A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN INDUSTRIAL DISTRICT AGREEMENT WITH EMERALD BIOFUELS, LLC WHEREAS, Emerald Biofuels, LLC is requesting that the City of Port Arthur enter into an Industrial District Agreement (IDA) solely for the purpose of constructing new Renewable Diesel Production Facility, on approximately 18.71-acre parcel of land located at the GT OmniPort site, that will convert, at its design capacity, approximately 7,865 barrels per day ("BPD") of pretreated solid waste (predominantly waste fats, oils, greases and other agricultural oils) into approximately 7,224 BPD (or approximately 105 million gallons per year ("MGPY")) of renewable diesel fuel and approximately 20 MGPY of naphtha, liquefied petroleum gas, lean gas and soap stocks; and WHEREAS, pursuant to Sections 42.044 and 212.172 of the Texas Local Government Code, and Article 1, Sections 5 and 6, of the City's Charter, the City Council of the City of Port Arthur deems it in the best interests of the citizens of Port Arthur to enter into a separate Industrial District Agreement with Diamond Green Diesel, LLC. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Council hereby authorizes the City Manager to execute an Industrial District Agreement with Emerald Biofuels, LLC exclusively for the construction of s.pr21968 Emerald Biofuels a new Renewable Diesel Production Facility inside the existing GT OmniPort Site, in substantially the same form as, attached hereto as Exhibit "A". Section 3. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council.
