC" uses. The public hearing is not required since this is not aresidential- subdivision of land (See Exhibit) Applicant- Arceneaux & Gates Owner- Total Industries (Port Arthur Group) RECOMMENDATION: Staff has no objections to this request, as the land so zoned "PD-25" as described for such uses. Article I, Section 7 of the Charter of the City of Port Arthur, the City has the power to abandon and vacate streets, public road rights-of--way, alleys and easements, subject to the provisions of Article VI. (Abandoning and Vacating City Streets., Alleys and Easements; Conveying, Selling and Exchanging City Land of Chapter 94 of the Code of Ordinances of the City of Port Arthur; and, WHEREAS, a request has been received to abandon certain streets located in the Fairlea Addition, City of Port Arthur, Texas; and. The exhibits attached displays some of the cases in addition to the status of the roads, houses, and present bland - use. The lots with the blue squares against a yellow background depicts houses and lots with pending contacts for sale to Total, while those with blue squares against red sections are where residents exist. Vacant lots not awned by Total are the red square The process of abandonment started in: 2005 A05-01-Case then was to abandon Grandview Avenue between 32"d Street and 39th Street( east to west) as well as just north to Locust Avenue except by Laurel Street -the abandonment stopped by the easement between Block 13 and 114. After several discussions this went to the Planning Commission-December 119, 2005 and the Council for approval on August 29, 2006. The amount of $15,E>50 was obtained Z05-08- Zoning was done on the same exhibited areas to change the use from "SF"-"LC" (Single-Family to Light Commercial, for parking and office buildings). This zoning was later revised as Ordinance 06-06 as changes from SF- PD-25 2006 Z06-16- Zoning to change "SF" (Single-Family) to "PD-25" (Planned - Development-25); the planned development district will include Grandview and portions mentioned in A05-01 in addition to land south of Coke and North of Grandview bordered by the eastern ETJ vicinity that has Kansas City rails. Rezoning is to allow for offices and training facilities December 12, 2006 was the P & Z meeting and Council hearing was f=ebruary 13, 2007 with Ordinance 07-17 A06-04 and 05 At a cost of $200 2008 Z08-01 -Rezoned of 11 cares of SF to PD-25. A boarder area was encompassed (Lots 4-26 Block 2, Lots 4-10, and 14-2iD Block 5, Lots 1-20, Block 6 and L.ot 1 Block 14, Fairlea Addition. A substation, more offices trailers and facilities are expected; P & Z February 18, 2008 and City Council was March 25, 2008 A08-01 ROW to be abandoned see (Exhibits B1 and 2). Case went to P 8~ .? The value of $15,000 for 4.05 acres established in 2006 equates to $3,704 per acre or .085 per square foot. We agree that this value its still valid for the current abandonment request. Using the dollar value of .085 per square foot and the estimated sq. ft. total of 101;650 sq. ft., a dollar value of $8,640.25 is calculated. There are 24 rooming sites, with related parking- out of the Dennis Gahagan League, Tract 103, A-133, Port Arthur Texas, and Jefferson County. The location is north of Highway 82 (T.B. Ellison Parkway) and approximately 13 tracts west of Sabine Lake by the bridge to Louisiana. The zoning is "HC" (Heavy Commercial District). The land is not being subdivided; hence the entire tract is being utilized for this lodge. Applicant- Mr. Weber Owner- Jerome Weber RECOMMENDATION: Staff has no objections to this request; fire response will be from Sabine and the Police Department as an annex in the area. BUDGETARY/FISCAL EFFECT: None STAFFING/EMPLOYEE EFFECT: None SUMMARY: The Sabine Fishing should be approved with. the consent of the owner willing to comply with all the City's Subdivision Rules, City Ordinances and Codes. The zoning was to encourage such uses and the use is less impacting that other heavy commercial use.
